So, I will now share my screen. 40 00:02:13.980 --> 00:02:14.750 Community Hall: Okay… 41 00:02:18.810 --> 00:02:22.590 Speaker 6 (Community Hall): Okay, can everyone see my… Screen. 42 00:02:23.060 --> 00:02:23.770 Seema Lindskog, Commissioner: Yes. 43 00:02:23.770 --> 00:02:25.579 Speaker 6 (Community Hall): Okay, excellent. Thank you. 44 00:02:26.140 --> 00:02:38.679 Speaker 6 (Community Hall): Great, so before I begin, I first wanted to thank staff for partnering with us to put out this subcommittee report. I know that this is the first time, at least in recent history, that we have had a subcommittee that would 45 00:02:38.680 --> 00:02:49.769 Speaker 6 (Community Hall): present a report, potentially driving a recommendation back to City Council. So, I appreciate your partnership on figuring out a process to… to do this properly. So, with that… 46 00:02:49.880 --> 00:03:09.050 Speaker 6 (Community Hall): Just moving into the background on the Community Noticing Subcommittee, this was actually approved about half a year ago, on October 14th, 2025, during that Planning Commission meeting, and the objective was really just to report on best practices on community noticing from other Bay Area cities. 47 00:03:09.050 --> 00:03:22.679 Speaker 6 (Community Hall): So this is a temporary ad hoc committee with limited jurisdiction and scope, and it really is intended to provide a report back to the full Commission for discussion and possible recommendation to the City Council, depending on what the Commission chooses. 48 00:03:22.680 --> 00:03:31.769 Speaker 6 (Community Hall): So the subcommittee consisted of myself and Vice Chair Scharf. We have met four times to align on the work, discuss findings, and finalize a report back to the Planning Commission. 49 00:03:33.470 --> 00:03:47.280 Speaker 6 (Community Hall): And the goal of this really was based on community feedback to address resident and business feedback that we consistently hear people just don't know about development projects near them until it's too late. 50 00:03:47.280 --> 00:03:58.260 Speaker 6 (Community Hall): And many residents also report that they were unaware of major zoning changes, and this is especially the case for the parcel list for the sixth cycle housing element. So, you know, our 51 00:03:58.280 --> 00:04:07.359 Speaker 6 (Community Hall): Our goal here, really, is just to identify any opportunities where possible to improve Cupertino community noticing methods and policies for businesses and residents. 52 00:04:08.100 --> 00:04:20.760 Speaker 6 (Community Hall): So, we started with a quick audit of where we are today with the City of Cupertino. So, this is the website where all of the development proposals are listed, and the public hearings can be found within each development project. 53 00:04:21.029 --> 00:04:38.210 Speaker 6 (Community Hall): We also are, you know, adhering to physical notices of public hearing at the site of the development, as well as, emails that… for anyone that is subscribed. And I did not have a photo, but of course, we are also sending physical mail to residents within the noticing radius. 54 00:04:39.340 --> 00:04:52.660 Speaker 6 (Community Hall): So, Cupertino is quite similar, by and large, to most neighboring cities, who are all kind of just following California government code, which is to send a mail notification within a 300-foot radius of major development. 55 00:04:52.660 --> 00:05:04.890 Speaker 6 (Community Hall): have signage at least 10 days prior to the public hearing, publish a notice within a newspaper, and also provide the option to sign up for email notifications. Some cities, we have seen, are also 56 00:05:04.930 --> 00:05:11.539 Speaker 6 (Community Hall): Exploring expanding the noticing radius for very large projects to, you know, 1,000 feet or more. 57 00:05:13.010 --> 00:05:16.899 Speaker 6 (Community Hall): And so this chart, you know, again, we… 58 00:05:17.100 --> 00:05:28.149 Speaker 6 (Community Hall): most… for the most part, cities are very similar in the way that they are noticing, and the one difference that we saw was really in the notice radius for mail. So you can see that 59 00:05:28.190 --> 00:05:45.110 Speaker 6 (Community Hall): many cities, from a municipal code standpoint, have codified the standard 300 feet as their noticing radius. And then there are some other cities you can see to the right of the graph, Los Altos and Saratoga have codified a larger noticing radius at 500 feet. 60 00:05:45.110 --> 00:05:51.139 Speaker 6 (Community Hall): Palo Alto's at 600 feet, and Mountain View has codified a 750-foot noticing radius. And… 61 00:05:51.210 --> 00:06:05.279 Speaker 6 (Community Hall): the one caveat with this is that this is what is written in the municipal code, and some of these cities may be going above and beyond what is written in their code. You know, we've called out Cupertino here. While we 62 00:06:05.280 --> 00:06:21.210 Speaker 6 (Community Hall): have codified a 300-foot noticing radius in many cases, you know, based on conversation, and staff can talk more about this later, we are already noticing up to 1,000 feet or more for larger projects. So we would actually be off this chart if we were looking at unofficial and noticing radiuses. 63 00:06:21.250 --> 00:06:22.040 Speaker 6 (Community Hall): But… 64 00:06:22.110 --> 00:06:33.150 Speaker 6 (Community Hall): you know, again, this is sort of what is officially listed. And then City of Santa Clara is also contemplating a quarter-mile radius for larger projects, so some of these may change in the future. 65 00:06:34.240 --> 00:06:45.460 Speaker 6 (Community Hall): So, you know, one question I had when I was looking at this is, what is it like to have a 750-foot noticing radius? And, you know, I did… I was able to speak briefly with a planner in the Mountain View. 66 00:06:45.460 --> 00:06:55.259 Speaker 6 (Community Hall): Planning Department that specifically mentioned they did see fewer complaints from residents and businesses when they expanded to a 750-foot noticing radius. 67 00:06:55.260 --> 00:07:17.460 Speaker 6 (Community Hall): And the main caveat, really, is just that there's an increased cost if one was to choose to expand the noticing radius that far. That said, you know, our city staff is… has already, you know, taken note of the community feedback and unofficially expanded the noticing radius for many of our projects recently. Like, Evilich, I believe, was over a thousand feet. 68 00:07:17.460 --> 00:07:29.439 Speaker 6 (Community Hall): So, you know, in some ways, any change to our noticing radius would technically not actually impact costs in the sense that staff is already increasing it where they feel is necessary. 69 00:07:30.660 --> 00:07:48.269 Speaker 6 (Community Hall): So, aside from noticing RADIUS, there were only a few other differences that we were able to find with other cities, and a lot of these were with digital channels, so City of San Jose and some other cities are using social media to push out notices around community meetings. 70 00:07:48.270 --> 00:07:55.849 Speaker 6 (Community Hall): The one thing to note here, based on conversations with staff, is that, you know, we… we… City of Cupertino is not really 71 00:07:56.430 --> 00:08:05.380 Speaker 6 (Community Hall): promoting community meetings, because they would count towards one out of the five required meetings for SB330 projects. So, you know, this is not exactly… 72 00:08:05.490 --> 00:08:19.250 Speaker 6 (Community Hall): something that we might do in City of Cupertino, but, you know, I did wanted to at least show this example for the sake of the Commission, knowing what other cities are doing. So, again, this is City of San Jose, publishing community meetings. 73 00:08:19.520 --> 00:08:23.399 Speaker 6 (Community Hall): On their Nextdoor and Facebook channels. 74 00:08:23.870 --> 00:08:39.789 Speaker 6 (Community Hall): And then City of Sunnyvale. So another… another area where cities are using digital more is just creating one common webpage of all public hearings that are happening. So City of Sunnyvale has a PDF of all public hearings that's just regularly updated. 75 00:08:40.390 --> 00:08:46.650 Speaker 6 (Community Hall): oops, went the wrong way. And then Redwood City has one website for all of its upcoming public notices as well. 76 00:08:48.220 --> 00:09:03.660 Speaker 6 (Community Hall): So, you know, that brings us to our final recommendations, and Vice Chair, please feel free to chime in when you see fit. But, you know, our recommendations kind of came into three main categories, and again, the Commission is welcome to discuss this, and staff is also 77 00:09:03.660 --> 00:09:22.410 Speaker 6 (Community Hall): of course, more than welcome to weigh in as a major stakeholder in this process. So the first is around noticing radius. So our recommendation is, you know, since we have seen larger projects draw so much concern from the community, and staff has already started to increase the noticing radius unofficially for larger projects. 78 00:09:22.410 --> 00:09:27.190 Speaker 6 (Community Hall): Why not, potify that increase, in noticing radius? 79 00:09:27.190 --> 00:09:35.559 Speaker 6 (Community Hall): And, you know, it could be discussed as to what exactly is defined as a larger project. Is it based on the acreage or the number of units? 80 00:09:35.560 --> 00:09:52.540 Speaker 6 (Community Hall): But that's one thought there. We would want to consider increasing the noticing radius for zoning changes. We have received a lot of community feedback around that, and for any upcoming zoning changes that we make, we may want to consider notifying more residents. 81 00:09:52.870 --> 00:10:07.900 Speaker 6 (Community Hall): very high fire hazard zone projects. We have, you know, seen directly that residents feel very impacted by these projects, even when they are well out of the 300 feet radius, and so we would recommend increasing that noticing radius as well. 82 00:10:08.030 --> 00:10:11.690 Speaker 6 (Community Hall): And then, finally, this is, I think, based off of… 83 00:10:12.450 --> 00:10:25.850 Speaker 6 (Community Hall): changes that we saw happening to De Anza a few years ago, but proposals for changes to major streets, including any emergency lane reduction, we may want to consider having a larger noticing radius for projects like that as well. 84 00:10:26.080 --> 00:10:26.960 Speaker 6 (Community Hall): on… 85 00:10:27.080 --> 00:10:40.250 Speaker 6 (Community Hall): The next recommendation is around noticing language, and so I will caveat here that this is not really based off of what we have seen from other cities, but based off of our own community feedback, because I have looked at 86 00:10:40.250 --> 00:10:47.550 Speaker 6 (Community Hall): mailers from other cities, and they are quite boilerplate, by and large. They're just stating, you know, the project, and 87 00:10:47.550 --> 00:10:54.799 Speaker 6 (Community Hall): you know, some basic details about the public hearing. And so this is just our, you know, own feedback as a subcommittee about 88 00:10:54.800 --> 00:11:10.779 Speaker 6 (Community Hall): opportunities where we think it could be a little better. So the first is around zoning language. We have received a lot of feedback that the zoning notices only include the parcel number and not the address, so we think there might be an opportunity here to just clarify and include the address. 89 00:11:10.780 --> 00:11:14.849 Speaker 6 (Community Hall): For housing projects, we continue to… 90 00:11:14.850 --> 00:11:31.260 Speaker 6 (Community Hall): have a lot of large developments. Every time they are in different areas to different sectors of the community that are all new to the latest housing laws, and they continue to raise very similar concerns, so we wonder if there's an opportunity to use the mailers for housing projects as 91 00:11:31.260 --> 00:11:40.300 Speaker 6 (Community Hall): More of an educational opportunity to explain relevant housing laws, how the city must abide by them, and maybe disclose any requested waivers from the developer. 92 00:11:40.750 --> 00:12:00.019 Speaker 6 (Community Hall): And then the final recommendation is just to increase channels of outreach where possible. There's, you know, obviously you can use social, we could create one shared web page for all upcoming hearings, or consider just additional signage through bulletins at places like the library. And Vice Chair, did you have any other comments to provide? 93 00:12:00.460 --> 00:12:03.810 Speaker 6 (Community Hall): Just… it's a few years in the future. 94 00:12:04.295 --> 00:12:12.484 Speaker 7 (Community Hall): I think one of the failures we had was during our… Housing element parcel selection. 95 00:12:12.615 --> 00:12:19.934 Speaker 7 (Community Hall): I don't think there was noticing to all the affected areas. You know, I'm thinking specifically of Evilich. 96 00:12:20.105 --> 00:12:24.245 Speaker 7 (Community Hall): Where at least the residents did say they had no idea. 97 00:12:24.355 --> 00:12:29.585 Speaker 7 (Community Hall): That that property was in the housing element for, at the time. 98 00:12:29.905 --> 00:12:33.924 Speaker 7 (Community Hall): From Planning Commission was 30 units per acre, then I ended up at 20. 99 00:12:34.085 --> 00:12:39.655 Speaker 7 (Community Hall): So I'm just thinking, when it's time for the seventh cycle housing element, we need to be very… 100 00:12:39.945 --> 00:12:42.504 Speaker 7 (Community Hall): Aware of the need for noticing of 101 00:12:43.075 --> 00:12:45.754 Speaker 7 (Community Hall): Probably the whole city since, 102 00:12:46.065 --> 00:12:49.704 Speaker 7 (Community Hall): Probably there will be parcels everywhere in the city in that element. 103 00:12:51.295 --> 00:12:52.215 Speaker 7 (Community Hall): Thank you. 104 00:12:53.360 --> 00:13:01.580 Speaker 6 (Community Hall): Great, thank you. So, that concludes my report, and I believe, staff, if you have any comments, now would be the time. 105 00:13:07.760 --> 00:13:09.690 Speaker 1 (Community Hall): Thank you, Chair Crystall Chiron. 106 00:13:10.090 --> 00:13:16.320 Speaker 1 (Community Hall): I think you did incorporate what we did articulate earlier, which was that we do increase the radius, 107 00:13:16.320 --> 00:13:30.929 Speaker 8 (Community Hall): for larger projects, and that indicate… when it becomes clear to us that there is certainly community interest in those projects, we do evaluate how to increase that radius and what's most appropriate. Aside from that, I do not have any other comments. 