A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
MAKING ITS ORDER AND DESCRIBING BOUNDARIES FOR REORCANIZATION
BETWEEN CUPERTINO AND THE COUNTY OF SANTA CLARA AND WITHDRAWAL
FROM THE COUNTY LIGHTING SERVICE AREA IN ACCORDANCE WITH THE
DISTRICT REORGANIZATION ACT OF 1965 WITHOUT A PUBLIC HEARING AS
PROVIDED BY LAW; APPROXIMATELY 1.76+ ACRES LACATED NORTN OF
BYRNE AVENUE
WHEREAS, purtsuant to provisions of the Distrtict Reorganization Act of
1965, a petition for reorganlzation was filed aith the Local Agency
Formation Commission involving:
a) Annexation of unincorporated area in the County of Santa C1aYa to
the City of Cupertino;
b) WithdCawal ft`om the County Lighting SeCVice aCea.
WHEREAS, the Santa Clara County Local Agency Formation Commission, by
Resolution No. 84-04 adopted the 8th day of February, 1984, has authoCized
the City of Cupertino to annex this uninhabited teCCitory designated "San
Fernando Avenue 84-1" and descCibed in Exhibit "A" without notice, hearing
or election in accordance with Section 56439.5 of the Government Code; and
WNEREAS, annexation has no environmental impact on the area; and
WHEREAS, the City Council finds that it is to the best interest of the
City and of the tePritoCy proposed to be annexed that the territory be
annexed without public hearing;
NOW, THEREFORE, BE IT RESOLVED that the territory desePibed in Exhibit
~~A~~, attached hereto and made part hereof, is hereby annexed to the City
of Cupertino and withdrawn from the County Lighting Service area.
PASSED AND ADOPTED at a regulaC ad~ouYned meeting of the City Council
of the city of Cupertino on this 27th day of February, 1984 by the

State of California, more particuiarly described as follows:
Beginning at the northeast corner of Lot 35 as shown on "Tract No. 198,
Stevens Creek Subdivision, Map No. 3," which map was filed for record
in the office of the Recorder of Santa Clara County in Volume 7 of Maps,
at page 14:
Thence from said Point of Beginning SOUTH, 60.00 feet to the southeast
corner of said Lot 35~
Thence WEST, 170.00 feet to a point on the westerly sideline of San
Fernando Ave;
Thence NORTH, 221.61 feet along said westerly sideline of San Fernando
Ave. to the norcneast corner of Lot 59 as shown on said "Tract No. 198";
Thence N 57°30'E, 165.98 feet along said sideline of San Fernando Ave;
Thence N 62°50'30"E, 150.27 feet along the sideline of San Fernando Ave.
as shown on "Tract No. 150, Stevens Creek Subdivision, Map ~Io. 2", which
map was filed for record in the office of the Recorder of Santa Clara
County in Book 5 of Maps, at pages 4 and 5;
Thence along a tangent curve to the left, with a radius of 30.00 feet,
through a central angle of 62~50'30",and an arc length of 32.90 feet to
a point on the westerly sideline of Byrne Ave. as shown on said afore-
mentioned map;
Thence NORTH, 713.59 feet along said westerly sideline of Byrne Ave. to
a point along the southerly boundary of that certain annexation to the
City of Cupertino entitled "Byrne Ave. 82-04";
Thence EAST, 50.00 feet along said annexation to a point oa the easterly
sideline of Byrne Ave., as shown on "Map of Subdivision "ri', :tonta Jista,"
recorded in Volume P of Maps, at page 20, Santa Clara County Records;
Thence SOUTH 820.85 feet along said easterly sideline of Byrne Ave. as
shown on the aforementioned map;
Thence WEST, 50.00 feet to a point on the westerly sideline of Byrne Ave.
as shown on "Tract No. 139, Stevens Creek Subdivision,Map No. 1", recorded
in Book 4 of Maps, at page 43, Santa Clara County Records;
Thence along a curve to the. left, from a tangent bearing of due NORTH, with
a radius of 20.00 feet, through a central angle of 117°09'30", and an arc
length of 40.90 feet;
