Subject: Director's Minor Modification (DIR-2010-11) for a 77 sq. ft. one-story addition
to the rear of a 2-story townhouse in an R1C zoning district at 10010 Scenic Boulevard
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
BACKGROUND:
The applicants, Walter and Cheryl Shepard, are requesting a Director's Minor
Modification to construct a 77 sq. ft. first floor addition to the rear of their townhouse in
a R1C zoning district at 10010 Scenic Boulevard. The townhouse is part of a larger
development of 28 residential units. It is located at the northern end of the
development surrounded to the north and east by the former Stocklmeir property
owned by the City of Cupertino
DISCUSSION:
In the R1C zoning district the Community Development Director may approve minor
building changes that do not affect the general appearance of the area or the interests of
property owners within or adjoining the development area. In addition, an approval
letter from the homeowners' association is also required.
The one-story addition fills an existing notch in the townhouse, maintaining existing
building lines and setbacks to the side and rear. Building materials will match existing
materials while the design will provide some architectural relief to the long sloping
rooflines that characterized this residential development.
A letter has been provided by the president of the Meadows of Cupertino Homeowners
Association (HOA) by order of the Meadows Board of Directors. The letter approves
the addition, noting that two other townhomes in the HOA have had similar rear
additions approved and built (Attachment A).
ACTION:
The Community Development Director deems the project minor and hereby approves
the modification effective March 31, 2010. The fourteen-calendar day appeal period will
expire on Apri114, 2010.

contained in this resolution.

Cheryl and Skip Shepard are undertaking a remodel and the addition of 77 square feet to their home
(10010 Scenic Boulevard) and have requested permission from the Meadows of Cupertino Home
Owners Association to request permits for their project(s). There ha.ve been two homes in the
association that have already had the same 77 squaxe foot addition.
The intent of this letter is to permit the Shepards to request permits for the above project(s) with the
permission of the Meadows HOA by order of the HOA's Board of Directors.