108 00:13:33.010 --> 00:13:44.040 Speaker 6 (Community Hall): Okay, great, thank you. And again, you know, we… we want this to be a collaborative process, so if throughout this discussion you think of anything, please feel free to bring it up. It looks like, Vice Chair, you have a… 109 00:13:44.220 --> 00:13:51.069 Speaker 7 (Community Hall): No, I just wondered, is there an issue with codifying the larger radius? Is there a downside to doing that? 110 00:13:54.900 --> 00:14:07.070 Speaker 8 (Community Hall): I, I think it depends on, staffing levels, how much time it takes. Postage just keeps going up. These are costs that are passed on to applicants as well. So it's not necessarily, 111 00:14:07.660 --> 00:14:21.829 Speaker 8 (Community Hall): there's a downside, necessarily, to codifying it, but there's also, we do need to do our own analysis of, you know, what other cities do, and how we would put in our recommendations. This is the subcommittee's recommendations that are being discussed right now. 112 00:14:22.480 --> 00:14:24.389 Speaker 7 (Community Hall): Okay, and one other question. 113 00:14:24.800 --> 00:14:29.129 Speaker 7 (Community Hall): The general circulation newspaper. What newspaper is that? 114 00:14:30.700 --> 00:14:46.229 Speaker 8 (Community Hall): There are generally two. It depends on, so a lot of times, noticing deadlines are, related to the, the newspaper that is, of general circulation. Here in Cupertino, it is the Cupertino Courier. It could also be the Mercury News. The, the… 115 00:14:46.250 --> 00:14:57.529 Speaker 8 (Community Hall): pricing difference between the two is phenomenal. It is about a three times higher cost of advertising in the Mercury News. And so… but aside from that, 116 00:14:57.980 --> 00:15:06.689 Speaker 8 (Community Hall): Because of how deadlines work, particularly with new state laws, we just have to pick whatever is best appropriate for that particular meeting. 117 00:15:07.055 --> 00:15:10.355 Speaker 7 (Community Hall): So, what constitutes general circulation? I have not… 118 00:15:10.765 --> 00:15:15.135 Speaker 7 (Community Hall): Had a Cupertino courier delivered to my house in years. 119 00:15:16.190 --> 00:15:21.590 Speaker 8 (Community Hall): I will have to check in with the clerk's office, but that is what we're told, that those are the two that qualify. 120 00:15:21.820 --> 00:15:23.020 Speaker 8 (Community Hall): Okay, thanks. 121 00:15:23.900 --> 00:15:35.379 Speaker 6 (Community Hall): Great, so, we will now officially bring this back to the Commission for questions. It looks like we have hands raised on Zoom, and I don't know in which order, so I guess I'll just call, Commissioner Rao? 122 00:15:40.010 --> 00:15:47.239 Santosh Rao, Commissioner: Yes, thank you, Chair. I think that was a good presentation. I'm glad we… we were able to form the subcommittee. I believe, 123 00:15:47.530 --> 00:15:50.139 Santosh Rao, Commissioner: It was formed last year, and that took, 124 00:15:50.450 --> 00:15:57.350 Santosh Rao, Commissioner: a fair amount of iterations, so glad to see this come to fruition. I think my first question to staff 125 00:15:58.020 --> 00:16:03.179 Santosh Rao, Commissioner: Is… of, what is the… Procedural… 126 00:16:03.690 --> 00:16:12.730 Santosh Rao, Commissioner: handling of this. Are there going to be public comments that are possible on this item? I don't know if we even have any public comments, but will we have public comments? 127 00:16:12.880 --> 00:16:15.600 Santosh Rao, Commissioner: How is this item to be… 128 00:16:15.880 --> 00:16:24.269 Santosh Rao, Commissioner: handled, given that this was put in reports rather than as a study session. And maybe the question is, why was this not a study session? 129 00:16:32.180 --> 00:16:50.610 Speaker 8 (Community Hall): This is a report from the subcommittee, and so it is not a study session, because it was not part of the city's work program or any items that city staff is working on at this point. So, it was meant to be a report out from the subcommittee, and then, based on discussion 130 00:16:50.610 --> 00:16:55.990 Speaker 8 (Community Hall): there could be a recommendation to City Council for direction, future, to staff. 131 00:16:57.350 --> 00:17:01.550 Speaker 8 (Community Hall): At this point, there isn't a project that is being worked on. 132 00:17:03.170 --> 00:17:22.069 Santosh Rao, Commissioner: Okay, my understanding is from the other subcommittees that have done readouts, they have had the ability to do study sessions on them. Just trying to understand, is there technically any difference between the item being a study session versus a commission readout? Is there any difference procedurally? And maybe that's a question for Atomibu. 133 00:17:28.670 --> 00:17:33.699 Speaker 8 (Community Hall): And Commissioner Rao, I don't believe there's any practical difference between the two. I mean, you can have a full discussion here. 134 00:17:34.070 --> 00:17:35.170 Speaker 8 (Community Hall): And I hope you guys do. 135 00:17:36.610 --> 00:17:40.390 Santosh Rao, Commissioner: Okay, great. So my next question, then, is for… 136 00:17:40.570 --> 00:17:42.780 Santosh Rao, Commissioner: Maybe 4 at NIBU and staff. 137 00:17:43.400 --> 00:17:52.969 Santosh Rao, Commissioner: Are we… accounting for, I believe there was a state law, 2904, AB2904 that was passed. 138 00:17:53.520 --> 00:17:59.950 Santosh Rao, Commissioner: That mandates that there be a 20-day noticing period anytime there is a change of land use. 139 00:18:00.250 --> 00:18:02.650 Santosh Rao, Commissioner: Specifically in the Planning Commission. 140 00:18:02.790 --> 00:18:07.869 Santosh Rao, Commissioner: Are we accounting for 2904, and do we do a 20- day noticing today? 141 00:18:09.940 --> 00:18:12.830 Speaker 8 (Community Hall): Yes, we comply with all elements of state law. 142 00:18:15.590 --> 00:18:17.799 Santosh Rao, Commissioner: Okay, but are we doing a 20-day noticing? 143 00:18:20.160 --> 00:18:23.049 Speaker 8 (Community Hall): 20-day noticing for zoning applications, yes. 144 00:18:25.330 --> 00:18:27.999 Santosh Rao, Commissioner: Not just zoning, but any change of zoning. 145 00:18:28.630 --> 00:18:39.399 Santosh Rao, Commissioner: So, under what conditions do we do a 20-day? For example, if we change from R1 to R3, as in the case with Avalich and others, would that be a 20-day 146 00:18:39.700 --> 00:18:40.820 Santosh Rao, Commissioner: Notice period. 147 00:18:41.380 --> 00:18:42.509 Speaker 8 (Community Hall): That is correct. 148 00:18:43.730 --> 00:18:46.480 Santosh Rao, Commissioner: And if we did a change of zoning from 149 00:18:46.940 --> 00:18:51.669 Santosh Rao, Commissioner: public right-of-way to R3, is that a 20-day notice period? 150 00:18:56.320 --> 00:19:01.079 Speaker 8 (Community Hall): Any application for a rezoning would be a 20- day notice period under state law. 151 00:19:02.880 --> 00:19:10.990 Santosh Rao, Commissioner: Okay, and is that something that we have been following? For example, with the Mary Avenue Villa's change of use 152 00:19:11.280 --> 00:19:14.869 Santosh Rao, Commissioner: Did we… Did we perform a 20-day noticing? 153 00:19:17.770 --> 00:19:22.729 Speaker 8 (Community Hall): Mary Avenue was rezoned with the housing element, so there was no additional… 154 00:19:23.020 --> 00:19:30.650 Speaker 8 (Community Hall): zoning application with the project, and I think it may have predated it'd be 29… 2904. 155 00:19:31.630 --> 00:19:38.100 Santosh Rao, Commissioner: I see, okay. And so then, my other follow-up question, just Moving to… 156 00:19:38.790 --> 00:19:42.450 Santosh Rao, Commissioner: another area here is… I know we're talking about 157 00:19:42.990 --> 00:19:49.219 Santosh Rao, Commissioner: Social media and so on, but one… Very effective, but low-tech method. 158 00:19:49.360 --> 00:19:53.599 Santosh Rao, Commissioner: is the banner that is put up on Stevens Creek. 159 00:19:53.700 --> 00:20:03.719 Santosh Rao, Commissioner: And I know the banner is used by the Transportation Department. For example, on ATP, we've seen the banner. I think maybe Vision Zero, we saw the banner as well. So, I would like to… 160 00:20:04.570 --> 00:20:10.300 Santosh Rao, Commissioner: put forward for the Commission's inclusion, Maybe we can stir… 161 00:20:10.870 --> 00:20:15.209 Santosh Rao, Commissioner: the banner, I don't know if it was in your slides here, and maybe it is somewhere. 162 00:20:15.670 --> 00:20:23.029 Santosh Rao, Commissioner: But the banner is a low-tech, but very effective method to get people that generally tend to criss-cross Stevens Creek. 163 00:20:23.670 --> 00:20:26.840 Santosh Rao, Commissioner: And with that, I will lead the… Thank you. 164 00:20:28.030 --> 00:20:38.110 Speaker 6 (Community Hall): Thank you, Commissioner Rao, and to answer your question, no, I had not thought of the banner, but it is a good idea. So we can consider that in any potential recommendation. Commissioner Linskog? 165 00:20:40.800 --> 00:20:49.379 Seema Lindskog, Commissioner: Hi there, yeah, no, this is a… this is a really good topic to be discussing, because as you've… as you've pointed out, we… we get this feedback a lot. 166 00:20:49.380 --> 00:21:04.609 Seema Lindskog, Commissioner: So thank you for doing this. This is very helpful. And, I just had a question about the clarifying the noticing language, and you said, you know, disclose any requested waivers and texts explaining relevant housing laws. 167 00:21:05.880 --> 00:21:18.870 Seema Lindskog, Commissioner: have you, like, what has been the staff feedback on that? Because I'm just wondering how we would do that at a practical level, because, like, some of the applications we see have 168 00:21:18.900 --> 00:21:30.970 Seema Lindskog, Commissioner: you know, dozens of waivers, and it gets… it gets pretty nitty-gritty into state law. So, can you… can you clarify a little bit, like, how you're thinking about 169 00:21:31.030 --> 00:21:32.949 Seema Lindskog, Commissioner: How that would get applied? 170 00:21:33.530 --> 00:21:34.070 Community Hall: Okay. 171 00:21:34.070 --> 00:21:42.109 Speaker 6 (Community Hall): Yes, it's an excellent question, and that was a last-minute ad for me, so I did not actually get staff feedback on this, so, 172 00:21:42.410 --> 00:21:51.870 Speaker 6 (Community Hall): Actually, would love to hear any feedback you might have on, you know, what room is there to add additional detail on the mailer. 173 00:21:56.560 --> 00:21:59.060 Speaker 8 (Community Hall): I don't have anything to add at this point of time. 174 00:21:59.210 --> 00:22:02.760 Speaker 8 (Community Hall): I could just add, I think… I think it's a good idea. 175 00:22:02.765 --> 00:22:05.935 Speaker 3 (Community Hall): But it's hard to think how you implement that with… 176 00:22:06.745 --> 00:22:10.904 Speaker 3 (Community Hall): First, you're going to be putting down laws people are very likely not familiar with, so. 177 00:22:10.905 --> 00:22:14.645 Speaker 9 (Community Hall): you're almost having to explain if, say, it's density bonus. I mean… 178 00:22:14.885 --> 00:22:18.144 Speaker 9 (Community Hall): To a lot of people, that probably doesn't mean a lot. 179 00:22:19.055 --> 00:22:20.665 Speaker 9 (Community Hall): And then… 180 00:22:20.805 --> 00:22:27.564 Speaker 9 (Community Hall): I think, as Commissioner Linskogg pointed out, most of the projects we've seen have between a half dozen to a dozen waivers. 181 00:22:27.865 --> 00:22:34.695 Speaker 9 (Community Hall): So you're then explaining it doesn't meet height, setbacks, parking, open space requirements, etc. 182 00:22:35.135 --> 00:22:41.485 Speaker 9 (Community Hall): I think that would be tough to incorporate on a notice without making it something like a mini staff report. 183 00:22:41.795 --> 00:22:45.295 Speaker 9 (Community Hall): But the intention, I understand, because it then… 184 00:22:45.615 --> 00:22:52.695 Speaker 9 (Community Hall): what's either the Planning Commission or the City Council, at least people who are showing up understand the limitations you have. 185 00:22:53.375 --> 00:23:02.065 Speaker 9 (Community Hall): to deny or not approve or modify the project, but I think it's just difficult to handle that through noticing without it getting overly wordy. 186 00:23:03.355 --> 00:23:04.685 Speaker 9 (Community Hall): Okay, thank you. 187 00:23:05.365 --> 00:23:07.835 Speaker 9 (Community Hall): Of a share. So… 188 00:23:09.140 --> 00:23:10.349 Speaker 7 (Community Hall): It is wordy. 189 00:23:10.850 --> 00:23:20.320 Speaker 7 (Community Hall): And I think the notice would just have to include a link to… An explanation of each law. 190 00:23:20.440 --> 00:23:22.069 Speaker 7 (Community Hall): I mean, I think we really… 191 00:23:22.320 --> 00:23:33.000 Speaker 7 (Community Hall): you know, people show up, they're very well- meaning, we're all policy wonks up here, and we understand all… well, we don't really understand all the laws, but we do our best. 192 00:23:33.340 --> 00:23:41.129 Speaker 7 (Community Hall): And I think for many of our residents who are all pretty well educated, it would be useful for them to have a link 193 00:23:41.360 --> 00:23:45.070 Speaker 7 (Community Hall): They can go to to understand why… 194 00:23:45.730 --> 00:23:50.009 Speaker 7 (Community Hall): Many of the things that we're doing, we really have no choice due to state law. 195 00:23:50.190 --> 00:23:51.549 Speaker 7 (Community Hall): And it might even… 196 00:23:51.920 --> 00:24:01.739 Speaker 7 (Community Hall): Might even shorten some of the meetings and reduce the number of public comments if they did understand exactly why we're so limited into what we can do. 197 00:24:03.850 --> 00:24:07.239 Speaker 6 (Community Hall): Any other questions from the Commission? Commissioner Fung? 198 00:24:08.480 --> 00:24:10.789 Speaker 3 (Community Hall): Yeah, sure. I was wondering, 199 00:24:10.900 --> 00:24:15.960 Speaker 3 (Community Hall): With regard to the, noticing on on. 200 00:24:16.310 --> 00:24:20.960 Speaker 10 (Community Hall): You know, when we have a housing element, or when we're doing, You know, general plan. 201 00:24:21.110 --> 00:24:27.710 Speaker 10 (Community Hall): I'm just curious if you can recap what the normal noticing would be. You know, there was some… there was some discussion here in this report about 202 00:24:27.860 --> 00:24:29.540 Speaker 10 (Community Hall): You know, doing something special. 