SUBJECT: TREE REMOVAL PERMIT ACTION LETTER - Application TR-2010-06:
This letter confirms the decision of the Director of Community Development, given on
Apri12, 2010, approving a tree removal permit to remove eight (8) Monterey Pine trees
and (2) Redwood trees at 19920 Olivewood Street, with the following conditions:
1. APPROVED PROTECT
The approval is based on the arborist report prepared by Arbor Resources dated
February 9, 2010 regarding the two Coast Redwoods; and the arborist report
prepared by Arborwell Professional Tree Management regarding the eight
Monterey Pine trees and two Coast Redwoods dated February 17, 2010 except as
may be amended by conditions in this resolution. The table below details the tree
removals' locations and required replacements:

2. TREE REPLACEMENTS
The applicant shall be required to plant one (1) 36-inch box tree and (18) 24-inch
box trees in accordance with the City's Protected Tree Ordinance. At least two
replacement trees shall be Coast Redwoods. The replacement trees shall be planted
within 60 days of the approval of this application.
3. REVISED TREE REPLACEMENT PLAN
The applicant shall submit a revised tree replacement plan prior to the tree
removals. Replacement trees shall not be shrubs, and must be planted in the
immediate vicinity of the residential buildings. At least three replacement trees
shall be planted in the courtyard between 10659 and 10649 Maplewood Road.
4. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herei n may include certain fees,
dedication requirements, reservation requirements, and other exactions. Pursuant
to Government Code Section 66020(d) (1), these Conditions constitute written
notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified that
the 90-day approval period in which you may protest these fees, dedications,
reservations, and other exactions, pursuant to Government Code Section 66020(a),
has begun. If you fail to file a protest within this 90-day period complying with all
of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
Staff received comments from two community members regarding this project. One
expressed concerns regarding the loss of shade that would result from the tree removals.
A condition has been added to locate the replacement trees within the immediate vicinity
of residential buildings, and to plant replacements on at least a one-for-one basis in the
courtyard between 10659 and 10649 Maplewood Road.
The other community member expressed concerns about the removals of the two Coast
Redwood trees, particularly regarding the accuracy of the applicant's arborist report,
whether a third party was consulted, and why no quantitative data was supplied. The
City's Consulting Arborist inspected the two Coast Redwood trees and found that the
trees in their current location have the potential to cause damage to the adjacent
foundations and hardscape because of the lignotuber growth at the base of the trunks.
There are no measures that could be employed to reduce the risk of future foundation
damage without increasing the risk of the trees uprooting in the future.
The Consulting Arborist also found that the trees were more susceptible to falling because
of the lack of branches on the lower 25 to 30 feet of their trunks. The concentration of
foliage at the upper half of the trunk creates a greater risk of the top breaking (particularly
during a storm event) than if the foliage was more uniformly distributed along the entire
trunk. City staff concurs with the Consulting Arborist's findings. The City does not
require arborist reports to contain quantitative data.

Staff has made the findings necessary to grant the tree removal permit in accordance with
Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal
of this decision can be made within 14 calendar days from the date of this decision. If
this happens, you will be notified of a public hearing, which will be scheduled before
the Planning Commission and the trees cannot be removed until a final decision on the
appeal has been made. If no appeal is made within the appeal period, the trees may be
removed after Friday, Apri116, 2010.

CONCLUSIONS
My observations reveal the trees to appear in viable condition, however, such a significant
portion of their canopies have been removed (possibly more than 60-percent) that their
longevity and structural integrity have been adversely impacted for their remaining
lifespans. Additionally, new branches that did grow along the lower trunks would be
weakly attached and susceptible to breakage.
Regarding the trees' locations, there is the potential for future damage of adjacent
foundations and hardscape (although none was observed at this time), and there are no
measures that could be employed to reduce this risk to less-than-significant levels without
predisposing the trees to uprooting. The distinct large growth at the bases of both trunks is
called a"lignotuber" (a natural growth of coast redwoods), and has the capacity to move or
damage surrounding foundations and hardscape. The greatest potential for damage to
occur is by tree #85, which is only a few feet from the foundation.
When considering the above information, it is my opinion that the removal of both trees
would conform to Section 14.18.180 of the City Code, provided replacements are installed
as mitigation. In my opinion, the replacements (pursuant to Table A of the Code) should
include at least four trees of 24-inch box size (two per tree removed} versus one of 36-inch
box size based on the lack of trees (both large and small) at the site.
Sincerely,

The tree is about 50 feet tall, and has a canopy spread of approximately 30 feet across. It
appears stable, but its canopy seems sparser and less healthy than tree 84. Similar to tree
#84, the lower 25 to 30 feet of its trunlc is oid of any branches. I also observed that its top
broke out or was removed sometime ago.

