A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
CUPERTINO SETTING DATE FOR CONSIDERATION OF
REORGANIZATION OF AREA DESIGNATED "HANFORD
DRIVE 97-11 ", PROPERTY LOCATED ON THE NORTH SIDE OF
HANFORD DRIVE BETWEEN BEARDON AVENUE AND
CUPERTINO CITY LIMITS LINE; APPROXIMATELY 0.228
ACRE, WANG (APN 326-33-024)
WHEREAS, the City Council of the City of Cupertino has received a
request for annexation of territory designated "Hartford Drive 97-11" from
property owner, Kun-Pao Wang by Shou Tung Wang; and
WHEREAS, the property, 0.228+ acres on the north side of Hanford Avenue
between Beardon Avenue and the Cupertino ity limits line (APN 326-33-024) is
contiguous to the City of Cupertino and is within its .urban service area; and
WHEREAS, annexation would provide for use of City services; and
WHEREAS, this territory is uninhabited and was prezoned on December 1, 1997,
to City of Cupertino Pre RI-10 zone; and
WHEREAS, the City of Cupertino, as Lead Agency for environmental review
completed an initial study and granted a Negative Declaration for annexation; and
WHEREAS, the County Surveyor of Santa Clara county has found the map and
description (Exhibits "A" and "B") to be in accordance with Government Code Section
56826, the boundaries to be definite and certain, and the proposal to be in compliance
with LAFCO's road annexation policies; and
WHEREAS, the fee set by the County of Santa Clara to cover staff cost for above
certification has been paid; and
WHEREAS, as provided in Government Code Section 56826 the City Council of
the City of Cupertino shall be conducting authority for a reorganization including an
annexation to the City; and

WHEREAS, Government Code Section 56837 provides that if a petition for
annexation is signed by all owners of land within the affected territory the City Council
may approve or disapprove the annexation without public hearing;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of
Cupertino hereby initiates annexation proceedings and will consider annexation of the
territory designated "Hartford Drive 97-11" and detachment from the Santa Clara County
Lighting Service District at their regular meeting of February 17, 1998.
PASSED AND ADOPTED at a regular meeting of the City Council of the City of
Cupertino this 20th day of January, 1998 by the following vote:

All that certain real property situated in the County of Santa Clara,
State of r~lifornia, being all of Lot 171 of Tract No. 783, GARDEN
GATE VILLAGE ADDITION, filed in Book 30 of Maps at Pages 30-33,
Santa Clara County Records, described as follows:
Beginning at the Northeasterly corner of said Lot on a Westerly line
of the Original City Limits of the City of Cupertino;
Thence along the Northerly line of said Lot, West 87.28 feet to the
Nortbwesierly corner thereof;
Thence along the Westerly line of said Lot, South 115.00 feet to the
Southwesterly corner thereof on the Northerly line of Hanford Drive,
60 feet wide;
Thence along said Noi~herly line, East 40.12 feet;
Thence continue' along said Northerly line along a curve to the left,
tangent to the preceding course, having a radius of 170 feet, 'through
a central angle of 16'09', an arc' distance of 47.92 feet to its
intersection with the above referred to 0rigina] city Limits Line;
Thence leaving said curve from a tangent bearing of N73'51'E and
along the Easterly line of said Lot, also being said line of said
Original City Limits, N0'04'W 108.29 feet to tile point of beginning.