203 00:24:31.880 --> 00:24:45.180 Speaker 9 (Community Hall): Yeah, I think for the last housing element, because there were so many sites, there were 58, and then if you took the radius around each one of those sites, you ended up having, I think it was over 2,000. It was well into that, so… 204 00:24:45.600 --> 00:24:52.790 Speaker 9 (Community Hall): And the limit under state law was 1,000 or more, you then can publish in a newspaper. You do not do a mailing. 205 00:24:53.210 --> 00:25:03.199 Speaker 9 (Community Hall): And so we complied with the law, though that said, I do understand people who then say, I wish I knew about that particular site that's a block away from my house. 206 00:25:03.470 --> 00:25:04.780 Speaker 9 (Community Hall): That's logical. 207 00:25:05.190 --> 00:25:16.009 Speaker 9 (Community Hall): the other reason we're not doing that at the time is there's no project on the site. If there is an individual project, they then are notified, but I understand the issue is I wish I knew before the land use designation changed, so… 208 00:25:16.440 --> 00:25:26.819 Speaker 9 (Community Hall): That's something I think everybody has heard. It would be something we… if that were the desire to go well beyond state law and say once we have settled on those housing sites. 209 00:25:27.310 --> 00:25:36.150 Speaker 9 (Community Hall): I think Commissioner Scharf said it, it almost has to be citywide, or it would be close to it, because you're having a large affected area, assuming you have 210 00:25:36.660 --> 00:25:40.109 Speaker 9 (Community Hall): 30, 40, 50 sites again, and they're dispersed throughout the city. 211 00:25:40.710 --> 00:25:43.009 Speaker 9 (Community Hall): You would have to do a mass mailing. 212 00:25:43.200 --> 00:25:44.150 Speaker 9 (Community Hall): And… 213 00:25:44.740 --> 00:25:50.899 Speaker 9 (Community Hall): Maybe in that instance, you could even do something like target sites within a particular area of the city. 214 00:25:51.010 --> 00:25:52.340 Speaker 9 (Community Hall): So if you live… 215 00:25:53.580 --> 00:25:58.729 Speaker 9 (Community Hall): On the eastern edge, you may not care so much about something happening on the western side, but… 216 00:25:59.420 --> 00:26:06.159 Speaker 9 (Community Hall): I think the message we got out of the housing element is we do need to do something more personalized that people receive at their home. 217 00:26:06.350 --> 00:26:12.469 Speaker 9 (Community Hall): Rather than just publishing in a newspaper. Probably, too, because fewer people are even reading newspapers these days. 218 00:26:14.000 --> 00:26:28.629 Speaker 10 (Community Hall): Good, thanks. Now, I… you know, I think at the time, certainly with the general plan effort, it seemed like there was kind of sitting-white notice, there were a lot of… there were hearings being held. Maybe the question was really around the specificity when you're considering 219 00:26:28.780 --> 00:26:39.369 Speaker 10 (Community Hall): rezoning efforts, you know, to identify housing sites. You know, that… that would probably be the time. I think that… that seems to me that would be the time when… when, 220 00:26:39.860 --> 00:26:53.209 Speaker 10 (Community Hall): when there would have been, you know, people… if I take advantage… take an example of the one on McClellan, for instance, you know, I think, there was, you know, there was a change in the density there, you know, both up and down. 221 00:26:53.450 --> 00:26:56.540 Speaker 10 (Community Hall): You know, through that fairly long process. 222 00:27:02.200 --> 00:27:04.359 Speaker 10 (Community Hall): No, no, no additional question there. 223 00:27:06.690 --> 00:27:12.839 Speaker 10 (Community Hall): And then I guess maybe, maybe one other question. You know, another thing that I think is a challenge here is that the… 224 00:27:13.260 --> 00:27:20.770 Speaker 10 (Community Hall): You know, both… Both when the project actually comes, and when sites are being considered, that the… 225 00:27:21.510 --> 00:27:22.920 Speaker 10 (Community Hall): the mandatory… 226 00:27:23.030 --> 00:27:37.750 Speaker 10 (Community Hall): notice time, you know, would be, you know, for a meeting here in the Planning Commission, is really only, you know, a couple days. Difficult for people to review, a huge, huge, huge document, in that time. So I don't know there's anything you can do about that. I mean. 227 00:27:38.060 --> 00:27:56.430 Speaker 10 (Community Hall): the, problem is, it would be nice if there were something that happened maybe farther in advance to say these things were being considered before the… they were in final form, you know, before the final presentation, but at the same time, I think we all recognize that, projects change when we cancel meetings because the, 228 00:27:56.670 --> 00:28:03.880 Speaker 10 (Community Hall): the proposal changed at the very last moment. So, I'm not sure if there's any alternative to that, but I would just… I would just say as a comment. 229 00:28:03.960 --> 00:28:18.340 Speaker 10 (Community Hall): that that actually is one of the things that's challenging, you know, if there's going to be a Planning Commission meeting on something significant on Tuesday, you know, typically you wouldn't have a chance to even know what it was until Thursday, the Thursday before, which is not much time. 230 00:28:20.600 --> 00:28:25.039 Speaker 6 (Community Hall): Great. Thank you, Commissioner Fung. Commissioner Linskogg, any questions? 231 00:28:25.820 --> 00:28:45.210 Seema Lindskog, Commissioner: Yes, thank you. I want to actually kind of build on what Commissioner Fung said, because I think a lot of the feedback that we heard was, that they didn't… that, residents didn't hear about proposed zoning changes, discussions in the Planning Commission and Council. 232 00:28:45.360 --> 00:29:05.000 Seema Lindskog, Commissioner: as the housing element was being debated, so… so the noticing period, I mean, which is… it's great, but it's… it's a… it's after the fact, right? It's like, after the Planning Commission has… has recommended a site to be upzoned or downzoned or whatever, or after the Council has decided to change the zoning. 233 00:29:05.000 --> 00:29:12.089 Seema Lindskog, Commissioner: It would be great if we… and I don't know, so the question is, did you guys discuss 234 00:29:12.090 --> 00:29:21.410 Seema Lindskog, Commissioner: Doing greater noticing of Planning Commission meetings or council meetings where zoning changes are being considered. 235 00:29:25.170 --> 00:29:27.150 Speaker 8 (Community Hall): So, I, I… 236 00:29:27.270 --> 00:29:42.959 Speaker 8 (Community Hall): Commissioner Linsky, I didn't want to add, I mean, specifically for the housing element or bigger projects, we actually go out, not just do the notices in the newspaper, but we also do e-notices, which is for persons that have signed up for those notices, and 237 00:29:43.150 --> 00:30:02.300 Speaker 8 (Community Hall): we had well over, I want to say 2,000, or 2,200, or some number of people that had signed up to receive notices, and those notices were routinely sent out throughout the process, to address every meeting, every rezoning action, through the entire project. 238 00:30:02.450 --> 00:30:03.710 Speaker 8 (Community Hall): I did want to add that. 239 00:30:03.990 --> 00:30:09.410 Seema Lindskog, Commissioner: No, I'm… I know, I know you guys… you guys did a terrific job, but, you know, clearly. 240 00:30:09.480 --> 00:30:17.569 Seema Lindskog, Commissioner: there's still a lot of residents who didn't hear about it, right? So, we have the 2,000 residents who are very, very involved. 241 00:30:17.570 --> 00:30:34.770 Seema Lindskog, Commissioner: But that still leaves, you know, tens of thousands of residents who are not, and for whom this was a complete surprise when Evelych Court was upzoned, or, you know, or all the McClellan Road properties were added to the housing element. So… 242 00:30:34.810 --> 00:30:43.099 Seema Lindskog, Commissioner: So I guess that's my question, is like, is there, when you were doing the subcommittee discussion, did you take a look at 243 00:30:43.200 --> 00:30:55.389 Seema Lindskog, Commissioner: Is there a way to, augment the current communication for, for those kinds of meetings where we are discussing, zoning, changes in… around the city? 244 00:30:58.920 --> 00:31:01.380 Speaker 6 (Community Hall): Sorry, was that a question for me or for staff? 245 00:31:01.650 --> 00:31:03.160 Seema Lindskog, Commissioner: No, for subcommittee. 246 00:31:03.640 --> 00:31:05.830 Speaker 6 (Community Hall): Okay. We… 247 00:31:06.060 --> 00:31:24.059 Speaker 6 (Community Hall): did not go as specific… as case-specific into, housing element versus, just regular zoning, but, you know, I… you know, Vice Chair can chime in, correct me if I'm wrong, I do think that there was appetite to, you know, increase the radius of that noticing, if that answers your question. 248 00:31:29.340 --> 00:31:33.340 Speaker 6 (Community Hall): Okay, Commissioner Rao, any questions before we move on to public comment? 249 00:31:34.800 --> 00:31:37.959 Santosh Rao, Commissioner: Yes, so my question to… 250 00:31:38.490 --> 00:31:44.550 Santosh Rao, Commissioner: staff, is I see a number of notifications from CUSD, 251 00:31:44.670 --> 00:31:52.040 Santosh Rao, Commissioner: and FHSD that are related to county-related notifications. For example. 252 00:31:52.390 --> 00:32:03.480 Santosh Rao, Commissioner: I believe, and not just county, but other agencies as well. For example, I believe there was recent CUSD notification about a VTA outreach effort. 253 00:32:03.860 --> 00:32:09.469 Santosh Rao, Commissioner: And there's been prior notification around Foothill-related projects that the county was doing. 254 00:32:09.750 --> 00:32:13.640 Santosh Rao, Commissioner: So, have we, in the past, done any cross- agency noticing 255 00:32:13.800 --> 00:32:20.569 Santosh Rao, Commissioner: Or, I shouldn't say noticing, but cross- agency, communications, outreach. 256 00:32:20.800 --> 00:32:27.689 Santosh Rao, Commissioner: using, other agencies, and do we push anything towards USD or FHSD or FHDA? 257 00:32:27.830 --> 00:32:31.709 Santosh Rao, Commissioner: And vice versa, and that's something that I would like to include. 258 00:32:31.880 --> 00:32:34.220 Santosh Rao, Commissioner: In the recommendation, if it's not already there. 259 00:32:37.930 --> 00:32:43.700 Speaker 8 (Community Hall): I don't believe that community development has done that kind of outreach with the school districts, to my knowledge. 260 00:32:45.390 --> 00:32:51.119 Santosh Rao, Commissioner: And would staff know if any other department has done that? I… I guess ATP, maybe? 261 00:32:51.790 --> 00:32:55.609 Speaker 8 (Community Hall): I can't confirm or… I'm not aware. 262 00:32:57.710 --> 00:32:58.330 Santosh Rao, Commissioner: Okay. 263 00:32:58.600 --> 00:33:03.549 Santosh Rao, Commissioner: Yeah, so for the… consideration of the commissioners, I would… 264 00:33:03.780 --> 00:33:13.849 Santosh Rao, Commissioner: Recommend we consider how to include a We include a recommendation to… Explore cross-agency outreach. 265 00:33:14.190 --> 00:33:18.540 Santosh Rao, Commissioner: Clearly, they're doing that on behalf of VTA, and we are far closer. 266 00:33:18.700 --> 00:33:21.819 Santosh Rao, Commissioner: And we should be able to push out certain notifications. 267 00:33:22.020 --> 00:33:24.690 Santosh Rao, Commissioner: through COSD, FHST, and FHDA. 268 00:33:26.860 --> 00:33:32.679 Santosh Rao, Commissioner: The, the other… the other item that I wanted to add to this is really around… 269 00:33:33.270 --> 00:33:41.899 Santosh Rao, Commissioner: We just had this town hall, and it looked like we just, you know, blasted out a phone call, or a text message, or maybe both, to… 270 00:33:42.340 --> 00:33:44.060 Santosh Rao, Commissioner: I guess the entire city. 271 00:33:44.480 --> 00:33:46.610 Santosh Rao, Commissioner: Do staff know how that was. 272 00:33:46.610 --> 00:33:47.570 Speaker 6 (Community Hall): Sorry, was this a… 273 00:33:47.570 --> 00:33:48.030 Santosh Rao, Commissioner: Technology. 274 00:33:48.030 --> 00:33:52.430 Speaker 6 (Community Hall): Commissioner Rao, is this a question or a comment? If we, you know, I think we can. 275 00:33:52.430 --> 00:33:53.509 Santosh Rao, Commissioner: Here's a question. 276 00:33:53.810 --> 00:33:54.250 Speaker 6 (Community Hall): Okay, alright. 277 00:33:54.250 --> 00:33:55.440 Santosh Rao, Commissioner: It is a question. 278 00:33:56.790 --> 00:33:59.539 Santosh Rao, Commissioner: The question to staff is the recent 279 00:33:59.820 --> 00:34:12.709 Santosh Rao, Commissioner: town hall that we just had, do we know if the technology is new, it's something that has previously existed, and is that a mechanism that we could use to target a neighborhood? Because clearly nobody reads newspapers. 280 00:34:13.190 --> 00:34:16.109 Santosh Rao, Commissioner: And nobody even subscribes to these newspapers. 281 00:34:16.460 --> 00:34:18.780 Santosh Rao, Commissioner: But, you know, everybody could get a… 282 00:34:18.949 --> 00:34:23.739 Santosh Rao, Commissioner: Call in the quarter mile radius, or whatever the appropriate noticing radius is. 283 00:34:25.210 --> 00:34:40.529 Speaker 8 (Community Hall): I am not aware. I understand that the city had, has, contracted with a consultant to… to actually host that town hall, and they have the technology for it. I am not aware of any such efforts internally at the City. 284 00:34:41.889 --> 00:34:48.719 Santosh Rao, Commissioner: Thank you. And so maybe then that's another recommendation we could consider including, and that's, that's, 285 00:34:49.049 --> 00:34:55.119 Santosh Rao, Commissioner: technology that maybe, the CT office could provide, so just something for us to consider. 286 00:34:57.159 --> 00:34:58.729 Santosh Rao, Commissioner: That's all I have. Thank you. 287 00:34:59.820 --> 00:35:05.069 Speaker 6 (Community Hall): Great, thank you. So, I think we will, at this point, move to public comment. City Clerk, are there any public comments? 288 00:35:05.670 --> 00:35:09.330 Speaker 5 (Community Hall): We have one hand raised on Zoom chair, Jennifer Griffin. 289 00:35:09.640 --> 00:35:11.120 Speaker 5 (Community Hall): Welcome, Jennifer. 