Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Coinmission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND The applicant, David Belleville, of Homestead Mine Court LLC, is requesting the approval of exterior enhancements to a previously approved four-lot planned residential development and a minor first floor addition of approximately 111 square feet to the home on Lot 3 at 10630- 10633 Mine Court. On April 24, 2007, the Planning Commission approved a Use Permit (U-2007-01), Architectural and Site Approval (ASA-2007-01), and Tentative Map (TM-2007-01) for a four lot subdivision of four new single family homes at the former 10630 Linnet Lane. The previous property owner/developer made significant exterior changes and additions to the homes without City approval. The new owner (the applicant) has agreed to mitigate the illegal construction with minor enhancements to the approved colors and materials. The new owner is also requesting a Director's Minor Modification for a minor first floor enclosure of approximately 111 square feet to the home on Lot 3. DISCUSSION P��oposed E��closi.«�e The applicant is proposing a 111 square foot addition the buest sitting room in Lot 3. The Director is supportive of this minor addition due to the fact that it �vill not visually increase the mass of the home and the addition will not be �Tisible to public ��iews (see Sheet A 0.1). In addition, the project is consistent the general architectural integrity associated with the original approval. ACTION The Director approves the modifications as listed above with the following condition: 1. APPROVED EXHIBITS - Approval is based on Exhibits titled: "Mine Court, Cupertino, CA 95014" and consisting of eighteen sheets labeled A0.1, A1.0-A1.3, A2.0-A2.3, A3.0- A3.3, A4.0-A4.3 and A5.0 except as may be amended by the conditions contained in this resolution. 2. The applicant shall demolish the illegal patio/porch enclosures on Lot 2(approx. 150 sq. ft) and Lot 3(approx. 325 sq. ft) prior to final occupancy. This approval of the modification is effective March 12, 2010. The fourteen-calendar day appeal period will expire on March 26, 2010.
