A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF CUPERTINO
ORDERING VACATION OF A PORTION OF ADRIANA AVENUE FROM
STEVENS CREEK BOULEVARD TO A POINT APPROXIMATELY 200' NORTH;
AND A PORTION OF STEVENS CREEK BOULEVARD BETWEEN ORANGE
AVENUE AND ADRIANA AVENUE; RETAINING THE ADRIANA PORTION
AND THE STEVENS CREEK PORTION AS PUBLIC SERVICE
EASEMENTS AND A PORTION OF ADRIANA AS A SANITARY
SEWER EASEMENT~ AS PROVIDED IN SECTION 8320 ET SEQ. OF
THE STREETS AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA
WHEREAS~ hearing on Resolution of Intention No. 6510 was held on
February 19, 1985 at a regular meeting of the City Council at 10300 Torre
Avenue~ Cupertino, California; and
WHEREAS, it appears that notice thereoP was duly given as required by
law; and
WHEREAS, from the evidence presented, both oral and documentary, it
appears to be to the best interest of the City to vacate the hereinafter
described portions of City streets; and that said portions of said City
streets are unnecessary for present or prospective public street purposes,
but are necessary to be retained for easements as follows:
1. The entire area to be abandoned as a publie service easement.
2. A portion of Adriana Avenue as a sanitary sewer easement.
3. Exempting and reserving therefrom pursuant to the provisions of
Seetion 8340 of the Street and Highways Code and for the benefit
of Pacifie Bell, the permanent easement and the right at any time
or from time to time to construct~ maintain~ operate, replace,
remove, renew and enlarge lines of pipe, conduits, cable, wires,
poles and other convenient struetures, equipment and fixtures for
the operation of telegraphie and telephone lines and other
communication facilities, ineluding access and the right to keep
the property free from inflammable materials and wood growth, and
otherwise protect the same from all hazards, in, upon, over and
across that portion of Adriana Avenue and Stevens Creek Boulevard
highway or part thereof.
WHEREAS~ existing streets are adequate to handle present and future
projected traffie; and
WHEREAS~ vacation is in conformanee with the City's General Plan;
NOW~ THEREFORE~ BE IT RESOLVED:
1. That all or any protests against the vaeation of said portions of
City streets be and hereby are overruled and denied;
2. That said portions of Stevens Creek Boulevard and Adriana Avenue
described and shown in Exhibits "A° and "B" attached hereto and made part
hereof, be and hereby are vacated, but are reta3ned as easements as
hereinabove mentioned.
BE IT FURTHER RESOLVED:
That the City Clerk be and hereby is instructed and direeted to cause
a certified copy of this resolution, attested to and sealed with the
official seal oP the City~ to be recorded with the County Recorder of the
county of Santa Clara, California, forthwith.