290 00:35:13.960 --> 00:35:15.970 Jennifer Griffin: Oh, can you hear me? 291 00:35:16.760 --> 00:35:18.149 Speaker 5 (Community Hall): Yes, we can hear you. 292 00:35:18.150 --> 00:35:34.120 Jennifer Griffin: Okay, good. Yes, I would have come, but I've developed a stomach bug, and I think this topic makes my stomach upset. I would just say thank you for the very good report. I'm glad the subcommittee was working on this. 293 00:35:34.250 --> 00:35:36.850 Jennifer Griffin: We have had, 294 00:35:37.080 --> 00:35:50.180 Jennifer Griffin: A lot of issues happen in the city recently, and I really, really am concerned that we're not getting to everyone like we did a few years ago. 295 00:35:50.340 --> 00:35:56.279 Jennifer Griffin: I think that I would… I sent an email, comments. 296 00:35:56.290 --> 00:36:04.770 Jennifer Griffin: One of them is, I think the postcards are extremely effective in trying to get messages out 297 00:36:04.770 --> 00:36:20.830 Jennifer Griffin: I know that we check our mail all the time, we get postcards from every single person in the world, realtors, but we look at them, and there have been multiple times when I had found a mailer, or my husband did, and said, hey, the city 298 00:36:20.900 --> 00:36:35.450 Jennifer Griffin: is having a meeting on something, and I think you all had red or yellow, which was really good, so I think we should go back to that. The other one was having a community meeting, 299 00:36:35.810 --> 00:36:47.170 Jennifer Griffin: section of the Cupertino website, Los Altos and City of San Jose have had these for many years. I routinely look at them, 300 00:36:47.260 --> 00:37:02.889 Jennifer Griffin: Also, I think having meetings that are posted on the community development boards at each project site would be extremely helpful. I… I'm fully aware of the five 301 00:37:02.890 --> 00:37:18.729 Jennifer Griffin: meeting limit of SB330. I know more about this bill than probably a lot of people, but I am really, really being concerned that because of all the SB330 meetings, there have not been… there has not been one 302 00:37:18.770 --> 00:37:27.720 Jennifer Griffin: community meeting that I've been aware of. I know they've had them, but I don't know where they're advertising them. The developers are keeping them secret. 303 00:37:27.760 --> 00:37:42.339 Jennifer Griffin: We have a big SB330 at Finch and Stevens Creek Boulevard, which I have yet to hear anything about. There's nothing on the website, there's been no community meetings, and that one is going to be extremely 304 00:37:42.340 --> 00:37:48.929 Jennifer Griffin: critical for the eastern end, so I want to know about it, but there is no communication 305 00:37:48.930 --> 00:38:03.840 Jennifer Griffin: And I think that… I feel like the SB330 law is just trying to keep the public unaware. I know there's 5 meetings, but even that one I went to in Santa Clara at the development at Homestead 306 00:38:04.050 --> 00:38:23.530 Jennifer Griffin: and Lawrence Expressway was an SB330 project, and that was one of their community meetings, but I found that out because I got a notice from the City of Santa Clara. I am registered with that city to get updates, as I am with Santa Cruz. So I think that it's very important that we understand… 307 00:38:23.530 --> 00:38:25.189 Speaker 5 (Community Hall): Jennifer, that is your time? 308 00:38:25.190 --> 00:38:28.870 Jennifer Griffin: Okay, I… sorry, I can't even see the time here. Thank you. 309 00:38:32.360 --> 00:38:34.520 Speaker 5 (Community Hall): We have no remaining speakers, Chair. 310 00:38:34.790 --> 00:38:35.610 Speaker 5 (Community Hall): Great, thank you very much. 311 00:38:35.615 --> 00:38:40.164 Speaker 6 (Community Hall): much, so I will bring this back to the Commission for any further clarifying questions or comments. 312 00:38:43.315 --> 00:38:44.515 Speaker 6 (Community Hall): Commissioner Rao? 313 00:38:47.070 --> 00:38:49.399 Santosh Rao, Commissioner: Yes, so I'd like to… 314 00:38:49.730 --> 00:38:54.590 Santosh Rao, Commissioner: hear from staff on what the next steps on this could be, if we wanted to 315 00:38:55.010 --> 00:38:59.109 Santosh Rao, Commissioner: Amend the deck to include certain recommendations. 316 00:38:59.610 --> 00:39:05.889 Santosh Rao, Commissioner: I'll be… Is it… is it a, process by vote? How should we proceed here? 317 00:39:08.890 --> 00:39:10.700 Santosh Rao, Commissioner: Maybe a question for Atme Group. 318 00:39:17.060 --> 00:39:36.080 Speaker 11 (Community Hall): I think it's appropriate for the Commission, after the discussion of this item, to, should the desire to make a motion capturing the recommendation, as part of that motion, you would designate a commissioner, to prepare an email, to send to the City Council with your recommendation. 319 00:39:38.990 --> 00:39:51.230 Speaker 11 (Community Hall): And to the extent there's any dissenting votes on that, I emailed to be consistent with the recent revisions to the Commissioner's Handbook to also identify the views of the minority. 320 00:39:54.350 --> 00:39:55.839 Santosh Rao, Commissioner: And is that, 321 00:39:56.350 --> 00:40:02.269 Santosh Rao, Commissioner: Is that also something we could request? The… I guess as a part of that email, we could… 322 00:40:02.640 --> 00:40:11.979 Santosh Rao, Commissioner: request council or the City Manager and the mayor to consider agendizing a discussion allowing the Commission 323 00:40:12.210 --> 00:40:15.500 Santosh Rao, Commissioner: to, to present their recommendations to Council. 324 00:40:18.840 --> 00:40:22.589 Santosh Rao, Commissioner: Is that… is that a possible recommendation we would include, or… 325 00:40:23.530 --> 00:40:26.750 Speaker 11 (Community Hall): Well, you certainly can't make that request explicitly. 326 00:40:27.810 --> 00:40:37.680 Santosh Rao, Commissioner: And in that case, is the body able to attend in its entirety, or would it be a subset of the body so as to not 327 00:40:38.370 --> 00:40:43.929 Santosh Rao, Commissioner: violate the Brown Act and form a meeting at Council. Would that be two commissioners and no more? 328 00:40:46.860 --> 00:40:50.130 Speaker 11 (Community Hall): If the question is, 329 00:40:50.920 --> 00:40:54.260 Speaker 11 (Community Hall): for Brown Act purposes, how will we agendize 330 00:40:54.430 --> 00:41:12.399 Speaker 11 (Community Hall): a meeting of two bodies, and I think the agenda would need to know… would notice that it's a joint meeting between the City Council and the Planning Commission, although I'm not certain that that's necessary or required for the purpose of this particular item, where you're going to be informing the Council of 331 00:41:12.400 --> 00:41:17.670 Speaker 11 (Community Hall): Of the subject matter and the recommendations from this commission. 332 00:41:19.830 --> 00:41:20.440 Santosh Rao, Commissioner: Okay. 333 00:41:21.340 --> 00:41:27.840 Santosh Rao, Commissioner: I have no other questions, but I would like to, for the purpose of discussion. 334 00:41:28.330 --> 00:41:30.819 Santosh Rao, Commissioner: Consider if we can make, 335 00:41:31.050 --> 00:41:34.480 Santosh Rao, Commissioner: Maybe some small motions to see if we have 336 00:41:34.950 --> 00:41:42.060 Santosh Rao, Commissioner: some consensus on these items. I don't know how the Commission wants to proceed, whether you want to use straw votes or motions, I will… 337 00:41:42.430 --> 00:41:47.710 Santosh Rao, Commissioner: I'd love to hear from other commissioners what the preference is, and we can… Look to add a few… 338 00:41:47.820 --> 00:41:50.160 Santosh Rao, Commissioner: Minor additions to this. 339 00:41:50.660 --> 00:41:58.750 Santosh Rao, Commissioner: I had a few that I commended. One was the use of the banner across Stevens Creek, similar to how other city departments are using. 340 00:41:59.540 --> 00:42:09.160 Santosh Rao, Commissioner: And that, the second one was the cross-agency communications outreach, taking advantage of CUST, FHSDA, and FHDA. 341 00:42:09.920 --> 00:42:17.139 Santosh Rao, Commissioner: And then the third was, I believe the report does not actually talk about AB2904, so it might be worth… 342 00:42:17.950 --> 00:42:23.810 Santosh Rao, Commissioner: Abanding the report to just include that, and if we are adhering to it, then maybe we reference that. 343 00:42:24.730 --> 00:42:27.539 Santosh Rao, Commissioner: I will just pause there so we don't get lost in… 344 00:42:28.390 --> 00:42:32.180 Santosh Rao, Commissioner: Would, like to hear… Yeah, thank you. 345 00:42:33.630 --> 00:42:41.520 Speaker 6 (Community Hall): Yeah, thank you, Commissioner Rao. City Attorney, is there a preference between straw vote versus having an actual motion for… 346 00:42:41.640 --> 00:42:43.240 Speaker 6 (Community Hall): This final recommendation. 347 00:42:44.310 --> 00:42:47.330 Speaker 11 (Community Hall): I think it's appropriate to use straw votes here. Okay. 348 00:42:47.560 --> 00:42:48.430 Speaker 11 (Community Hall): Thank you. 349 00:42:48.710 --> 00:43:06.159 Speaker 6 (Community Hall): Okay, so thank you, Commissioner Rao, for your suggestions. I have noted them. The one I wanted to clarify was around the assembly bill. I thought my understanding from staff is that we are already adhering to that one, so does it need to go within a suggestion for future changes? 350 00:43:09.320 --> 00:43:16.050 Santosh Rao, Commissioner: I would probably propose including it so that it is informative to 351 00:43:16.570 --> 00:43:26.170 Santosh Rao, Commissioner: both Council and members of the public that are reading it to be aware that this… because this is a recent bill, it just passed Jan 1st, 2025, 352 00:43:26.500 --> 00:43:38.619 Santosh Rao, Commissioner: And so, the fact that noticing has increased to 20 days is something that is fairly new, and it may be educational to members of the public as well. So for that purpose, I would include it in the report. 353 00:43:40.240 --> 00:43:55.840 Santosh Rao, Commissioner: I… I also want to add one, one additional item to the list I mentioned, which is… and I think it is on your list, but I believe the city of… maybe this is in your list, the city of Santa Clara has a quarter-mile radius on very high fire hazards 354 00:43:56.110 --> 00:43:58.109 Santosh Rao, Commissioner: Division, was that in your list already? 355 00:43:59.350 --> 00:44:10.500 Speaker 6 (Community Hall): No, that was not. I think that that was part… one of the recommendations was to increase the noticing radius for very high fire hazard zones, though, so yes. Sorry, the answer is yes. 356 00:44:10.500 --> 00:44:15.890 Santosh Rao, Commissioner: Yeah, so specific… yeah, so specifically, the City of Santa Clara is considering including 357 00:44:16.050 --> 00:44:22.320 Santosh Rao, Commissioner: a broader noticing of quarter mile for very high fire hazard civility zone. So I would just… 358 00:44:22.840 --> 00:44:29.479 Santosh Rao, Commissioner: maybe propose inclusion of the quarter mile for the VHF. 359 00:44:29.660 --> 00:44:35.009 Santosh Rao, Commissioner: Whatever that acronym is, just given how much aquatino is in the red zone and orange zone. 360 00:44:36.980 --> 00:44:37.790 Speaker 6 (Community Hall): Okay. 361 00:44:39.170 --> 00:44:56.949 Speaker 6 (Community Hall): I think we can possibly go by category. I still think that there were 3 main categories of recommendations. One was noticing radius, the second was noticing language, and then the third was around channels of outreach. So maybe we can just do some straw polls of this group. 362 00:44:57.100 --> 00:44:59.360 Speaker 6 (Community Hall): Starting… 363 00:44:59.920 --> 00:45:14.820 Speaker 6 (Community Hall): with, the members online, we will do Commissioner Rao, Lynn Skogg, and then Vice Chair, myself, and then Commissioner Fung. So what would you support an increase in noticing radius for? 364 00:45:15.300 --> 00:45:22.289 Speaker 6 (Community Hall): larger projects, anything, for example, 2 acres or more, larger projects could be, 365 00:45:22.570 --> 00:45:32.400 Speaker 6 (Community Hall): determined by this commission as well. Zoning changes, very high fire hazard zone projects, one quarter mile, and changes to major streets. 366 00:45:33.600 --> 00:45:34.869 Speaker 6 (Community Hall): Commissioner Rao. 367 00:45:37.090 --> 00:45:39.819 Santosh Rao, Commissioner: Sorry, point of, point of inquiry. 368 00:45:40.010 --> 00:45:50.140 Santosh Rao, Commissioner: Are we trying to reiterate the recommendations in the report, and doing that line by line, or itemizing it? Because it might be more efficient to just do 369 00:45:51.780 --> 00:45:57.900 Santosh Rao, Commissioner: You know, do we do a straw vote for your report, and then do a straw vote for any amendments? 370 00:45:58.230 --> 00:46:05.479 Santosh Rao, Commissioner: Because there's quite a few recommendations in the report, and I guess we could do one straw vote to just accept the recommendations, and then… 371 00:46:05.920 --> 00:46:07.720 Santosh Rao, Commissioner: Work through the amendments, if any. 372 00:46:09.030 --> 00:46:17.710 Speaker 6 (Community Hall): Yes, I wasn't sure if there was differing feedback on the different components of the recommendations, but if, you know. 373 00:46:17.930 --> 00:46:23.430 Speaker 6 (Community Hall): People feel that there's generally alignment on the direction, and would rather go by 374 00:46:23.570 --> 00:46:28.799 Speaker 6 (Community Hall): amendments. I… I'm open to that as well. Commissioner Linskog? 375 00:46:29.880 --> 00:46:47.309 Seema Lindskog, Commissioner: No, I was gonna say, I think the way you're… you were doing it with the three sections is good, so that we can have, you know, conversation with each of the… or… or, you know, straw vote on the… each of the three sections, and then take each of the amendments that, Commissioner Rao is suggesting, or any of the other commissioners. 376 00:46:49.900 --> 00:46:59.149 Speaker 6 (Community Hall): Yeah, I just, I'm concerned that it might be a little bit too broad and far-reaching to have the Commission approve the entire, 377 00:46:59.150 --> 00:46:59.700 Seema Lindskog, Commissioner: Exactly. 378 00:46:59.700 --> 00:47:03.509 Speaker 6 (Community Hall): set of recommendations, so that's why I'm going by category. 379 00:47:03.850 --> 00:47:06.430 Seema Lindskog, Commissioner: No, I like… I think the categories is appropriate. 