Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. DISCUSSION The applicant proposed to convert a portion of existing attic space into a 271 square foot loft. Because the loft has a maximum ceiling height of 6-feet,10.5-inches, the space is not considered a habitable bedroom space per the Zoning Ordinance (19.08). The Building Department has reviewed the project and determined that the area is not classified as a bedroom. Consequently the project is not subjected to any bedroom egress requirements relating to window height and size. A condition has been included as part of this approval requiring the owner to record a covenant restricting the use of the area to an attic den space only. Staff supports the proposed modifications because they are contained within the footprint of the existing residence and include minimal exterior alternations (see Attachment 1). The Northpoint Homeowners Association also approved the proposed modifications on December 15, 2009 (see Attachment 2). ACTION The Director of Community Development deems the modification minor and approves the addition with the following conditions of approval: 1. LOFT COVERSION COVENANT The owner shall record a covenant that states that the loft shall not be used as a bedroom, and that no plumbing facilities shall be added to the loft area. The DIR-2010-06 10833 Northfield Square Page 2 precise language will be subject to approval by the Director of Community Development. Proof of recordation must be submitted to the Community Development Department prior to final occupancy of the residence. This approval of the modification is effective February 26, 2010. The fourteen calendar day appeal period will expire on March 11, 2010.
