PLANNING DIVISION REVIEW #1 COMMENTS
Additional information/redline changes are required. Any changes to the drawings or calculations
require a delta-revision cloud bubble around the changes and a date stamp indicating when the
changes were made.
Please provide a written response clearly addressing each item and indicate where items are located on
the plan set. Re-submittal without a response letter will be considered incomplete
1. Provide a Written Description of the Event: On a separate sheet of paper, please provide a
written description of the event, introducing the event and event concept to City staff. The event
description should also provide some of the information on your application such as the days
and hours of operation and number of estimated guests. The address you provided for Main
Street Cupertino is no longer in use, please instead use the current address which is 19469
Steven’s Creek.
Next, please clarify how the event will operate and what activities are available to guests. Is a
ticket required to participate in the event? Is the Beer and Wine Booth the only location where
alcohol will be served or are there several wine tasting stations? How will the bar tables be
used, meaning are they each wine tasting pour stations? Depict all alcohol service stations on
your Event Layout Plan.

2. Provide a More Specific Event Layout Map Using a Satellite Image of the Site: The Event
Layout Plan must show the exact locations for the booths and stage in relation to other
structures in the plaza. For this, you will need to use a satellite view of the property. I am
attaching screen shots of this property and I have placed them in a Power Point format.
Please draw a box (under the Insert tab, click on shapes and choose the rectangle) to depict the
exact location of the stage. Please also draw the 10 x 10 canopy tents on the lawn for general
seating. Please also depict the number of rows of chairs on the plaza lawn facing the stage (30
total chairs per your notes, but we also need the number of rows). Please also depict the exact

3. Amplification Noise Restrictions for Performers on the Stage: Please provide a schedule for
performers on the stage. The schedule must comply with the City’s Noise Ordinance which
prohibits noise levels above 70 decibels on any residential property (in this case, the apartment
units at the Lofts) for more than 3 hours. So, amplified music with percussion can only be
played on the stage for 3 hours and the rest of the performances are limited to acoustical
performers with (no percussion and no amplification). This can be a challenging requirement to
meet, but see if you can structure the performances in a way that complies with the noise
requirements.
Please provide a full schedule of performances for both days that will take place on the stage.
The schedule should show the time and day the performance will occur, list the type of
performance, and include whether amplification will be used and during what times and
whether percussion will be used in the performance.
10.48.052 Outdoor Public Events.
A. Outdoor events open to the general public on nonresidential property, such as parades,
rallies, fairs, concerts and special sales and promotional events, involving generation
of noise levels higher than would normally occur, by use of the human voice, public address
systems, musical instruments, electronic amplification systems, and similar sound producing
activities, are allowed upon obtaining an appropriate permit from the city, and subject to the
following general limitations:
1. The event shall not produce noise levels above seventy dBA on any residential property
for a period longer than three hours during daytime.
2. The event shall not produce noise levels above sixty dBA on any residential property
during the period from eight p.m. to eleven p.m., and above fifty-five dBA for any other
nighttime period.
3. Continuous or repeated peak noise levels above ninety-five dBA shall not be produced at
any location where persons may be continuously exposed.
B. The conditions imposed upon the event or activity in the permit issued by the City,
regarding maximum noise level, location of noise sources, or duration of activity, for example,
may be more limiting than this section, to protect certain individuals, areas or nearby activities
which would otherwise be disturbed, and these permit conditions, when in conflict with this
section, are overriding.

4. Provide an On-Site Traffic Management Signage Plan: Since driveway and private street
closures are proposed, you will need to post directional signs at multiple locations on the
property to direct traffic to alternative driveways and parking locations.
Page 3
Please use a satellite view of the property to create a plan depicting and labeling all locations
where directional signs will be placed. Please also print on your plan what the sign will say and
depict any arrows on the sign that will direct traffic. Please also clarify the type of sign that will
be used (A-Frame sandwich board sign or poster).
A sign must be placed on the traffic barrier at the driveway closure stating that the driveway is
closed for an event and directing traffic to an alternative driveway.
Signs must be placed on the traffic barriers at the entrances to the event stating that the road is
closed to traffic and directing traffic to the event parking in the garage on Vallco and then
provide a directional arrow.
Please also propose a sandwich board sign at the entrance to the garage on 10150 N Wolfe Road
where the event and vendor parking will be. The sign should not be on the sidewalk, but back
behind the sidewalk and not where the fencing blocks the sign.
Page 4
Please place sandwich board signs at each of these 3 locations around Main Street Cupertino’s
garage stating that additional parking is located at the Vallco Parkway garage. And the sign at
the traffic light exit to the garage can have an arrow directing traffic toward the garage.

5. Depict on Traffic Flow Plan All Traffic Barrier Locations and Type and Propose Signs at
Closed Driveways and Streets: What traffic control devices will be used at the driveway at
Vallco (cones? barriers?). Please provide a photo example of the barriers that will be used.
Please propose to install traffic barriers at the two vehicle entrances to the event area (circled in
red below).

6. Drop Off Zone Traffic Control: Please depict on your Traffic Control Plan exactly where the
loading zone(s) will be for vendors. How will you be controlling traffic in the drop off zone?
Will cones be placed just for set-up of the event, if so, please show them? To answer this
question, you will need to meet with the security team who will be directing traffic and clarify
with them how the unloading zone will operate for vendors. On your Traffic Control Plan,
show the locations of any individuals who will be directing traffic and label on the plan the
hours that they will be stationed in those locations.

7. Obtain a Letter or Email Communication from the Residence Inn Mariott Hotel: Please
provide a letter or email communication from the managers of the Residence Inn Mariott Hotel
describing how guest check-in will operate while the event is in progress since the event area
will be closed to traffic. Where will hotel guests park to check-in or unload baggage during the
event? On your signage plan, if modified check in procedures will occur, please provide this
direction on signs to direct Mariott guests wishing to check in to the hotel to a different location.
RESPONSE______________________________________________________________________
8. Add Additional Information to your In-Progress Listo of All Vendors Participating in the

in the list. Please add the following additional columns to the table: Name of Business; Business
Contact Person; Items Sold; Is the Business a Non-Profit (501(c)(3) or a For-Profit Business?;

9. Cupertino Temporary Event Business License Required for Each Vendor at the Event and
Any Performers: Every vendor at the event must obtain a Cupertino Temporary Event Business

Page 6
Finance Division and the fee for this calendar year is $13.32 per business if paid with a check, or
$13.32 plus a 3.4% credit card fee (.45 cents, per business), which is $13.68 per business if paid
with a credit card.
Thank you for confirming that your cutoff date for vendor sign-up is 10 days before the event.
The Finance Division requires that the event coordinator pay for all vendor business licenses at
once in a single payment. Please confirm that this will be completed for all vendors.
When you are ready to pay for the permits, please call the Cupertino Business License Division
at (408) 777-3221 to coordinate payment for the Temporary Event Business Licenses, you can
also coordinate to pay the fee in-person at City Hall at 10300 Torre Ave, but please call the
Business License Division first, as they will also need you to send them your vendor list with all
information requested above.

10. Porta Pottie Locations: Please depict the location of the portable toilets more precisely on your
site plan. The porta pottie should be shifted to be back against the sidewalk curb so that a
person exiting the porta pottie steps out into a parking space and not into a lane of traffic.
Additionally, the porta potties cannot be located in a marked handicap space, but they can be
located in regular parking spaces.
