Application 1 -Z-76 of CITY OF CUPERTINO: REZONING 20+ acres from R3-2.2 (Residential, multiple, 2,200 sq. ft. per dwelling unit) Zone to P (Planned Development with residential land use intended with a density of 0 - 4 units per acre) or whatever zone may deemed appropriate by the Planning Commission. Said property is located adjacent to and westerly of Foothill Blvd. opposite the intersection of Alpine Drive and Foothill Blvd. First Hearing continued. Attorney D. A. Barnett, 1625 The Alameda, San Jose, stated he was representing the property owner (Taubman), who recently suffered a heart attack. He expects to be back in the office shortly, and requested a continuance of this public hearing. Chairman Gatto asked if there were comments from the audience in regard to application 1-Z-76. There were none. Moved by Comm. Adams, seconded by Comm. Woodward to continue application 1-Z-76 to March 22, 1976. Motion carried, 5-0 2. Application 16 -TM -75 of SAN CARLOS HOMES & DEVELOPMENT. TAKEN OFF CALENDAR 3. Application 12-U-75 of PHOTOTECHNOLOGY: USE PERMIT to allow a photo kiosk in a CG (General Commercial) Zone. Said property] is located at the southwest corner of the intersection of Stevens Creek Blvd. and E. Estates Drive. First Hearing continued. It was noted that the applicant was not present at this meeting. The staff stated he had been advised by mail and phone call of this! hearing. The Assistant City Attorney advised it would be more appropriate for the Planning Commission to act upon this proposal rather than take it off calendar. The Assistant Planning Director reviewed the proposal again. He stated the staff recommended denial because historically, the City discourages freestanding structures in parking lots on main thoroughfares. There could be a disruption of traffic flow, due to cars waiting in line to be served. Air quality is another determining factor. There are no other such uses within the City of Upertlno. 1-Z-76 cont'd to March 22nd PC -218 MINUTES OF FEBRUARY 23, 1976, PLANNING COMMISSION MEETING Page 4 Chairman Gatto asked for comments from the audience. There were none. Moved by Comm. Adams, seconded by Comm. Cooper to close the Public Rearing. Motion carried, 5-0 12-U-75 ;Moved by Comm. Cooper, seconded by Comm. Woodward to deny application denied 12-U-75, on the basis that it is not consistent with City policy. AYES: Comm. Adams, Cooper, O'Keefe, Woodward, Chairman Gatto NOES: None Motion carried, 5-0 4. Application 2-U-76 of Vallco Park, LTD.; USE PERMIT to allow construction of one building containing 10,700 sq. ft., one building containing 13,217 sq. ft., the construction of six tennis courts and the relocating of a 2,200 sq. ft. building presently located at the southeast corner of Pruneridge Avenue and Wolfe Road. Said property is generally located adjacent to and westerly of Wolfe Road immediately southerly of the Vallco Village Shopping Center. First Hearing continued. ;The Assistant Planning Director reviewed the February 6 and 20, 1976 staff memos and documents, and the memo handed out at this meeting. The staff has had discussions with the applicant in regard to resolving the traffic circulation pattern from Pruneridge, through ;this property and into the Vallco Village Shopping Center. He !then reviewed the original and the alternate exhibits on the bulletin `board. A third alternate was also explored. The Assistant Planning Director stated that the staff would like a major roadway into the project, and it may be necessary for the applicant to go back to the drawing board with this proposal. lir. Walter Ward, Vallco Park General Manager, stated it might be a problem for the bank visitors to park by the handball courts and cross this major roadway to the bank. He suggested more discussions with the staff might be in order before a decision is made. Architect Dick Griffiths, representing Cabac Associates, said this is the first time he has seen this current proposal. He would like to provide as much parking by the bank as possible. There are other tenants in the bank building as well as the banking facility. He answered Comm. Cooper that they anticipate 17 employees and 10-12 customers at one time. MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING PC -218 ' Page 5 Mr. Griffiths answered Chairman Gatto that the parking could be changed from 60° to 90° angle in order to pick up some extra parking spaces. However, more aisle width will be necessary if it is changed. Another problem with 90° parking is there would be the tendency for the cars to back out and go either direction, whereas with 60° angle they would be inclined to go only one way. Chairman Gatto offered the following suggestions: Provide a simple, direct means of access from Pruneridge to a common melting point in Vallco Village. An aisle, free of cars, for the main travel aisle is an