Subject: Director's Minor Modification, DIR-2010-17, to modify a recently approved
office basement space into residential space and related minor exterior
building changes at an existing mix-use project located at 10048-10050 Orange
Avenue.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
DISCUSSION
The applicant is proposing to convert an existing 406 s.f. basement office space into
residential space. The original Use Permit (U-2006-14) only provided exterior access to
the basement office space. The project includes the following changes:
• Removal and replacement of the existing basement access with a new window
system; and
• Construction of interior stairs to the basement area from the first floor of the
residential unit.
The proposed modifications are contained within the footprint of the existing residence
and the window replacements do not create additional visual/privacy impacts (See
Attachment 1).
ACTION
The Director of Community Development deems the modification minor and approves
the changes with the following condition:
1. DEVELOPMENT ALLOCATION
Based on this modification, the adjusted office allocation for this project is 676
square feet.

2. EASEMENTS
Prior to final occupancy, the pertinent easements on the property shall be
modified and recorded to reflect the change to the use for the basement space.
This approval of the modification is effective May 13, 2010. The fourteen calendar day
appeal period will expire on May 27, 2010.
