Subject: Director's Minor Modification, DIR- 2010 -01 to allow a personal wireless service
facility on the rooftop of an existing hotel and consisting of three panel
antennas, six microwave dishes, and an equipment cabinet at 10050 South De
Anza Boulevard.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
BACKGROUND
The applicant, Patrick Mahoney, of FMHC Corporation, representing Clearwire, is proposing
to install a personal wireless service facility on the rooftop of the Cypress Hotel at 10050 South
De Anza Boulevard. The personal wireless service facility consists of three panel antennas, six
microwave dishes, and an equipment cabinet on an existing Sprint PCS platform.
Two of the three panel antennas are proposed to be flush - mounted on and painted to match the
existing pillars on the hotel's penthouse on the north (Stevens Creek Blvd - facing) and west (S.
De Anza Blvd - facing) elevation. The other antenna is proposed to be mounted behind a new
radio frequency - transparent screen wall, painted and textured to match the existing building on
the eighth story wall on the south (alley- facing) elevation. The new screen wall will also stealth
an existing Sprint antenna, previously approved under Director's Minor Modification file #
DIR- 2002 -32. The other two existing Sprint antennas are already shielded by a screen wall.
All six microwave dishes are proposed to be side - mounted on the hotel's penthouse and
painted and textured to match the existing building. Two dishes are proposed on the west (S.
De Anza Blvd- facing) elevation; two are proposed on the north (Stevens Creek Blvd- facing)
elevation; and two are proposed on the east (City Center interior- facing) elevation.
One equipment cabinet will be mounted to an existing Sprint steel platform in the middle of the
upper roof of the hotel, next to three existing Sprint equipment cabinets.

The proposed wireless facility complies with the City's Wireless Communications Facilities
Ordinance (CMC chapter 19.108). The antennas are proposed to be vertically mounted to the
building, which exempts them from the 55 foot height restriction. Additionally, they will be
mounted at the same height as the existing Sprint antennas (95'6" on the north, south, and east
elevation; and 8410" on the south elevation). The proposed wireless facility is located at least
75 feet from the nearest residentially zoned property, which is approximately 90 feet from the
Montebello Cupertino condominiums.
The proposed wireless facility is also consistent with the relevant policies contained in the City's
Wireless Facilities Master Plan. The plan prefers that wireless facilities be located on existing
non - residential buildings, one of which was identified as the Cypress Hotel on the candidate
locations map. All antennas and dishes will be camouflaged to the best extent possible by being
flush - mounted and /or painted and textured to match the existing building. Additionally, the
south elevation antenna will be covered by a screen wall which is architecturally compatible
with the building as depicted in the photo simulations. The proposed equipment cabinet will be

located next to three existing equipment cabinets on the middle of the rooftop and will not be
visible from the public right of way.

The applicant commissioned a radio frequency energy assessment prepared by TRK
Engineering to estimate the levels of radio frequency energy generated by the proposed
Clearwire and existing Sprint facilities and evaluate those energy levels against adopted federal
safety limits for human exposure to radio frequency energy (Attachment 1). The federal limits
apply to continuous exposures and are intended to provide a prudent margin of safety for all
persons, regardless of age, gender, size or health.
The applicant's consultant calculated maximum radio frequency (RF) exposures for both the
proposed Clearwire and existing Sprint facilities at three different locations: standing near the
facility at street level; the nearby building rooftops; and hotel rooms below hotel's lower roof.
All locations were calculated to have RF exposures well below the Federal Communication
Commission's maximum permissible exposure (MPE) limit. Specifically, the calculated, street -
level, maximum RF exposure is 0.08% of the MPE; the nearby rooftop maximum RF exposure is
.17% of the MPE; and the maximum RF exposure to persons staying in rooms below the facility
is .06% of the MPE.

Project plans were routed to the Cupertino Technology, Information and Communications
Commission (TICC) for their commentary. TIC Commissioners (Attachment 2) felt that the
proposed facility will provide adequate coverage to nearby residents and did not have any
concerns about the positioning, design, and height of the wireless facilities.
The Director of Community Development deems the modification minor and approves the
wireless facility with the following conditions of approval. State law requires a minimum 10-
year permit for personal wireless service facilities.

1. APPROVED EXHIBITS
Approval is based on Exhibits titled: "Cypress Hotel CA- SJCO29A,10050 S. De Anza Blvd.,
Cupertino, CA 95014, Santa Clara County" prepared by Delta Groups Engineering, Inc.
dated 12/15/09 and consisting of five sheets labeled T1, Al, A2, A3, and A4 except as may
be amended by the conditions contained in this resolution.
2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees, dedication
requirements, reservation requirements, and other exactions. Pursuant to Government
Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the
amount of such fees, and a description of the dedications, reservations, and other exactions.
You are hereby further notified that the 90 -day approval period in which you may protest
these fees, dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90 -day period complying
with all of the requirements of Section 66020, you will be legally barred from later
challenging such exactions.
3. ABANDONMENT
If after installation, the aerial is not used for its permitted purpose for a continuous period
of 18 months, said antennae and associated facilities shall be removed. The applicant shall
bear the entire cost of demolition and removal.
4. EXPIRATION DATE
This Director's Minor Modification shall expire ten (10) years after the effective date of the
permit. The applicant may apply for a renewal of the minor modification at which time the
Director of Community Development may review the state of wireless communication and
camouflage technologies to determine if the visual impact of the personal wireless facility
can be reduced.
This Director's approval is effective March 3, 2010. The fourteen calendar day appeal period
will expire on March 17, 2010.