380 00:47:06.940 --> 00:47:07.570 Community Hall: Okay. 381 00:47:09.930 --> 00:47:17.059 Speaker 6 (Community Hall): All right, so, again, starting with you, Commissioner Rao, what is your opinion on increasing noticing radius? 382 00:47:19.100 --> 00:47:21.580 Speaker 6 (Community Hall): Do you support increasing… yes? 383 00:47:21.920 --> 00:47:22.600 Speaker 6 (Community Hall): Okay. 384 00:47:23.430 --> 00:47:24.760 Speaker 6 (Community Hall): Commissioner Linskog? 385 00:47:25.470 --> 00:47:26.110 Seema Lindskog, Commissioner: Yes. 386 00:47:27.500 --> 00:47:28.620 Speaker 6 (Community Hall): Vice Chair? 387 00:47:29.340 --> 00:47:32.380 Speaker 7 (Community Hall): Yes, and I presume you're talking about codifying. 388 00:47:32.600 --> 00:47:35.759 Speaker 6 (Community Hall): Yes, codifying a decrease in noticing radius. Yes. 389 00:47:37.670 --> 00:47:41.099 Speaker 6 (Community Hall): And then for myself, it would be yes, and Commissioner Fung. 390 00:47:43.270 --> 00:47:51.219 Speaker 10 (Community Hall): I guess it's yes. I mean, I didn't think there was really an issue with what was in the report. The only difference, I think, that we had had here was that 391 00:47:51.580 --> 00:48:04.310 Speaker 10 (Community Hall): there was not an explicit distance for very high fire danger regions, so I, you know, I don't know whether the more appropriate thing is just to ask if, you know, we revise that in the presentation. 392 00:48:06.055 --> 00:48:08.635 Speaker 6 (Community Hall): I, I think… I mean… 393 00:48:08.635 --> 00:48:12.045 Speaker 10 (Community Hall): We could do it formally or informally. I'm just not sure why we would want to… 394 00:48:13.015 --> 00:48:20.215 Speaker 10 (Community Hall): I don't think there's… I'm not… I don't feel like I'm hearing a lot of opposition to what was… so I'm not sure why we would go through this… 395 00:48:20.495 --> 00:48:22.465 Speaker 10 (Community Hall): Kind of extended process here. 396 00:48:23.330 --> 00:48:23.940 Santosh Rao, Commissioner: I will be… 397 00:48:23.940 --> 00:48:30.659 Speaker 6 (Community Hall): I wasn't sure. I actually wasn't sure, but that's fine. We can note the amendment for a quarter mile. 398 00:48:30.850 --> 00:48:33.680 Speaker 6 (Community Hall): For very high fire hazard zones. 399 00:48:33.800 --> 00:48:40.150 Speaker 6 (Community Hall): Now, on the next section for clarifying noticing language. 400 00:48:41.510 --> 00:48:55.579 Speaker 6 (Community Hall): Is there… okay, Commissioner Rao, what is your opinion on clarifying noticing language on zoning? So I'll recap this for everyone who's listening. Zoning would be to include the parcel address, not just the parcel number, and for housing… 401 00:48:55.580 --> 00:49:04.210 Santosh Rao, Commissioner: Through the chair, could you share your slide as you're talking about the section that you're describing, if you might project the slide again? 402 00:49:08.900 --> 00:49:09.870 Speaker 6 (Community Hall): Okay. 403 00:49:13.170 --> 00:49:16.410 Speaker 6 (Community Hall): Okay, so I'm kind of editing it as we go. 404 00:49:19.620 --> 00:49:30.329 Speaker 6 (Community Hall): So, we're now in the green section for clarifying noticing language. And so, the reason why I had wanted to go section by section was I had sensed some question around 405 00:49:31.510 --> 00:49:37.170 Speaker 6 (Community Hall): Increasing the amount of content on the mailers, and whether that's feasible. 406 00:49:38.190 --> 00:49:49.510 Speaker 6 (Community Hall): So we may want to potentially dial back this recommendation, or just, you know, not have it. Commissioner Linskog, you had your hand… do you have a question? 407 00:49:50.040 --> 00:50:05.870 Seema Lindskog, Commissioner: Yeah, no, that was exactly my comment. And I think, you know, if there's another way to address that, so it's not in the notice, but, you know, maybe there's a link to… here's, you know, as I think Commissioner Scharf, or Vice Chair Scharf suggested, maybe there's a link to 408 00:50:05.970 --> 00:50:22.570 Seema Lindskog, Commissioner: Not necessarily each waivers that this specific project is requesting, but, you know, here's all the law around it, and what they can request, and how the city has to abide by it, something like that, so that we're not trying to do, you know, each and every single… because it might look like, you know. 409 00:50:22.680 --> 00:50:29.939 Seema Lindskog, Commissioner: Those medical documents with the tiny 6- point font, which doesn't really serve any purpose at that point. 410 00:50:35.140 --> 00:50:36.010 Speaker 6 (Community Hall): Chishna Rowe? 411 00:50:37.400 --> 00:50:41.510 Santosh Rao, Commissioner: Yes, I was going to echo that that seems excessive. 412 00:50:41.770 --> 00:50:44.520 Santosh Rao, Commissioner: To include all of the housing 413 00:50:44.980 --> 00:50:54.480 Santosh Rao, Commissioner: state law language, because that, I believe, staff do include that in the staff report when the project comes to the hearing, and I think they do a pretty good job at 414 00:50:55.080 --> 00:51:02.179 Santosh Rao, Commissioner: At tabulating what laws apply and how they're being used, and for any members of the public that 415 00:51:02.590 --> 00:51:12.909 Santosh Rao, Commissioner: who are interested would see that in the staff report. So I think the address is a particularly good one to include. I would be supportive of the address, which is the first section of that column. 416 00:51:13.060 --> 00:51:16.099 Santosh Rao, Commissioner: I don't think the second section is needed, nor would it fit. 417 00:51:16.340 --> 00:51:19.830 Santosh Rao, Commissioner: And the footprint that we have for any sort of… any sort. 418 00:51:22.070 --> 00:51:29.700 Speaker 6 (Community Hall): Okay, great. So, let me do a straw poll, then, on just clarifying the noticing language for zoning and parcel address. Chair, if I may. 419 00:51:29.700 --> 00:51:37.989 Speaker 8 (Community Hall): Yes? Oh, right here. Our code actually requires us to put the parcel address, so it's already codified. 420 00:51:38.690 --> 00:51:47.240 Speaker 6 (Community Hall): Oh, okay. So this was just, me going off of community feedback that the parcel number was visible and the address was not. 421 00:51:47.880 --> 00:51:50.469 Speaker 8 (Community Hall): We are required by law to include the address. 422 00:51:50.475 --> 00:52:01.355 Speaker 6 (Community Hall): So, specifically, the instance I'm referring to is, residents referring to receiving a mailer with a list of parcel numbers, but no addresses. Did that ever exist? 423 00:52:02.410 --> 00:52:03.040 Speaker 8 (Community Hall): Okay? 424 00:52:03.320 --> 00:52:06.849 Speaker 8 (Community Hall): Not to my knowledge. In that case. 425 00:52:06.850 --> 00:52:08.770 Speaker 6 (Community Hall): So we are… 426 00:52:08.770 --> 00:52:10.920 Santosh Rao, Commissioner: Through the chair. Through the chair. 427 00:52:11.370 --> 00:52:16.760 Santosh Rao, Commissioner: During the housing element discussions, all the way through to the final hearing. 428 00:52:16.880 --> 00:52:20.509 Santosh Rao, Commissioner: The materials included an APN, but not an address, and… 429 00:52:20.650 --> 00:52:24.859 Santosh Rao, Commissioner: as a member of the public at that time, I repeatedly raised the same comment, that 430 00:52:25.030 --> 00:52:30.080 Santosh Rao, Commissioner: the APN is not easy to identify, and an address should be included, so I offered 431 00:52:30.340 --> 00:52:36.030 Santosh Rao, Commissioner: at that time, written comment and public comment to that effect. So, if you go back, look at the housing element materials. 432 00:52:36.330 --> 00:52:45.030 Santosh Rao, Commissioner: The APN is there, the address is not, and it's possible that the address could not be included in certain cases, so maybe that was the reason. 433 00:52:45.500 --> 00:52:50.180 Santosh Rao, Commissioner: And maybe Luke can clarify that. There may have been parcels that 434 00:52:51.310 --> 00:52:54.910 Santosh Rao, Commissioner: We're, for example, the public right-of-way, and therefore did not have an address. 435 00:52:57.250 --> 00:53:01.760 Speaker 8 (Community Hall): Correct. If a parcel does not have an address, we can't include it. We would have to include the APN. 436 00:53:02.660 --> 00:53:04.220 Speaker 8 (Community Hall): We have to include some identity. 437 00:53:04.220 --> 00:53:04.570 Santosh Rao, Commissioner: to fight. 438 00:53:05.640 --> 00:53:13.229 Santosh Rao, Commissioner: So, can staff clarify, did we have a precedent during the housing element, when the site list was socialized with the various meetings? 439 00:53:13.480 --> 00:53:16.379 Santosh Rao, Commissioner: that the APN was used, but not the address. 440 00:53:18.000 --> 00:53:26.969 Speaker 8 (Community Hall): If I had to use a specific example, then yes, I could point to the Mary Avenue parcel, which did not and does not still have an address. It only has an APN. 441 00:53:28.290 --> 00:53:31.250 Santosh Rao, Commissioner: But otherwise, it's fair to say if an address existed, you would include that. 442 00:53:33.770 --> 00:53:41.019 Speaker 8 (Community Hall): At this point, I'm just saying that the code requires us to include the address. That is what Chapter 19.12 of the Municipal Code says. 443 00:53:42.760 --> 00:53:45.719 Speaker 10 (Community Hall): Perhaps it would be better, if there's an issue here where 444 00:53:45.960 --> 00:53:49.360 Speaker 10 (Community Hall): Where anybody feels that the address wasn't included. 445 00:53:49.470 --> 00:53:51.209 Speaker 10 (Community Hall): Perhaps we… if we could see that. 446 00:53:52.270 --> 00:53:54.860 Speaker 10 (Community Hall): Rather than… rather than, you know. 447 00:53:55.540 --> 00:54:03.560 Speaker 10 (Community Hall): If we… if we know there's a requirement, then it was included when it's possible. If it's… if there's not an address of record, then it wasn't included. I mean, you know… 448 00:54:06.250 --> 00:54:10.329 Speaker 10 (Community Hall): When I look at the housing element proposal, I mean. 449 00:54:10.470 --> 00:54:13.070 Speaker 10 (Community Hall): You know, there's a pretty good idea of where these… 450 00:54:13.350 --> 00:54:16.489 Speaker 10 (Community Hall): Of where these things are. I mean, most of these, most of these sites… Right. 451 00:54:16.495 --> 00:54:20.124 Speaker 8 (Community Hall): If an address is not included, usually we include a map. Yes. 452 00:54:21.010 --> 00:54:23.370 Speaker 6 (Community Hall): Well, I believe, Commissioner Minskog, yes. 453 00:54:23.370 --> 00:54:34.399 Seema Lindskog, Commissioner: Yeah, sorry, thank you. So I think I understand where this is coming from also, is… I don't think this is in the zoning postcards or notices, but it is in… 454 00:54:34.480 --> 00:54:59.430 Seema Lindskog, Commissioner: I've encountered this as well, is in some of the presentations, often they'll… or in the, you know, appendices and tables, it'll list the APN, but it will not list the address next to it, and that is kind of confusing, because you have to kind of go back and forth and look up the APN, look up the address, and it creates… it creates more work. And, you know, we do it because it's our job, but for a member of the public, I can see how that 455 00:54:59.430 --> 00:55:02.250 Seema Lindskog, Commissioner: It would get pretty confusing and difficult to follow. 456 00:55:02.250 --> 00:55:18.530 Seema Lindskog, Commissioner: So maybe it's the… what we should be putting in the recommendations is not, to add the address to the postcard, but in… in all the presentation materials to have the address easily referenceable. 457 00:55:18.590 --> 00:55:29.619 Seema Lindskog, Commissioner: whenever the APN is listed, to, you know, to have it always listed next to each other, to make it easier for the public to follow, what's happening in those, in those, 458 00:55:29.790 --> 00:55:31.340 Seema Lindskog, Commissioner: in those presentations. 459 00:55:32.430 --> 00:55:40.860 Seema Lindskog, Commissioner: I don't know if that's something staff would find onerous, I'm not sure, but… but I've heard that feedback, so I think maybe that's where it's coming from. 460 00:55:42.200 --> 00:55:43.700 Santosh Rao, Commissioner: Thank you very much. 461 00:55:43.700 --> 00:55:44.580 Speaker 6 (Community Hall): Oh, sorry. 462 00:55:44.580 --> 00:55:52.109 Santosh Rao, Commissioner: The amount of ambiguity in this, maybe it's worth just including the language, just to be explicit, to encourage inclusion of the address where possible. 463 00:55:53.390 --> 00:55:55.750 Speaker 7 (Community Hall): So, I think we could put a link 464 00:55:56.220 --> 00:56:00.990 Speaker 7 (Community Hall): to Google Maps, or put in the longitude and latitude if there is no address. 465 00:56:01.160 --> 00:56:04.500 Speaker 7 (Community Hall): Because that is something people can easily go 466 00:56:04.660 --> 00:56:13.159 Speaker 7 (Community Hall): and used to figure out where it is, as opposed to the APN, which is a lot more work to figure out where exactly that is located. 467 00:56:15.120 --> 00:56:18.450 Santosh Rao, Commissioner: But if you're talking about a postcard, how do you click a link on a postcard? 468 00:56:19.610 --> 00:56:25.120 Speaker 7 (Community Hall): You can put a tiny link, or you can just put the coordinates if the people are really interested, but… 469 00:56:25.240 --> 00:56:33.379 Speaker 7 (Community Hall): Yeah, you can put, instead of the long Google Maps link, you can create a tiny link that goes directly to the Google Maps. 470 00:56:36.270 --> 00:56:40.700 Santosh Rao, Commissioner: Yeah, it just seems to me like an address would be the most straightforward thing to include. 471 00:56:41.240 --> 00:56:45.100 Speaker 7 (Community Hall): Right, if there is an address. If there's not an address, that's the issue. 472 00:56:45.720 --> 00:56:50.009 Speaker 7 (Community Hall): That's when you want to include some reference to where it actually is. 473 00:56:50.250 --> 00:56:51.519 Speaker 7 (Community Hall): I mean, I don't know… 474 00:56:51.710 --> 00:56:55.669 Speaker 7 (Community Hall): A better… you know, or you can print a map on the postcard, but that seems… 475 00:56:55.850 --> 00:56:57.870 Speaker 7 (Community Hall): Like, a lot more work. 476 00:57:00.440 --> 00:57:01.020 Santosh Rao, Commissioner: Okay. 477 00:57:01.020 --> 00:57:06.350 Speaker 6 (Community Hall): I think, and I agree with Commissioner Alinskog's suggestion, it seems… 478 00:57:06.510 --> 00:57:16.270 Speaker 6 (Community Hall): So staff has confirmed that they are required to include the address on… on the communications, but there is some, you know. 479 00:57:17.210 --> 00:57:36.540 Speaker 6 (Community Hall): The community has experienced seeing parcel numbers with no address, so maybe just for posterity's sake, we will just, you know, have a straw poll here to confirm that we would like to make sure the parcel address is on all relevant, public hearing communications. 