Subject: Director's Minor Modification, DIR-2010-14, to clarify the approved occupancy
for a previously approved day care business located at 20100 Stevens Creek
Boulevard
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within f ourteen calendar days.
BACKGROUND
The applicant, Teresa Lai, of Growing Tree Learning Center at 20100 Stevens Creek
Boulevard Suite 160, is requesting to clarify the approved occupancy of its previously
approved day care business from 94 children to 105 children.
On June 16, 2009, the City Council approved an approximately 6,670 square foot pre-
school and day care facility to operate within an existing commercial/office building
(M-2009-03). The application also included a new outdoor play area in a section of the
existing rear parking lot. The day care business was approved with a maximum number
of 94 children based on the available parking calculation provided at the time.
DISCUSSION
Subsequent to the approval, staff was able to confirm that there was an error in the
original parking calculation provided to Council and that the revised parking
calculation permits the day care business to have a maximum of 105 children (see table
below).

The change in the number of students does not require any physical alteration to the
site/building and the play area is adequate to support the increase.
ACTION
The Community Development Director deems the project minor and hereby approves
the modification effective May 7, 2010. The fourteen-calendar day appeal period will
expire on May 21, 2010.
CONDITION
The day care operator is required to secure the necessary permits from the Community
Care Licensing Department, which would involve both Building and Fire Departments
review and approval.