improvement. He recognized the desire to get more cars near the bank building. Comm. Adams observed that the present southeast corner of Vallco Village Shopping Center is usually filled now. And the triangular section is always filled. Mr. Ward said they will probably want to have a crosswalk from the parking areas to the bank building. It was the consensus of the Planning Commission to leave the detail of the traffic circulation pattern to the staff. Mr. Ward answered Comm. Woodward that they will probably put humps in the parking lot to help reduce speeds. There will also probably be a need for stop signs as the cars leave the bank. Comm. Adams said at the time of the last public hearing on this the question of driveup windows was explored. Only three members were present at that meeting. He wondered whether it was appro- priate to discuss this with a full Commission. Mr. Walter Ward said City Council Resolution No. 4097, in regard to driveup windows, would have no significant impact on this proposal. Environmental problems were addressed at the time of the hearing on Resolution No. 4097. Mr. Ward said this application was first filed in December, 1973. Three banks with driveup windows have come in since then and have been approved.. We should strive for uniformity. It might not be equitable for Cupertino to ban the driveup windows if our neighbors do not. Dr. Myronek has stated that the environmental problems are regional. :Be recommended deletion of Conditions 16 and 18. Comm. Cooper suggested the landscaping along the bank be low enough to prevent the canyon effect and allow better visibility. She would like her feelings on this conveyed to the Architectural and Site Approval Committee. PC -218 MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING Page 6 (Comm. Cooper said she has listened to the tape and read Dr. Myronek's ,report. She believes restriction of driveup windows is a step in the !right direction. However, she believes driveup windows in this !location are appropriate because this is an open area. She would be in favor of an ordinance discouraging driveup facilities in the future. Comm. -Woodward stated he also has listened to the tapes. He agreed with Chairman Gatto that the driveup facility is part and parcel of this proposal. He suggested the bank put up a sign for people to please shut off their engines while waiting in'Iine. This was not addressed in Dr. Myronek`s report, Comm. Adams said he could appreciate this application was first filed in 1963. He would be willing to bend on Condition 16 if it is changed Ito request the bank install signs requesting engines be turned off while_ waiting in line He asked if there ,i7. facilities ---p - - ca.c are any walkup 1-1;11-ltles on this face of the building. 4Mr.yWardsaid they are only on the south !side. Mr. Bob Holding, Properties Department of First National Bank of San Jose, said walkup windows on the west side would not be good. Emissions from the automobiles would be on that side. It would interfere with the operations inside the bank. This is a standard system, with four lanes operated by two tellers. They have nine of these operations and they are all very efficient. Chairman Gatto stated Dr. Myronekts report addressed: an isolated case. This proposal is a very minor, localized condition. The air quality problem is regional. consensus vote to strike Condition 16 passed, 3-2, with .. Adams and O`Keefe dissenting. consensus vote to strike Condition 18 failed, with only Woodward voting in favor of it. The consensus vote to retain Condition 18 passed, 3-2, with Chairman Gatto and Comm. Woodward dissenting. I ,The Assistant Planning Director stated Dr. Myronek was not asked to ;explore the condition of cars starting and stopping. Moved by Comm. Adams, seconded by Comm. Woodward to close the public hearing. ! Motion carried, 5-0 The Assistant Planning Director modified the wording of Condition 15. MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING Moved by Comm, Cooper, seconded by Comm. Woodward to approve application 2-U-76 with the 14 standard conditions, condition 15 as modified, condition 16 deleted, conditions 17, 18 and 19 as in the staff report, and condition 20 which directs the Architec- tural and Site Approval Committee to place landscaping in the area by the driveup lane and road to the shopping center to be of the type to not restrict air flow nor visibility of bank traffic. AYES: Comm. Adams, Cooper, Woodward, Chairman Gatto NOES: Comm. O'Keefe Motion carried, 4-1 Chairman Gatto called a recess at 9:00 PM. The meeting reconvened at 9;15 PM. 5. Application 3-Z-76 of GOOD SAMARITAN UNITED METHODIST CHURCH: REZONING 1.6 acres from Al -43 (Agricultural -Residential, single-family, 1 -acre lots) Zone to BQ (Quasi -Public Building) Zone, or whatever zone may be deemed appropriate by the Planning Commission. Said