480 00:57:36.560 --> 00:57:39.420 Speaker 6 (Community Hall): So… why don't we just, 481 00:57:39.750 --> 00:57:41.870 Speaker 6 (Community Hall): go forward with that, Commissioner Rao? 482 00:57:43.830 --> 00:57:58.439 Speaker 6 (Community Hall): What would your opinion be on clarifying the noticing language for zoning to ensure that all communications include the parcel address? While we understand that it is already legally required? We are just confirming… we are reiterating our desire for this. 483 00:57:59.750 --> 00:58:10.930 Santosh Rao, Commissioner: I would support including the address and a reference to that. I would not support this language around the state laws and all of the text explaining the relevant housing laws. 484 00:58:10.930 --> 00:58:15.579 Speaker 6 (Community Hall): Right, yeah, we are… we are leaving that out. Alright, Commissioner Linskog? 485 00:58:16.490 --> 00:58:17.100 Seema Lindskog, Commissioner: Aye. 486 00:58:17.580 --> 00:58:18.219 Seema Lindskog, Commissioner: Or yes. 487 00:58:18.220 --> 00:58:18.890 Speaker 6 (Community Hall): mister? 488 00:58:20.490 --> 00:58:21.320 Speaker 6 (Community Hall): Bye. 489 00:58:21.740 --> 00:58:24.789 Speaker 6 (Community Hall): Yes for myself, and then Commissioner Fung? 490 00:58:25.325 --> 00:58:28.584 Speaker 10 (Community Hall): actually vote no on this. We've already got 491 00:58:29.225 --> 00:58:33.405 Speaker 10 (Community Hall): It's already… it's already… so I think the problem is, it's sort of… 492 00:58:34.005 --> 00:58:41.404 Speaker 10 (Community Hall): you know, if a place doesn't have an address, we're not going to make… we're not going to have an address for it. So I don't think we're… I don't think there's any point in even having a discussion about this. 493 00:58:41.950 --> 00:58:51.119 Speaker 6 (Community Hall): And I understand that. Okay, great. And we will move on to the final category of feedback. So, I have it pulled up here. I already… I added, 494 00:58:51.360 --> 00:58:54.409 Speaker 6 (Community Hall): Oh, apologize, Commissioner Linscog, you had a question? 495 00:58:55.050 --> 00:59:06.389 Seema Lindskog, Commissioner: Yeah, no, sorry, this is not a question. I actually have to drop off, because I have a personal matter to address, but before I go, I just wanted to make a quick comment on 496 00:59:06.390 --> 00:59:30.140 Seema Lindskog, Commissioner: the third section, I think all of it sounds great, except the banner, I think, is unfeasible, because sometimes we have multiple housing developments at the same time. The banners are expensive, and they are meant to stay up for a while, and I don't know how we would logistically or financially be able to swap them out on a continuous basis. 497 00:59:30.390 --> 00:59:42.770 Seema Lindskog, Commissioner: for all the housing development issues, especially if, you know, we sometimes have them on short notice, we wouldn't be able to print the date. So it just seems logistically infeasible. 498 00:59:42.770 --> 00:59:59.359 Seema Lindskog, Commissioner: To use the banner, though I understand the thought around it, but I think if we can do a better job on social and web and have, like, you know, a dedicated page that shows all the upcoming public hearings, we can address some of that concern. So those are my comments, and then I'm going to drop off. 499 00:59:59.390 --> 01:00:00.220 Seema Lindskog, Commissioner: Thank you. 500 01:00:00.480 --> 01:00:03.259 Speaker 6 (Community Hall): Okay, thank you, Commissioner Lenskogg, for attending remotely. 501 01:00:03.720 --> 01:00:04.340 Seema Lindskog, Commissioner: Thank you. 502 01:00:05.460 --> 01:00:06.370 Speaker 6 (Community Hall): Commissioner Rao? 503 01:00:08.470 --> 01:00:11.889 Santosh Rao, Commissioner: Yeah, so I would keep the banner for… 504 01:00:12.410 --> 01:00:20.060 Santosh Rao, Commissioner: major developments. So, for example, when we get into the next set of housing elements cylists, for the zero net loss. 505 01:00:20.260 --> 01:00:24.260 Santosh Rao, Commissioner: I think that that's a major development that the city needs to be notified on. 506 01:00:24.420 --> 01:00:33.830 Santosh Rao, Commissioner: Clearly not… every Planning Commission agenda item qualifies, but where we have major, newsworthy, 507 01:00:33.970 --> 01:00:42.759 Santosh Rao, Commissioner: items that come to Planning Commission Council, such as the Housing Elements Hitelist Update, Or the objective design standards. 508 01:00:42.880 --> 01:00:49.409 Santosh Rao, Commissioner: Or, as we look ahead, maybe there's an item around objective fire-related standards, or fire evacuation standards. 509 01:00:49.640 --> 01:00:55.800 Santosh Rao, Commissioner: And in general, if we look at large developments, we don't have that many. We have… maybe 10. 510 01:00:55.950 --> 01:01:02.830 Santosh Rao, Commissioner: Or so, and so I would… I would keep the banner, and it's a recommendation, and always have the discussion. 511 01:01:03.130 --> 01:01:08.779 Santosh Rao, Commissioner: Around how and whether it's feasible, and maybe there's even an electronic banner that 512 01:01:08.960 --> 01:01:12.930 Santosh Rao, Commissioner: That gets installed, and we can have electronics signage. 513 01:01:15.450 --> 01:01:27.849 Speaker 6 (Community Hall): Thank you, Commissioner Rao. It is an interesting point that Commissioner Linskogg brought up, because as I think about it, you know, I know of organizations that have purchased banner space, and there is a cost. 514 01:01:28.180 --> 01:01:32.750 Speaker 6 (Community Hall): Would the staff happen to know how much the cost of printing those banners is? 515 01:01:33.930 --> 01:01:50.900 Speaker 6 (Community Hall): I have no idea. Okay, yeah, I can probably find that number out independently. I do know that there is a cost, and then the other minor conflict would be that organizations do buy out that banner advertising space, and so I imagine if they are buying that space. 516 01:01:50.900 --> 01:02:06.450 Speaker 6 (Community Hall): they would get priority, unless the city is gonna buy out the space at a higher price. I'm not really sure how the bidding for the banner space works. But, you know, I like the idea, and maybe perhaps we broaden it to just 517 01:02:06.460 --> 01:02:17.670 Speaker 6 (Community Hall): you know, city signage? Does it have to be the banner over Stevens Creek, Commissioner Rao, or would you be open to just exploring city signage for major… 518 01:02:17.780 --> 01:02:23.129 Speaker 6 (Community Hall): I would consider this only relevant for really major initiatives like the housing element. 519 01:02:26.500 --> 01:02:34.409 Santosh Rao, Commissioner: Yeah, so I would not, want to be optimizing this too early. I would let this kind of ruminate through. 520 01:02:34.550 --> 01:02:40.610 Santosh Rao, Commissioner: you know, the various bodies and staff, and let them think through the options, and I wouldn't prematurely rule 521 01:02:40.750 --> 01:02:49.530 Santosh Rao, Commissioner: Given the largest concern the public has expressed over the last 3 years has been that they did not know about something, I don't think… 522 01:02:50.030 --> 01:03:03.970 Santosh Rao, Commissioner: That we should prematurely rule something like this out, because this is very effective. Everybody sees the banner. Now, again, there's no reason there should be only one location for a banner, maybe there's multiple banners. So I wouldn't want to, sort of. 523 01:03:04.130 --> 01:03:10.139 Santosh Rao, Commissioner: Prematurely exclude things at this stage, especially where it is effective in reaching the public. 524 01:03:10.420 --> 01:03:15.819 Santosh Rao, Commissioner: I would, I would recommend we consider keeping it, and then let the… 525 01:03:15.940 --> 01:03:29.060 Santosh Rao, Commissioner: let the staff and the departments and the council decide how they would want to approach it. Like we said, there are multiple different options here. Could be different locations, could be electronic signboard, maybe there's grants for that, you know. 526 01:03:29.200 --> 01:03:33.000 Santosh Rao, Commissioner: Let… let the… let the proposal run its course. 527 01:03:35.430 --> 01:03:39.389 Speaker 6 (Community Hall): Okay, thank you. Any other feedback on this category before we strappel? 528 01:03:40.180 --> 01:03:42.000 Speaker 6 (Community Hall): Okay, so, I'm gonna… 529 01:03:42.000 --> 01:03:48.560 Santosh Rao, Commissioner: Are we on the third point of clarification, point of inquiry? Is that the third column we're looking at, or what are we looking at? 530 01:03:48.740 --> 01:04:02.090 Speaker 6 (Community Hall): Yes, we're looking at the third column, so I did add the banner as the suggestion, and I also added… oh, sorry, it's a little bit cryptic. Cross-agency was referring to partnering with other agencies, like CUSD and FUHSD. 531 01:04:03.530 --> 01:04:06.399 Santosh Rao, Commissioner: Right, and there was one more that I had brought up, which was the… 532 01:04:06.910 --> 01:04:14.090 Santosh Rao, Commissioner: Can the city acquire the technology that was used for telephone outreach? So, if we might include that. 533 01:04:15.990 --> 01:04:17.180 Speaker 6 (Community Hall): Okay. 534 01:04:17.180 --> 01:04:17.980 Santosh Rao, Commissioner: activity. 535 01:04:18.290 --> 01:04:33.689 Speaker 6 (Community Hall): Yep, I… I… well, I am screen sharing, and now I can't edit it, but we can just include that, mentally. So, I think I have noted Commissioner Linskaugh agrees with this category, but did not agree with the banner. Commissioner Rao? 536 01:04:34.480 --> 01:04:40.659 Speaker 6 (Community Hall): what is your opinion on the increasing channels of outreach, including what is listed on the screen? Okay. 537 01:04:40.660 --> 01:04:42.689 Santosh Rao, Commissioner: With the additions that I mentioned. 538 01:04:43.320 --> 01:04:47.800 Speaker 6 (Community Hall): Right. I… Okay, yes for myself and Commissioner Fung? 539 01:04:48.405 --> 01:04:59.414 Speaker 10 (Community Hall): difficult again. I'm opposed to the banner. I don't think it's practical. There were a lot of people who weren't happy about Avalanche Court. I don't think they would care if you put a sign at Stevens Creek Boulevard saying. 540 01:04:59.755 --> 01:05:04.465 Speaker 10 (Community Hall): you know, there's a project at Eve Village Court, and that you know. 541 01:05:04.585 --> 01:05:12.224 Speaker 10 (Community Hall): all the same problems that we have with Mailer, people will look at that and go, I wonder where that is. So, it just doesn't seem like it has any value. 542 01:05:12.395 --> 01:05:20.244 Speaker 10 (Community Hall): The, cross-agency… It's interesting, 543 01:05:22.235 --> 01:05:33.495 Speaker 10 (Community Hall): in the… in the, last general plan, maybe not the housing element, but in the last general plan, there was… there was some coordinated efforts for communications with the… the, school districts, so… 544 01:05:33.635 --> 01:05:36.625 Speaker 10 (Community Hall): you know, I think it's good. 545 01:05:37.385 --> 01:05:49.875 Speaker 10 (Community Hall): Well, in general, I thought the report was really good, in terms of hitting a lot of good points. So, you know, there were a couple places… I think there were a few places here where things didn't get into the fire zone region, and the 546 01:05:49.985 --> 01:06:02.324 Speaker 10 (Community Hall): school district tie-ins, or other, you know, community organization tie-ins. So, you know, I'm supportive of that, but I think that I'm generally kind of saying on this one again, I'm probably 547 01:06:03.015 --> 01:06:09.635 Speaker 10 (Community Hall): overall voting… voting… well, I don't even know how to say this. I mean, I'm voting now on the banner. 548 01:06:09.855 --> 01:06:15.355 Speaker 10 (Community Hall): I'm okay with the other, items, items that were mentioned in the, in the report. 549 01:06:15.780 --> 01:06:18.699 Speaker 6 (Community Hall): Great, yeah, thank you very much, and I, you know, I think I really… 550 01:06:18.790 --> 01:06:41.750 Speaker 6 (Community Hall): will do my best to incorporate the full, breadth of perspectives from this Commission into this. Whatever final recommendation goes to Council. I think it seems like there's an appetite to keep the recommendations more broad so that Council can, you know, take and leave whatever they feel, they want, but we can definitely note that, you know, there are caveats with something like a banner as well. Commissioner Rao? 551 01:06:45.630 --> 01:06:46.790 Santosh Rao, Commissioner: Sorry, I had no comment. 552 01:06:47.270 --> 01:06:47.950 Speaker 6 (Community Hall): Oh, okay. 553 01:06:48.920 --> 01:06:58.919 Speaker 6 (Community Hall): Great, so, it sounds like, you know, just to conclude, we have general recommendations that we would make to Council for their consideration. 554 01:06:59.090 --> 01:07:05.000 Speaker 6 (Community Hall): City attorney, did we need to officially designate someone? Okay. 555 01:07:05.680 --> 01:07:06.600 Speaker 6 (Community Hall): Does. 556 01:07:06.600 --> 01:07:12.020 Santosh Rao, Commissioner: Sorry, through the chair, are we done with the amendments? Because I thought we did have a few others. 557 01:07:12.250 --> 01:07:18.629 Speaker 6 (Community Hall): Oh, okay, yes, please feel free to add in any other amendments that you would like us to vote on. 558 01:07:20.040 --> 01:07:25.069 Santosh Rao, Commissioner: I'm just… Looking at the discussions we had so far. 559 01:07:25.370 --> 01:07:33.559 Santosh Rao, Commissioner: I believe we said we would include the language around AB 20904 for educational and completeness purposes. 560 01:07:33.740 --> 01:07:35.490 Santosh Rao, Commissioner: Do we need to vote on that, or… 561 01:07:37.890 --> 01:07:47.279 Speaker 6 (Community Hall): I think that since that's already being adhered to at staff, and that's just a note that we would make, I don't know that we need to, but, you know, we can include that. 562 01:07:48.170 --> 01:07:53.769 Santosh Rao, Commissioner: Okay, and then… There was the Fire Hazard Severity Zone, did we already include that? 563 01:07:54.350 --> 01:08:00.270 Speaker 6 (Community Hall): Yes, expanding the noticing radius to a quarter mile for very high fire hazard zone projects. 