SUBJECT: TREE REMOVAL PERMIT A:�TION LETTER - Application TR -2010-18:
This letter confirms the decision of tr e Director of Community Development,
given on July 19, 2010, approving a tree removal permit to remove and replace one
(1) 22.6" Ash tree at the Silver Oak We�t condominium complex, located at 22665
& 22667 Silver Oak Way, with the follo��ing conditions:
1. APPROVED PROTECT
The approval is based on the A:-borist report prepared by Deborah Ellis,
MS, ISA Certified Master Arborist #WE-0457B, dated March 1, 2010 (this
report is available upon request) pertaining to the Ash tree located 22665 &
22667 Silver Oak Way, except a� may be amended by conditions in this
resolution.
2. TREE REPLACEMENTS
The applicant shall be required to plant one (1) 24-inch box size Chinese
Pistache or Tristania on the property and pay an in-lieu fee for one (1) 24-
inch box tree in accordance with the City's Protected Trees Ordinance. The
required replacement trees shall be planted within 15 days of the effective
approval date of this tree remova] permit.
3. NOTICE OF FEES, DEDICA'I'IONS, RESERVATIONS OR OTHER
EXACTIONS
The Conditions of Project Appr��val set forth herein may include certain
fees, dedication requirements, reservation requirements, and other
exactions. Pursuant to Gover�unent Code Section 66020(d) (1), these
Conditions constitute written no tice of a statement of the amount of such
fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified :hat the 90-day approval period in which
you may protest these fees, dedications, reservations, and other exactions,
pursuant to Government Code �ection 66020(a), has begun. If you fail to

file a protest within this 90-c ay period complying with all of the
requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Staff has made the findings necessary to grant the tree removal permit in
accordance with Section 14.18.180 of the Protected Trees Ordinance.

SUMMARY & RECOMMENDATIONS
Roger Schwartzer of Community Managemen r Services asked me to evaluate an evergreen ash
tree at the Silver Oaks West condominium corriplex. I evaluated this tree on February 26, 2010. The
tree has good vigor but poor branch structure More importantly however, Roger informed me that
the roots of this tree have repeatedly damage d the asphalt driveways on both sides of the tree. The
roots have also broken underground utility line � that run through the planter in which the tree is
located. There have also been leaks in water pipes that run near the tree. Within the past two years
both driveways on either side of the tree have been replaced twice due to tree root damage from
the subject ash tree. Root barriers were installE;d after at least one of the driveway replacements,
but the tree roots have grown over the barrier to damage the pavement again.
Despite all good efforts, the tree will '
most likely continue to damage
nearby hardscape and underground
utilities. Evergreen ash trees are large- ��� ,

relatively small planting area for its

Reason: Wrong tree species planted in the w�ong place!
Mitigation Recommendations: If another tree will be planted in this location, make it a species that
is smaller stature than evergreen ash, and also with a less aggressive root system. There are many
crape myrtle trees (Lagerstroemia indica) plcinted in similar front yard locations along the south
portion of Silver Oak Lane. Crape myrtles ho�nrever, are drought tolerant trees that should not
really be planted in frequently irrigated landscape areas such as lawns. Instead I suggest a tree
species that is more tolerant of frequent irrigcition and lawn conditions, such as goldenrain tree,
Koelreuteria paniculata. This is a deciduous iree species that will allow more light to the front yard
and house during the winter while it is leafles� , and will provide shade during the summer when it is
in leaf.
Notes: The ash tree appears to have good ��igor based upon foliage color and density at this time
of year. Right now it is parfially deciduous ar�d its new spring leaves are beginning to grow. The
tree has a very dense cluster of multiple brarch afitachments This is a common structural defect
in evergreen ash, due to their normal brancring pattern. In this particular tree however, the
multiple attachments are quite dense and ciowded, which I believe increases the chance of a
large branch failure in the future. In addition, the tree was topped in the past, with the topping
cuts made very close to the trunk.
� Condition 8� Preservation Suitability Ratinqs: Trees c�re rated for Condition on a scale of zero to 100 with zero
being a dead tree and 100 being the most perfect tree imaginable (which rarely exists). Using this scale, 100 =
excellent, 80 = good, 60 = fair, 40 = poor, and 20 =��nacceptable. There are two components of tree condition
- Vigor and Structure. Each of these components i� rated separately and then considered relative to the tree
species and use of the site to obtain the Preservatic n Suitability Rating (i.e. "Is this tree worth keeping on this site,
in this location?").
2 Multiple trunk (leadersl or branch attachments arE� a common structural defect in many tree species such as
ash and flowering pear. In this condition, more tha � one branch or trunk originates at or very close to the same
point. These attachments are not as strong as well-�paced branches or trunks, particularly if included bark
between them prevents a solid wood connection. This structural defect can be eliminated or at least reduced
in significance by thinning removal of some of the r�ultiple attachments when the tree is very young (this
defect is large, it is much more difficult to correct.
3 Toppina is the practice of indiscriminately cutting �ack large diameter branches of a mature tree to some
predetermined lower height; to reduce the overall �eight of the tree. Each individual cut is called a heading
cut, and when most or the entire tree canopy is pr� ned in this method this is called topping the tree. Heading
cuts are cuts made to buds, stubs or lateral branch �s not lar e enou h to assume the terminal role at least 1/3

the diameter of the branch portion being cut off). 2eputable arborists no longer recommend topping because
it is a particularly destructive pruning practice. Top �ing is stressful to mature trees and may result in reduced
vigor, decline and even death. In addition, brancr es that regrow from topping cuts are weakly attached to
the tree and are in danger of splitting out. Large tcpping cuts may have significant decay associated with
them, which weakens the branch as well as the att �chment of any secondary branches attached nearby.
Topping is useful however, for immediately reducinc� the risk of a very hazardous tree that will soon be removed.