property is located at the south- east corner of the intersection of Homestead Road and Linnet Way. First Hearing. The Planning Director reviewed the proposal, details of which can be found in the February 20, 1976 staff memo. He noted this Church was built prior to annexation to the City. The expansion proposal is in three phases. Phase I includes the Sanctuary with a seating capacity of 130 and classroom facilities. In 1966, the Vallco Village use permit included purchase of a triangle piece of property with the understanding the Church could utilize a number of the shopping center's parking spaces. Phase II includes addition of office facilities and fireside room. Phase III is the ultimate development of the property, including a multipurpose room. Based upon the present use of the shopping center, there are 150 parking spaces available within 300' of the Church propert The Planning Director stated the other issue is more aesthetic. There is a 25' setback of the structures, but there is a wall some 8' in from the property line. Notices have been mailed to all property owners within 300' of this property. Architect Warren Gilbert stated he read the portion of the Agreement pertaining to the excess of 20 parking stalls. With this Agreement. we have a Church property hhat has a 200 —car parking lot already built within 300'. He said the Church entered into this Agreement in good faith. With this understanding, Phase III was designed taking full advantage of the parking in the shopping center. The big impact is on Sunday when the shopping center needstheleastnumber of parking spaces. PC -218 Page 7 2-U-76 approved PC -218 MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING Page 8 Comm. Cooper asked the capacity of the multipurpose room. Mr. Gilbert said it could seat 400 for dining purposes. The Church feels they act as a family. It would be a rare occasion when they would have more than one function at one time in more than one of the buildings. The multipurpose room is designed for youth activities such as volleyball, basketball, dancing, etc. Chairman Gatto was answered that weddings usually occur on Saturdays and no more than once a month except in June. The usual number of people at weddings is 25. Mr. Gilbert said they are willing to restudy the architecture to some ,degree. Present plans show stucco exterior, flat tile terra cotta roof and concrete overhang. Heavy timber may be introduced here. He said they are willing to reduce the height of the buildings. They are back some 80from Homestead Road and some 60from Linnet Lane. They are not surrounded by residential. Across the street is a Irestaurant of railroad cars and a service station, (Comm. Adams was answered the spire will be steel. ?Mr. Gilbert answered Chairman Gatto that, God willing, Phase I will be completed with 18 months to two years; Phase II in four or five years; :and another five years for Phase III; with a total time frame of 'eight to ten years. Chairman Gatto asked for comments from the audience. There were none. 4The Planning Director preferred that the public hearing not be closed !at this point. The staff wanted to sit down and discuss some of the details with the applicant and Vallco Park. 'Mr. Walter Ward explained the rationale for the joint parking agreement. 4He said Vallco Village is still in agreement with the original Agreement. .Comm. Adams was answered that this Agreement should probably be a part of the zoning. Comm. Cooper believes the present proposal for the Sanctuary is a bit ioverpowering. She would like to see the design more compatible with ;the Vallco Village architecture. She would prefer to pass on all three .phases at one time rather than in increments. Comm. Woodward said churches are always designed to stand out rather than blend in with the surrounding structures. If done in a nice manner, :it could be very pleasing. He said he would opt to passing on all three phases at once. MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING PC -218 Page 9 Comm. O`Keefe said phasing is important. This is the culmination of an excellent agreement made many years ago in terms of sharing of parking and, thus, minimizing the "sea of asphalt". Chairman Gatto said it is important to have an ultimate plan, for both the City and for the Church. He suggested the Architectural and Site Approval Committee consider whatever planting can take place during the first phase. Moved by Comm. Adams, seconded by Comm. O'Keefe to continue (3-Z-76 application 3-Z-76 to March 8, 1976. !cont'd to March 8th Motion carried, 5-0 Comm. O'Keefe left the meeting at 10:15 p.m. 6. Application 2 TM -76 of MAY INVESTMENT COMPANY: TENTATIVE MAP to subdivide.1.1 acres into four single-family residential lots; Said property is located adjacent to and southerly of McClellan; Road and approximately 350 feet westerly