Tree #84: coast redwood
This tree (see photos below} is situated approximately midway between building 19980.
Its trunk diameter measures 26 inches at 54 inches above grade, and is about tvvice that size
at grade. Surrounding the trunk is a walkway to the north, and wooden fence to the south,
east and west. A section of the trunk has grown over the walkway by seven inches, and the
trLUik's base abuts the fence to the south and east sides. A laundry room and carport
structure is situated six and-otle-half feet north of the trLUlk's base. I did not observe any
cracking or damage to surrounding hardscape or nearby foundations.

Dear Mr. Schroeder:
You have asked ine to perform the following items regarding tvvo coast redwoods (Sequoia
se»7peirezs) located along the north side of Building 19980 at the above-referenced site:
[ 1] Evaluate their health and structural condition.
[2) Review whether their reinoval complies with Section 1.418.180 of the Cupertino
Municipal Code.
[3 ] If the removal of one or both does comply, then recommend replacements as
mitigation.
I visited the site on February 8, 2010, and this report presents my observations and

Justification for Tree Removal:
The Pointe at Cupertino
The eiht Monterey pines (ID #: 76, 77, 79, 80, 82, 87, 99, 152) and two coast redwoods (ID #: 84,
85) located within The Pointe at Cupertino complex should be removed based on the facts and photos below.
• Pine Pitcli Canker -Fasuium circizutum or pine pitch canker is a fungus that is transmitted by
bark, cone and twig beetles whose dispersal may carry the disease to new locations. The disease can
also be carried on seeds of infected trees resulting in developing seedlings that are also infected.
Death of trees may result from the effects of the disease itself, from infesting insects in weakened
trees, or a combination of both. No effective chemical or biological control has yet been developed
for pitch canker; therefore, Arborwell recommend that tllese trees hould be removed and replaced
with non-susceptible species is a good idea.
Example of trees on site ith Pine Pitch Canker disease:

• Bark Beetles -Over 600 beetles in the family Scolytidue are commonly referred to as bark beetles.
The "shot hole'" appearance of the bark in infested trees indicates beetles have matured, chewed eit
holes and flown off to find new breeding sites. Once bark beetles are established in a tree, they emit
pheromones, which attract other beetles to the same tree. Bark beetles usually attack trees that are
weakened or dying due to other stress factors such as drought, disease SI110 mechanical injury, etc.
They are also attracted to recently cut wood. Once a tree is infected, trees almost never recover and
usually die rapidly. Control efforts at this point are futile.

• Sidewalk, Foundation, Driveway, Fence and other Hardscape Damae — The trees labeled for
removal are begiiuling to damage their surrounding hardscapes, and themselves, as they grown in
these confined spaces. Sidewalk upheaval, foundation cracking and fence buckling have all been
manaed in past using improper techniques, such as aggressive root pruning. These trees have
reached a point where the cost to benefit ratio is no longer favorable and should be replaced;
keeping in mind for new plantings: ``Right Tree, Right Place.'"

• Poor Crown Architecture and Lean — Proper crown architecture is important in the stability and
future growth of trees; as a result of improper growing conditions, vandalism and other factors,
many of the trees listed above should be removed. In these situations, the tree root systenis and
overall structure do not support their size and/or future growth; thus creating a hazardous situation.
Example of Poor Cr«n .4rchirecture and Lean:

• Dead/Dying — Some of the trees marked for removal have already died as a result of the Pine Pitch
Canker/Bark Beetle disease complex; many others are beginning to show serious signs of crown
dieback. These trees will soon and already do pose a threat to personal property and safety. As the
trees die, they will become breeding grounds for disease and bark beetles, thus infecting numerous
other trees in the area.
