Subject: Director's Minor Modification, D1R- 2010 -27, to allow Clearwire to upgrade an
existing wireless communication 3 facility on the AMC Theater by adding four
and relocating two existing microwave dish antennas at 10123 North Wolfe
Road
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen cale: idar days.
BACKGROUND
The applicant, Sandra Miguel, of FMHC Corporation, representing Clearwire, is
proposing to upgrade an existing wireless communications facility on the rooftop of the
AMC Movie Theater at the Vallco Shopping Mall at 10123 North Wolfe Road. The
existing wireless communications facility was recently approved under DIR- 2010 -02,
which allowed the installation of three microwave dishes, three panel antennas, and an
equipment platform. One microwave dish was not installed. Condition of approval #6
required a screening structure on the east ;North Wolfe Road - facing) side of the
building to screen the mechanical equipment. The Building Division granted final
approval of the screening structure in July 2010.
The proposed upgrade consists of installing a total of four side - mounted microwave
dish antennas (in addition to the five existing antennas) on the rooftop edge and
relocating two existing microwave dish antennas, all visually screened by new RF-
transparent screen walls that are painted z nd textured to match the existing building
exterior (See the photo illustration below). After the upgrade, there will be a total of
nine antennas in the wireless facility.

DISCUSSION
The proposed wireless
facility complies with the
City's Wireless
Communications Facilities
Ordinance (CMC chapter
19.108) . The antennas are
proposed to be vertically
mounted to the building,
which exempts them from
the 55 foot height
restriction. The proposed
wireless facility is located
more than the minimum 75
feet required by ordinance
from a residentially zoned
property, which is 375 feet
away.

The proposed wireless facility is also consistent with the pertinent policies contained in
the City's Wireless Facilities Master Plan.' Che plan prefers that wireless facilities be
located on existing non - residential buildirgs, one of which was identified as the AMC
Theater / Vallco Shopping Center building on the candidate locations map. All antennas
and dishes will be painted to match the existing building or sited behind screen walls as
depicted in the photo simulations.
The additional microwave energy generated by the dishes is highly directional and
poses an insignificant additional public exposure.
ACTION
The Director of Community Development deems the modification minor and approves
the upgraded wireless facility with the fol _owing conditions of approval. State law
requires a minimum 10 -year permit for personal wireless service facilities.

A2, A2.1, A3, and A4 except as may be amended by the conditions contained in this
resolution.
2. NOTICE OF FEES, DEDICATIONS, Rl?SERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation r 2quirements, and other exactions. Pursuant to
Government Code Section 66020(d) (1; , these Conditions constitute written notice of
a statement of the amount of such fees, and a description of the dedications,
reservations, and other exactions. Ycu are hereby further notified that the 90 -day
approval period in which you may pr Dtest these fees, dedications, reservations, and
other exactions, pursuant to Government Code Section 66020(a), has begun. If you
fail to file a protest within this 90 -day Deriod complying with all of the requirements
of Section 66020, you will be legally barred from later challenging such exactions.
3. ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous
period of 18 months, said antennae and associated facilities shall be removed. The
applicant shall bear the entire cost of demolition and removal.
4. EXPIRATION DATE
This Director's Minor Modification shall expire ten (10) years after the effective date
of the permit on August 24, 2020. The applicant may apply for a renewal of the
minor modification at which time the Director of Community Development may
review the state of wireless communication and camouflage technologies to
determine if the visual impact of the personal wireless facility can be reduced.

This Director's approval is effective August 24, 2010. The fourteen calendar day appeal
period will expire on September 7, 2010.