564 01:08:01.710 --> 01:08:02.710 Santosh Rao, Commissioner: Okay, great. 565 01:08:03.120 --> 01:08:08.370 Santosh Rao, Commissioner: And one topic we have not discussed, and I don't know how commissioners feel about this. 566 01:08:08.630 --> 01:08:11.950 Santosh Rao, Commissioner: Is multilingual notifications, do we do that today? 567 01:08:12.380 --> 01:08:17.200 Santosh Rao, Commissioner: Do we do notifications, for example, in… in, in Banton? 568 01:08:17.810 --> 01:08:20.040 Santosh Rao, Commissioner: We have a large Asian population. 569 01:08:20.370 --> 01:08:26.520 Santosh Rao, Commissioner: I don't know if we do any kind of multilingual in Mandarin, or… Or other languages. 570 01:08:27.890 --> 01:08:28.210 Speaker 6 (Community Hall): So… 571 01:08:28.210 --> 01:08:32.250 Santosh Rao, Commissioner: And I realize it's a cost, we have a highly educated population, but… 572 01:08:32.470 --> 01:08:36.640 Santosh Rao, Commissioner: Just trying to understand what the… what the current… enormous. 573 01:08:37.490 --> 01:08:39.679 Speaker 7 (Community Hall): So, I was wondering if we should… 574 01:08:40.000 --> 01:08:43.790 Speaker 7 (Community Hall): include non-English newspapers as well, like, 575 01:08:44.080 --> 01:08:46.939 Speaker 7 (Community Hall): World Journal, I'm not sure what, 576 01:08:47.250 --> 01:08:49.779 Speaker 7 (Community Hall): Commissioner Ralph, you're aware of any, 577 01:08:50.660 --> 01:08:54.999 Speaker 7 (Community Hall): newspapers for the Indian community that they consistently read. 578 01:08:55.490 --> 01:08:59.740 Speaker 7 (Community Hall): Because I can tell you, in Cupertino, there's probably more people 579 01:08:59.939 --> 01:09:04.009 Speaker 7 (Community Hall): reading World Journal than there is the Mercury News of the Cupertino Courier. 580 01:09:05.779 --> 01:09:06.359 Speaker 6 (Community Hall): So… 581 01:09:06.359 --> 01:09:09.049 Santosh Rao, Commissioner: So we should definitely include that one, that's a good catch. 582 01:09:10.010 --> 01:09:14.470 Speaker 6 (Community Hall): I think that would be… so, staff, are we currently notifying in other languages? 583 01:09:15.890 --> 01:09:16.510 Speaker 8 (Community Hall): No. 584 01:09:17.569 --> 01:09:20.530 Speaker 8 (Community Hall): Alright, so that would be… 585 01:09:21.145 --> 01:09:29.254 Speaker 6 (Community Hall): And actually, would you mind clarifying, what are the costs that get passed on to the developer when it comes to noticing 586 01:09:29.415 --> 01:09:31.494 Speaker 6 (Community Hall): Versus is held by the city. 587 01:09:32.790 --> 01:09:44.910 Speaker 8 (Community Hall): develop… Sorry, costs are passed on to applicants, not just developers, they could be residents. Okay. But with that said, newspaper… all the newspaper noticing is passed on to applicants. Okay. 588 01:09:45.649 --> 01:09:46.729 Speaker 6 (Community Hall): Alright, thank you very much. 589 01:09:47.539 --> 01:09:50.339 Speaker 6 (Community Hall): Great, okay, I would be on… 590 01:09:50.340 --> 01:09:51.950 Santosh Rao, Commissioner: the chair, I just wanna… 591 01:09:52.180 --> 01:10:03.399 Santosh Rao, Commissioner: I wanna be cognizant of passing on added cost to single-family home remodel applicants, so if we may modify this language to reference specifically 592 01:10:03.690 --> 01:10:10.670 Santosh Rao, Commissioner: In… in some shape or form, that this would apply to developments larger than 593 01:10:11.060 --> 01:10:12.920 Santosh Rao, Commissioner: You know, let's pick a number, but… 594 01:10:13.430 --> 01:10:16.659 Santosh Rao, Commissioner: Maybe it's 5 or whatever it is, but… 595 01:10:16.800 --> 01:10:19.629 Santosh Rao, Commissioner: I would be loath to apply any sort of 596 01:10:19.890 --> 01:10:21.949 Santosh Rao, Commissioner: None of this should really be to the… 597 01:10:22.090 --> 01:10:25.230 Santosh Rao, Commissioner: To the already burdened single-family homeowners. 598 01:10:25.780 --> 01:10:30.340 Santosh Rao, Commissioner: I hope we are not passing on a cost on them accidentally. That would be something we'd want to avoid. 599 01:10:32.310 --> 01:10:38.660 Speaker 6 (Community Hall): Yep, I think that's fine. Thank you, Commissioner Rao. So maybe we can… let's do a straw poll on… 600 01:10:38.850 --> 01:10:44.690 Speaker 6 (Community Hall): Multilingual notifications, as well as ads in… 601 01:10:44.840 --> 01:10:50.289 Speaker 6 (Community Hall): Other foreign language media publications for… 602 01:10:50.460 --> 01:10:54.999 Speaker 6 (Community Hall): developments of… for larger developments, let's leave it at that for now. 603 01:10:55.460 --> 01:10:56.870 Speaker 6 (Community Hall): Commissioner Rao. 604 01:10:57.770 --> 01:10:58.380 Santosh Rao, Commissioner: Oh, yeah. 605 01:10:59.220 --> 01:11:00.490 Speaker 6 (Community Hall): Okay, Vice Chair? 606 01:11:03.160 --> 01:11:11.299 Speaker 7 (Community Hall): I, however… If a single-family homeowner is splitting a lot into 607 01:11:11.590 --> 01:11:20.450 Speaker 7 (Community Hall): 6 units, I think that would still… should still qualify for noticing. Or even 4 units. 608 01:11:21.080 --> 01:11:21.780 Speaker 7 (Community Hall): I mean… Right. 609 01:11:21.780 --> 01:11:23.150 Santosh Rao, Commissioner: So, if we were to pick a number… 610 01:11:23.150 --> 01:11:25.069 Speaker 7 (Community Hall): An ADU wouldn't qualify. 611 01:11:27.060 --> 01:11:31.880 Santosh Rao, Commissioner: Right, so if you were to pick a number, so 4 years or larger, and something to that effect. 612 01:11:32.270 --> 01:11:33.910 Speaker 7 (Community Hall): Yeah, 4 is good. 613 01:11:35.270 --> 01:11:38.730 Speaker 6 (Community Hall): Okay, for myself it is yes, Commissioner Fung. 614 01:11:39.160 --> 01:11:44.739 Speaker 10 (Community Hall): Once again, I'm probably… I'm probably knowing this. I think that, 615 01:11:47.040 --> 01:11:53.349 Speaker 10 (Community Hall): The World Journal is actually a great, great recommendation, although, you know, kind of any newspaper is sort of, 616 01:11:54.070 --> 01:12:04.700 Speaker 10 (Community Hall): maybe not the best, the most effective use of the funds. I'm particularly concerned that the, the projects of the greatest impact are things like a housing element. 617 01:12:04.760 --> 01:12:15.020 Speaker 10 (Community Hall): So, you know, it will have lots and lots and lots of material that would need to be translated, and of course, there are no developers that you're going to charge that to. The city will have to pay that. 618 01:12:15.230 --> 01:12:18.829 Speaker 10 (Community Hall): So, I think making that requirement's probably not… not practical. 619 01:12:19.160 --> 01:12:23.859 Speaker 10 (Community Hall): Yeah, so I'd say no. 620 01:12:24.790 --> 01:12:32.630 Speaker 6 (Community Hall): I think that's a valid point, and I think that maybe the key here is figuring out the threshold for what we're defining as large. 621 01:12:33.180 --> 01:12:40.160 Speaker 6 (Community Hall): So… Yeah, that's… that's something that we would need to contemplate. I would actually… 622 01:12:40.165 --> 01:12:45.025 Speaker 10 (Community Hall): I would really agree on that, although I think that, you know, for something to be large enough to warrant 623 01:12:45.615 --> 01:12:49.315 Speaker 10 (Community Hall): being on a banner, you really are kind of talking about, you know, there's a project that's 624 01:12:49.555 --> 01:12:54.885 Speaker 10 (Community Hall): 25 or 35 acres, not… Not one that's even 2 acres, or… 625 01:12:55.285 --> 01:13:00.435 Speaker 10 (Community Hall): I don't know, I… I actually would agree with the vice chair here that that… 626 01:13:00.655 --> 01:13:07.104 Speaker 10 (Community Hall): that there are certain kinds of subdivisions within, particularly maybe subdivisions in R1, perhaps, of those. 627 01:13:08.185 --> 01:13:19.415 Speaker 10 (Community Hall): warrant a different, a different noticing, right? That's an area that wouldn't be covered right now, I think, specifically at, R1 subdivision, or… 628 01:13:19.775 --> 01:13:24.385 Speaker 10 (Community Hall): maybe R3 subdivision, you know, those would be areas where 629 01:13:24.595 --> 01:13:30.835 Speaker 10 (Community Hall): Probably of interest. Of course, probably only of interest locally to, you know, a pretty small, small group. 630 01:13:33.195 --> 01:13:37.645 Speaker 10 (Community Hall): So, I think it would be great if there were a way to, You know, to… 631 01:13:37.945 --> 01:13:46.025 Speaker 10 (Community Hall): think about something in that territory. But, you know, without a specific recommendation, you know, it's just a comment. 632 01:13:46.260 --> 01:13:52.970 Speaker 6 (Community Hall): Sorry, so to confirm, you're saying you would want to do more noticing for small projects? 633 01:13:53.890 --> 01:14:02.989 Speaker 10 (Community Hall): I think that there are, that particular case of, I'm subdividing, and I'm going to… I'm going to add, a number of ADUs to a property. 634 01:14:03.390 --> 01:14:09.570 Speaker 10 (Community Hall): That… that seems… I believe that's something that's worthy of notice. We've had… 635 01:14:09.680 --> 01:14:15.730 Speaker 10 (Community Hall): We had a couple… I mean, you know, there are emails that come which are… Maybe not… 636 01:14:17.120 --> 01:14:32.759 Speaker 10 (Community Hall): You certainly understand the concern that the homeowner has. There was the one where the person is building an ADU, which is of legal but unusual height, and close to the… very close to the fence. 637 01:14:33.040 --> 01:14:42.710 Speaker 10 (Community Hall): you know, and then when they're actually talking about, well, you know, now there's an issue here because I see they're putting the, you know, water heaters and things like that. 638 01:14:43.310 --> 01:14:50.829 Speaker 10 (Community Hall): if there were a way to have, you know, have some noticing of that, I think that that's something that's probably missing today. 639 01:14:51.010 --> 01:14:58.299 Speaker 10 (Community Hall): I think it would be very easy for somebody to decide to build an ADU, and it would be hard to know about, unless you were an immediate, 640 01:14:58.520 --> 01:15:00.200 Speaker 10 (Community Hall): A merely adjoining neighbor. 641 01:15:01.540 --> 01:15:10.160 Speaker 10 (Community Hall): Right. But I have no… I have no solution on what that would be. Or, you know, of course, there are legal implementation, implications as well. 642 01:15:10.350 --> 01:15:19.370 Speaker 10 (Community Hall): You know, since ADUs have, you know, a lot of waivers of the normal, you know, non-ADUs… 643 01:15:19.720 --> 01:15:20.870 Speaker 10 (Community Hall): rules. 644 01:15:21.580 --> 01:15:27.290 Speaker 8 (Community Hall): I just wanted to add that ADUs are ministerial in nature, so it's like building permit, we cannot notice for that. 645 01:15:29.610 --> 01:15:38.750 Speaker 6 (Community Hall): Right, yeah, it's a good point. I think the ADUs are causing a lot of community unrest, and it's the one category that we don't really have much control over. Commissioner Rao? 646 01:15:40.920 --> 01:15:46.879 Santosh Rao, Commissioner: Yeah, I think staff beat me to it. I was just about to say that we are not allowed to do noticing on ADUs. 647 01:15:47.090 --> 01:16:03.400 Santosh Rao, Commissioner: Which is unfortunate, but on the earlier comment that was made about trying to make a distinction based on acreage, I would point out that some of the most controversial projects in the city are projects on small acreage. For example, the project on Schofield Drive. 648 01:16:03.750 --> 01:16:07.930 Santosh Rao, Commissioner: the project on McClellan Road. So I would, you know. 649 01:16:08.300 --> 01:16:20.120 Santosh Rao, Commissioner: I would just err on the side of caution. If the unit count is a factor, you know, if it's greater than 4 units or something like that, you know, that's probably reasonable. I mean, we won't get it right 650 01:16:20.260 --> 01:16:24.820 Santosh Rao, Commissioner: And it's not… you know, we aren't making the decision right now, it's just a recommendation, so I would just… 651 01:16:25.580 --> 01:16:29.359 Santosh Rao, Commissioner: you know, this is… if it goes anywhere, it has plenty of iterations, so I wouldn't… 652 01:16:30.070 --> 01:16:31.410 Santosh Rao, Commissioner: Split hairs on this one. 653 01:16:32.510 --> 01:16:43.180 Speaker 6 (Community Hall): Yes, thank you, Commissioner Rao, I agree, and that's why I, you know, we had left this… the definition of larger projects open within this, recommendation, because I agree, I think it's… 654 01:16:43.180 --> 01:16:55.010 Speaker 6 (Community Hall): it's actually a very complex topic as to what we are defining as large. So, I agree that is a… is a further discussion should Council choose to, go into this. 655 01:16:56.700 --> 01:16:58.850 Speaker 6 (Community Hall): Any other comments from the Commission? 656 01:17:01.340 --> 01:17:05.160 Speaker 10 (Community Hall): Well, so I will comment that I think that the, 657 01:17:05.420 --> 01:17:15.519 Speaker 10 (Community Hall): The paper is actually very good. It captures a lot of the things that… it captures a lot of things that everybody knew, and it captures a few things that not everybody would have thought of. 658 01:17:15.710 --> 01:17:17.690 Speaker 10 (Community Hall): Having not read it, 659 01:17:17.850 --> 01:17:20.740 Speaker 10 (Community Hall): It is… it's also valuable because it's very brief. 660 01:17:21.010 --> 01:17:38.330 Speaker 10 (Community Hall): I don't think it would be a challenge for anybody to kind of read this and kind of grasp, you know, I definitely see the things that are in the recommendation. If it had been accompanied by, you know, 50 pages of the legal explanation that would have made it less valuable. 