Clearwire is proposing to construct a wireless broadband facility on the Cypress Hotel rooftop at the
above address (Figure 1). Three panel antennas with a horizontal beam width of 87° will be installed
on the rooftop penthouse and parapet. A site support cabinet (SSC) will be mounted on the existing
SprintPCS steel platform on the rooftop. Access to the facility is restricted to authorized personnel.

Clearwire also proposes to install dish antennas or Internet Services Exchange Points (ISEP) on the
penthouse. The RF power outside the main beam of these ISEP antennas is insignificant compared to
the panel antennas (see calculations in Appendix A).
Sprint has an existing wireless communication facility with panel antennas installed on the rooftop.
The RF summary for the facility is shown in the following Table.

PROTOCOL:
This study, and the calculations performed therein, is based on OET Bulletin 65 which adopts ANSI
C95.1 -1992 and NCRP standards. In particular, equation 10 from section 2 of the guideline is used as
a model (in conjunction with known antenna radiation patterns) for calculating the power density at
different points of interest. This information will be used to judge the RF exposure level incident upon
the general population, and any employee present in the area. It should be noted that ground reflection
of RF waves has been taken into account.
FCC'S MAXIMUM PERMISSIBLE EXPOSURE (MPE) LIMIT:
In order to evaluate the RF exposure level, the power densities at different locations of interest have
been examined. Equation 10 from Bulletin 65 is reproduced here as equation 1:

Scenario 1: Standing near the facility on street level
The RF exposure level of a six -foot tall person standing on street level near the proposed facility is
evaluated. For the worst -case scenario, we assume that all the antennas are transmitting the maximum
number of channels at the same time, with each channel at its maximum power level. In addition, the
azimuths of the antennas of both carriers are assumed to be in the direction of the studied location.
Please refer to scenario 1 in appendix A for the complete geometry and analysis. The highest
exposure location is found to be approximately 137' from a proposed Clearwire antenna. The
calculations of maximum cumulative power density are summarized in Table 3.

The Maximum Permissible Exposure (MPE) limit for 1900 MHz and 2500 MHz facilities for general
population/uncontrolled exposure is 1000 µW /cm The maximum cumulative power density for the
proposed Clearwire antennas and the existing antennas is calculated to be 0.08% of the MPE limit.
Scenario 2: Nearby building rooftops
There are multi -story buildings in the surrounding area. The RF exposure levels on nearby rooftops
are evaluated. We assume again, all antennas within a sector are transmitting with maximum power
level and the antennas azimuths are in the direction of the studied location. Please refer to scenario 2
in appendix A for the analysis. The highest exposure location is on the rooftop of a building north of
the subject building. The calculations for the maximum possible power density are shown in Table 4.

Scenario 3: Facility Lower Roof
The radiation center of Clearwire's antennas is approximately 73' from the lower roof deck. The RF
exposure level of different locations on the rooftop is evaluated. Please refer to scenario 3 in appendix
A for the analysis. The highest exposure location on the facility rooftop is approximately 118' in front
of Clearwire's sector 3 antenna. The calculations for the maximum possible power density are shown
in Table 5.

The maximum cumulative power density for the Clearwire antennas is calculated to be 0.06% of the
MPE limit. There is a relatively low level of RF energy directed either above or below the horizontal
plane of the antennas, and there are no locations in the surrounding areas near the facility that will
have RF exposure levels close to the MPE limit.
Conclusion:
Under "worst- case" conditions, the calculations shown above predict that the maximum possible RF
exposure is 0.17% of the MPE limit for general population/uncontrolled exposure. There will be less
RF exposure on the ground level or nearby buildings as a person moves away from the site.
Therefore, the proposed Clearwire facility in co- location with the existing facility will comply with the
general population/uncontrolled limit.
FCC COMPLIANCE:
The general population/uncontrolled exposure near the antennas, including persons on the street level,
in nearby open areas, and inside or on existing nearby buildings will have RF exposure much lower
than the "worst- case" scenario, which is only a small percentage of the MPE limit.
As for trained persons or transient workers, they will be made fully_ aware of the potential for RF
exposure and can choose to exercise control over their exposure that is within the
occupational /controlled limits.

George,
My thoughts on the proposed Clearwire installation at the Cypress Hotel are as follows:
1. While the WiMax technology is still relatively new and it is a bit difficult to predict
the exact coverage radius, it appears that the vendor has done an excellent job of antenna
selection and positioning to cover a wide range of the surrounding city. In particular, I
believe that coverage will extend to neighboring residential areas and is not mainly focused,
as are many cellular installations, on major street coverage.
2. The flat panel antennas are by their nature relatively unobtrusive and their positioning
on the upper hotel walls seems to make them almost unnoticeable to the casual observer.
3. I see no other issues relative no height or power output. The vendors RFE analysis
appears to be sound and conservative.

1. Proposed Microware Antennas ad Panel Antennas would have insignificant visual impact, hence the design
and positioning both are acceptable.
Technical
1. Location / Positioning of these antennas would provide adequate coverage for residents as well as point to
point communication with other antennas.
2. Antennas would be installed on the existing SprintPCS platform so there are no height concerns
