Capitol Office, 1021 O Street, Suite 4210

RE: AB 2221 (Quirk-Silva) – OPPOSE
Dear Assemblymember Quirk-Silva:
On behalf of the City of Cupertino, I am writing to express our opposition to AB 2221,
which would further remove local control and change state accessory dwelling unit (ADU)
policies.
AB 2221 would prohibit a local agency from establishing limits on front setbacks for
ADUs and imposing floor area limitations of not more than 800 square feet and height
limitations of 16 feet. The City acknowledges that California is facing a housing affordability
and homelessness crisis, but this bill is not the solution.
Cities lay the groundwork for housing production by planning and zoning new projects
in their communities based on extensive public input and engagement. However, this bill
disregards that public process by further removing local control over housing decisions.
The City of Cupertino is committed to being part of the solution to the housing shortfall
across all income levels and will continue to work collaboratively with the Legislature and
Governor to spur much needed housing construction while maintaining local control and
helping the state promote more sustainable development. For these reasons, the City of
Cupertino opposes AB 2221.
Sincerely,
Darcy Paul
