Subject: Director's Minor Modification, DIR-2010-13, for a temporary use permit to allow
installation of a temporary generator for a period of 30 days on property located at
20740 Valley Green Drive (Apple).
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
BACKGROUND
The applicant, Art Osaki on behalf of Apple, Inc., has submitted an application for a temporary
use permit to allow the installation of a temporary emergency generator for no more than 30
days on the subject property. The temporary generator is needed in case of any interruptions to
power during an upcoming inspection of Apple's main electrical switchgear for this site (See
project description letter). The generator is planned as an emergency backup power source, and
therefore, is not planned to run, unless utility power is lost. Part of Apple's maintenance
program includes a thorough inspection of the main electrical switchgear for the site every 5
years. Because the building on this site houses Apple's data center that performs critical
business data processing, the temporary generator is needed to supply energy should there be
an interruption of power during the switchgear testing. Apple is intending to conduct this
inspection once they receive the City's approval.
The site is located on the southeast corner of Valley Green Drive and Beardon Drive,
surrounded by the Valley Green Apartments to the west across Beardon Drive, industrial office
buildings to the north and east occupied by Apple, and single-family residences to the south.

DISCUSSION
The temporary generator is an 8'x 40' portable, trailer-mounted generator that is self contained
and housed in a weather-tight, sound reducing enclosure with locked doors. Although the
City's Community Noise Control Ordinance allows for exceptions to the noise requirements for
emergency generators as a performance of emergency work, the applicant states that the
temporary generator will still comply with the maximum allowable daytime noise level of 65
dBA per the ordinance. The generator will be located 253 feet away from the southern property
line that abuts the nearest residential uses. At this distance, the temporary generator will not
exceed 65 dBA. The generator is proposed to be located in a parking strip adjacent to the
driveway entrance along Valley Green Drive and will temporarily reduce the site's parking by
10 parking spaces.
Apple has reviewed alternative locations less visible from the street frontages; however, any
other locations than the proposed location are either equally visible along Beardon Avenue, or
are closer to surrounding residential uses.
Staff has added a condition of approval that will require the removal of the temporary
generator no later than 30 days from the effective approval date of this temporary use permit.
ACTION
The Director of Community Development deems the temporary use permit to install a
temporary generator on site as minor, and approves the temporary use permit subject to
the following condition of approval:
1. The temporary generator and all associated equipment shall be removed from
the site no later than 30 days from the effective approval date of this permit.
This approval is granted on April 28, 2010. Please note that an appeal of this decision can be
made within 14 calendar days from the approval date. The fourteen calendar day appeal period
expires on May 12, 2010. If an appeal is filed, a public hearing will be scheduled before the
Planning Commission. If no appeal is filed, the director's minor modification becomes effective
on May 13, 2010.

Apple Inc. is requesting a temparary use permit to allow the installation of a temporary
diesel generator at its facility at 24740 Valley Green Drive, Cupertino. The facility
houses a data center that performs business critical dafia processing for the corparation.
Any interruption of power to the computer equiprnent would have serious consequences
to our business. Because of this, we maintain a high standard for maintenance of the
electrical and mechanical equipment that serves this facility. Part of that maintenance
program includes a thoraugh inspection of the main electrical switchgear every 5 years.
In order to perfarm the inspection the switchgear rnust be de-energized by interrupting
the incoming utility power. The building's e(ectrical system is designed to allow
connection of a temporary generator that can carry the building load during these
inspections.
We are planning ta perform this 5 year inspection by about mid-April. The exact date is
subject to weather, any extraordinary business activity, and availability of the technicians
to perform the inspection. Because the exact date for completion is subject to change, we
are requesting permission to have the generator on site until the end of April. We will, of
course, remove the generator as soon as our maintenance work is completed.
The generator is a portable, t� mounted, generator specifically constructed for
temporary installatians. As such it is fully contained and haused in a weather tight,
sound reducing enclosure, with locking doors. It is also provided with monitorin� to
detect any fuel leaks.