of Linda Vista Drive. First Hearing. The Assistant Planning Director introduced the proposal by first identifying the property on the aerial photograph, adjacent to McClellan Road, across from the Horse Ranch Park. He said the staff is concerned about the condition requiring landscaping of the bank along McClellan for erosion prevention and to soften the effect of the bank. The new proposal is to subdivide the property into four lots instead of the original plan for five lots. Direct 30' flag corridors to lots 2 and 3 are suggested conditions of approval. Future fence lines will be constructed at the top of the bank rather than at the toe of the bank, per another recommende condition. Chairman Gatto asked for comments from the audience. Mr, Jason Chartier, General Partner of May Investment Corporation, said the only question to be resolved here is maintenance of the bank. It can be watered from the top with rainbirds. He wondered how the property owner would be motivated to turn on the rainbirds when his fence is at the top rather than the bottom of the bank. Comm. Cooper was told the sidewalk will hook up with Linda Vista. d PC -218 MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING Page 10 The Assistant City Engineer said it has been determined the City must have control of the downhill slope easement. Erosion control was placed on the property owner on the Williamson property. The details can be worked out.. The Assistant City Attorney stated the City has a weed abatement ordi- nance that can be enforced if such a problem occurs. Mr. Acle Hicks said he is across the street. He as', was told that it will be. a problem with alignment, out to bid within a month bridge will be widened. a homeowner in the townhouse development ced if the sidewalk will be completed. He The Assistant City Engineer said there was but it is being resolved now and should go or so, all the way down to the bridge. The Moved by Comm. Adams, seconded by Comm. Woodward to close the public hearing. Motion carried, 4-0 The Assistant Planning Director called attention to the fact that there will be no vehicular access to McClellan Road. The Assistant City Engineer felt the decision on this application would be important to decisions in our hillsides in regard to maintenance of the cut slopes. We should find some way to enforce the ordinance. 2-TM:76 Moved by Comm. Woodward, seconded by Comm. Adams, to approve application approved 2:T -M-76 with the 14 standard conditions, conditions 15 and 16, modified condition 17, 18, and 19, with no vehicular access to McClellan Road. AYES: Comm. First Hearing. The Planning Director reviewed the proposal per the February 20, 1976, staff report. The issue of traffic is still to be resolved. There was a negative declaration as to the EIR at this stage. MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING ':PC -218 Page 11 Comm. Cooper was concerned that the traffic constraints on the property might encourage fast food type businesses. Chairman Gatto repeated the rationale for this proposal. Since there were no comments from the audience, it was moved by Comm. Cooper, seconded by Comm. Adams to close the public hearing. Motion carried, 4-0 Moved by Comm. Woodward, seconded by Comm. (BURGER KING): USE PERMIT to allow construction of a fast foods restaurant to be located adjacent to and northerly of Stevens Creek Blvd.,; approximately 79 feet westerly of the intersection of Stevens Creek Blvd. and De Anza Blvd. First Hearing. The Assistant Planning Director reviewed the proposal, details of which can be found in the February 20, 1976 staff memo. In 1972 a 10 —lot, 5 —acre subdivision may for all but a few small lots bordered by Stevens Creek Blvd., Bandley Drive, Alves Drive, and De Anza Blvd. was filed. There are no traffic constraints on these properties. The City is quite sensitive about fast food restaurants that sell food to be taken out of the building. The staff felt this use in this location would not be acceptable unless it is designed in some manner to be integrated with its neighbors. There is a requirement that the improvements be completed along Bandley Drive and Stevens Creek Blvd. and the financial details are to be worked out with Bank of America-.- and Home Savings and Loan. Mr. Roger Griffin, 19660 Junipero Way, with Dick Finegan's Office, the architect for this project, said there will be seating space for 100 and outdoor dining for 20 people. He then reviewed the plot plan and elevations. There will be no drive -up windows. Comm. Adams was concerned there may be too many restaurants in such close proximity. He would like to see some pedestrian right-of-way to the north and to the west. 4 -218 MINUTES OF FEBRUARY 23, 1976 PLANNING COMMISSION MEETING age 12 !The medians will be reviewed by the Architectural and Site Approval 'Committee. -U-76 Moved by Comm.