661 01:17:38.600 --> 01:17:42.460 Speaker 10 (Community Hall): So, you know, in that respect, I kind of feel like… 662 01:17:42.960 --> 01:17:48.690 Speaker 10 (Community Hall): in a lot of respects, you know, I think there were good comments about things that had been omitted, or… 663 01:17:48.880 --> 01:17:54.720 Speaker 10 (Community Hall): you know, focused, and in a lot of respects, I kind of feel like, you know, the best way to do this would have been to 664 01:17:55.030 --> 01:18:01.339 Speaker 10 (Community Hall): You know, recommend a few revisions on that, and… and let that be the statement of what, what the… 665 01:18:01.930 --> 01:18:09.310 Speaker 10 (Community Hall): you know, of what the Commission… you know, the Commission's recommendation. But, of course, you know, we all have the right to, 666 01:18:09.540 --> 01:18:11.370 Speaker 10 (Community Hall): You know, modify how we might do that. 667 01:18:11.790 --> 01:18:27.599 Speaker 10 (Community Hall): I would also suggest, you know, we actually talked about what's the mechanism for how we'll do this, and, you know, I would actually suggest that the committee, do another revision, and that I think that we'll, I think we'll all approve that. 668 01:18:28.700 --> 01:18:30.450 Speaker 6 (Community Hall): Okay. Commissioner Rao? 669 01:18:32.880 --> 01:18:36.949 Santosh Rao, Commissioner: Yes, the last one that I had on this was, I think we should… 670 01:18:37.420 --> 01:18:40.880 Santosh Rao, Commissioner: recommend that Council hear the item. 671 01:18:41.320 --> 01:18:45.110 Santosh Rao, Commissioner: And that would involve a… 672 01:18:45.350 --> 01:18:51.239 Santosh Rao, Commissioner: a recommendation in person from either the Planning Commission or a subset that is appointed for it. 673 01:18:54.570 --> 01:18:56.150 Speaker 6 (Community Hall): Yes, I believe that. 674 01:18:56.410 --> 01:18:57.299 Santosh Rao, Commissioner: Let's here. 675 01:18:59.320 --> 01:19:02.629 Speaker 6 (Community Hall): Yes, I believe the process is that the… the… 676 01:19:03.580 --> 01:19:22.280 Speaker 6 (Community Hall): Planning Commission is designating a representative to then make a report to the Council. Now, I did think Commissioner Fung brought up an interesting suggestion, given that we are not on any particularly urgent timeframe. Is there interest from the rest of this Commission on 677 01:19:22.390 --> 01:19:27.520 Speaker 6 (Community Hall): You know, potentially the subcommittee Bringing back a revision, 678 01:19:27.970 --> 01:19:30.570 Speaker 6 (Community Hall): for this Planning Commission to approve. 679 01:19:30.880 --> 01:19:32.899 Speaker 6 (Community Hall): Before bringing it to Council. 680 01:19:34.160 --> 01:19:47.000 Santosh Rao, Commissioner: Yeah, through the chair, I would… through the chair, I would recommend we take this to Council as early as possible. If you look at the oversized vehicle parking, I think we started on it in April, we iterated it multiple times, and eventually Council did 681 01:19:47.370 --> 01:19:54.710 Santosh Rao, Commissioner: a totally different version of it, so I would just recommend this goes to Council, and let it, you know, go through the paces if it can. 682 01:19:54.820 --> 01:19:58.789 Santosh Rao, Commissioner: I would also suggest we do have a few large 683 01:19:59.460 --> 01:20:06.090 Santosh Rao, Commissioner: efforts going on, objective design standards, and the housing element cyclists, so I know it's, 684 01:20:06.210 --> 01:20:10.789 Santosh Rao, Commissioner: Unlikely to make it before that, but at least let's see if… 685 01:20:11.060 --> 01:20:13.549 Santosh Rao, Commissioner: Some low-hanging fruit might be adopted by Council. 686 01:20:15.610 --> 01:20:19.030 Speaker 6 (Community Hall): Okay. Vice Chair, did you have thoughts on timing? Nope. Okay. 687 01:20:19.770 --> 01:20:29.079 Speaker 10 (Community Hall): Yeah, if I could add to that, I mean, I actually agree. I mean, I think that… I think there's a pretty good consensus here. There isn't any reason to really, 688 01:20:29.590 --> 01:20:30.370 Speaker 10 (Community Hall): Will. 689 01:20:30.590 --> 01:20:34.360 Speaker 10 (Community Hall): I, I think that if you, in the process of, of, 690 01:20:34.770 --> 01:20:47.280 Speaker 10 (Community Hall): revising the report. If the committee feels like there's something that's worth coming back and discussing with people, then they should. But otherwise, you know, I think, you know, you got very strong support for the work that was done here. 691 01:20:47.910 --> 01:20:49.400 Speaker 6 (Community Hall): Thank you, Commissioner. 692 01:20:49.840 --> 01:20:59.380 Speaker 6 (Community Hall): City attorney, so we… Would we now commit… do another straw poll for, the designated representative? 693 01:20:59.620 --> 01:21:02.479 Speaker 6 (Community Hall): for this report back to Council? 694 01:21:02.860 --> 01:21:03.810 Speaker 6 (Community Hall): Or… 695 01:21:05.700 --> 01:21:09.470 Speaker 11 (Community Hall): Yeah, it's just your discretion. You can make a motion. As part of your motion. 696 01:21:10.840 --> 01:21:15.270 Speaker 11 (Community Hall): And as far as your motion, you can, you know, you can designate someone. 697 01:21:15.920 --> 01:21:24.670 Speaker 7 (Community Hall): Okay. I'll make a motion to designate Chair Casolcheron to be the representative to the Council. 698 01:21:25.020 --> 01:21:26.109 Speaker 7 (Community Hall): with this plan. 699 01:21:26.840 --> 01:21:27.740 Speaker 10 (Community Hall): I'll second that. 700 01:21:29.410 --> 01:21:32.530 Speaker 6 (Community Hall): Okay, thank you. City Clerk, may we please have a vote? 701 01:21:38.220 --> 01:21:39.380 Speaker 5 (Community Hall): Commissioner Feng? 702 01:21:40.075 --> 01:21:43.214 Speaker 10 (Community Hall): I… you never thought you'd hear that out of me, but yeah, it's fine. 703 01:21:45.050 --> 01:21:47.760 Speaker 5 (Community Hall): Commissioner Linskog is absent. Commissioner Rao? 704 01:21:48.600 --> 01:21:49.240 Santosh Rao, Commissioner: Oy. 705 01:21:50.450 --> 01:21:52.119 Speaker 5 (Community Hall): Vice Chair Scharf? Aye. 706 01:21:53.130 --> 01:21:55.090 Speaker 5 (Community Hall): Chair Kasulchron? Aye. 707 01:21:56.270 --> 01:21:59.270 Speaker 5 (Community Hall): The motion carries with Commissioner Linskogg absent. 708 01:22:00.570 --> 01:22:07.520 Speaker 6 (Community Hall): Great, thank you very much, and that concludes this item. We will move to future agenda setting. Is there anything from the Commission? 709 01:22:07.520 --> 01:22:16.099 Santosh Rao, Commissioner: Through the… through the chair, the item is staff and commissioner report, so we still have to hear from staff, and also hear from other commissioners. 710 01:22:18.100 --> 01:22:29.160 Speaker 6 (Community Hall): So I had actually already asked for the staff to provide their input at the very beginning of this item, but if staff has any more feedback, I'm happy to hear it. 711 01:22:29.690 --> 01:22:44.210 Speaker 11 (Community Hall): I think Commissioner Brown's a good point. Just generally, this particular agenda item is to allow staff to talk about other things, or commissioners to discuss what they may have done in the previous meeting to today, so… 712 01:22:44.400 --> 01:22:49.709 Speaker 11 (Community Hall): I think Commissioner Rao is suggesting that, we continue with that part of this agenda. 713 01:22:54.410 --> 01:22:57.139 Speaker 6 (Community Hall): Okay. Are there any staff reports? 714 01:22:58.990 --> 01:23:02.589 Speaker 8 (Community Hall): I don't believe staff has any updates at this point for the Commission. 715 01:23:03.850 --> 01:23:05.320 Speaker 6 (Community Hall): Okay, thank you very much. 716 01:23:05.820 --> 01:23:09.310 Speaker 6 (Community Hall): All right, moving to future agenda setting. Any items from the Commission? 717 01:23:09.510 --> 01:23:15.000 Santosh Rao, Commissioner: Through the chair, I did have questions for staff, and I think we still have to do commissioner reports. We haven't done that. 718 01:23:15.000 --> 01:23:18.869 Speaker 6 (Community Hall): I apologize, I did not see the hand raised. Commissioner Rao? Yes. 719 01:23:19.060 --> 01:23:22.860 Santosh Rao, Commissioner: Yeah, but going back to the question for staff. 720 01:23:23.410 --> 01:23:29.780 Santosh Rao, Commissioner: Can staff talk about whether the major projects page is What is the… 721 01:23:30.440 --> 01:23:38.030 Santosh Rao, Commissioner: timeline when the major projects page gets updated with the new project, because I believe There has been… 722 01:23:38.490 --> 01:23:45.230 Santosh Rao, Commissioner: Some movement on a 19 townhome development at Foothill and Stevens Creek at the northeast corner. 723 01:23:45.350 --> 01:23:52.010 Santosh Rao, Commissioner: And I don't recall seeing that on the major project page or on the staff report, so staff may comment on that. 724 01:23:54.640 --> 01:24:05.469 Speaker 11 (Community Hall): You know, if staff has a very quick response, you know, I'll let them do so, but Commissioner Rao, this section is reserved for staff to present any 725 01:24:05.470 --> 01:24:17.429 Speaker 11 (Community Hall): updates that they feel is appropriate to this commission. It's not the time for, sort of, general question and answer with staff. Feel free, of course, to reach out to them separately, and I'm sure they'll respond to you. 726 01:24:20.360 --> 01:24:27.089 Santosh Rao, Commissioner: Okay, but the staff wanna… not so much a question, but I guess, are there things that 727 01:24:28.740 --> 01:24:30.729 Santosh Rao, Commissioner: Do staff want to comment on that, or… 728 01:24:32.170 --> 01:24:46.840 Speaker 8 (Community Hall): The project… the major projects website is up to date. The project that you were talking about is an SB330 preliminary application. It is on the Major Residential Projects page, but it is not a formal application. 729 01:24:50.840 --> 01:24:53.959 Santosh Rao, Commissioner: I see, and so we do not update the… 730 01:24:54.390 --> 01:24:57.339 Santosh Rao, Commissioner: Web page when a preliminary application is received. 731 01:25:00.120 --> 01:25:03.060 Speaker 8 (Community Hall): Maybe we can take it offline, Chair, Commissioner Rowell. 732 01:25:06.220 --> 01:25:10.870 Speaker 8 (Community Hall): It is on the website, and I can show you where it is, but maybe we can take that offline. 733 01:25:11.420 --> 01:25:14.309 Santosh Rao, Commissioner: I think I know what I'm missing. Thank you. 734 01:25:15.290 --> 01:25:20.210 Santosh Rao, Commissioner: I believe there are two sections on that website, and I guess we gotta look at one end and then the other. 735 01:25:22.400 --> 01:25:27.700 Santosh Rao, Commissioner: Commissioner reports, I guess, since I have the mic, I can just comment on, 736 01:25:28.120 --> 01:25:36.050 Santosh Rao, Commissioner: It would be, probably appropriate to point out that we have not heard on ODS in a while, so… 737 01:25:36.210 --> 01:25:38.080 Santosh Rao, Commissioner: Would be good to hear on ODS. 738 01:25:38.540 --> 01:25:43.529 Santosh Rao, Commissioner: It's been a while since we last had the ODS session, and I don't know where we left off on that. 739 01:25:48.770 --> 01:25:52.360 Speaker 6 (Community Hall): Is there any staff response on the objective design standards? 740 01:25:55.120 --> 01:26:00.860 Speaker 8 (Community Hall): There isn't a specific response on that. We've just been very stretched thin on housing projects. 741 01:26:02.900 --> 01:26:06.070 Speaker 6 (Community Hall): Great. Any other Commission or staff reports? 742 01:26:08.610 --> 01:26:12.449 Speaker 6 (Community Hall): Okay, Commissioner Rao, you still have your hand raised, I'm not sure if that is, 743 01:26:12.860 --> 01:26:24.940 Speaker 6 (Community Hall): You know, okay, thank you. All right, now we move to future agenda setting. I did have one question, this is sort of a follow-up from the last City Council meeting, but there was mention of 744 01:26:25.010 --> 01:26:33.519 Speaker 6 (Community Hall): In this… particular section of the agenda, having a look forward at future weeks. 745 01:26:33.520 --> 01:26:50.449 Speaker 6 (Community Hall): Planning Commission meetings and, you know, sort of just a high level… I understand, you know, the schedule can be fluid, but a high-level look at upcoming agenda items for, like, rolling… I don't remember the time frame, like, 2 months or maybe 2 to 3 meetings. 746 01:26:52.050 --> 01:27:10.660 Speaker 8 (Community Hall): Right now, we are dealing with over 15 housing development projects, and the timeline is extraordinarily fluid. I believe that the city manager has been putting out, fairly recently, a look ahead on the… on the timeline for those. There are no… there is no fluid… there is no 747 01:27:11.020 --> 01:27:22.040 Speaker 8 (Community Hall): specificity in terms of months until we have visibility on it. At this point, it is very hard to pinpoint because of how review occurs on those projects. 748 01:27:23.050 --> 01:27:25.079 Speaker 6 (Community Hall): Got it. Is there a chance that that… 749 01:27:25.300 --> 01:27:32.289 Speaker 6 (Community Hall): timeline from the city manager can maybe be appended to this agenda setting section, just so that we have visibility as a commission? 750 01:27:32.930 --> 01:27:50.709 Speaker 11 (Community Hall): So, Chair, I just want to clarify, that section is for the purpose of, either you on yourself, in your capacity as chair, or for two commissioners to add an item, for a future agenda, not for, identifying what will be on future agendas. 751 01:27:50.860 --> 01:27:51.680 Speaker 11 (Community Hall): Okay. 752 01:27:52.270 --> 01:27:56.700 Speaker 6 (Community Hall): All right, thank you. Any other, agenda setting from the rest of the Commission? 753 01:27:58.390 --> 01:28:01.030 Santosh Rao, Commissioner: Yes, I would like to… Yes, ma'am. 754 01:28:01.410 --> 01:28:02.209 Santosh Rao, Commissioner: Through the chair. 755 01:28:02.240 --> 01:28:03.469 Speaker 6 (Community Hall): Yes, Commissioner Rao. 756 01:28:04.570 --> 01:28:16.049 Santosh Rao, Commissioner: I would like to propose agendizing a formation of a subcommittee on objective Fire evacuation standards and recommendations. 757 01:28:16.980 --> 01:28:18.320 Santosh Rao, Commissioner: Do I have a second? 758 01:28:19.370 --> 01:28:34.619 Speaker 6 (Community Hall): If I may briefly interject, I know I had brought this up with staff. Would staff be willing to share their opinion on the evacuation study and whether it is something that this commission can discuss again? 759 01:28:37.550 --> 01:28:38.660 Speaker 11 (Community Hall): Okay, no mute. 760 01:28:38.820 --> 01:28:47.640 Speaker 11 (Community Hall): Before staff responds, I'm just going to caution we shouldn't have too extensive discussions, because it's not agendized. I see.
