Date: July 29, 2010 Subject: Director's Minor Modification, DIR-2010-21, modifying use permit file no. 31-U-86, to allow live entertainment & music activities at Vallco Shopping Mall located at 10123 N. Wolfe Road Chapter 19132 of the Cupertino M.znicipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Plannulg Corrunis �ion in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND: Mike Rohde, the General Manager of the Vallco Shopping Mall, has requested permission to allow limited live entertainment and music activity at the mall. Tatami Sushi and Seafood Buffet, a tenant at the Mall, has previously re�:eived approval from the City to allow live music at their restaurant on an interim basis with a r'emporary Use Permit. DISCUSSION Ancillary live entertainment and music acti �ity is compatible with the operation of a mall and/or restaurant establishments. Staff suppc�rts the proposal with the following conditions: 1) The maximum number of entertainme�lt permits shall be limited to ten (10) at any given time. 2) All live entertainment and music activ ity shall be conducted indoors and occur beiween the hours of 7 a.m. to 11 p.m. (except during other permitted special events) 3) This permit does not allow any live en1 ertai.nment or music activity in any of the parking lots or garages. 4) All live entertainment and music acti� ity shall be permitted with the issuance of a Live Entertainment Permit approved by tr e Director of Community Development pending review and approval by the Buildin�;, Fire, Sheriff or other Departments as deemed necessary. ACTION: The Director of Community Development d�ems the project minor and approves the Minor Modification of Use Permit 31-U-86 with the c�nditions outlined in this report.
