Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports his decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND The applicant, David Imada, is proposing to allow live entertainment in an existing restaurant (Tatami Sushi & Seafood Buffet) located in the Vallco Shopping Mall. Typically, live entertainment activities require a conditional use permit under the Vallco Master Use Permit (7-U-76). However, the applicant is requesting a six-month temporary use permit to determine if the entertainment will enhance the business. DISCUSSION The applicant is proposing to provide live entertainment Monday through Saturday, from 6:00 p.m. to 8:00 p.m. The entertainment includes acoustic guitar, electric keyboard and vocals. The musicians would perform in the center of the restaurant, behind a a- foot partition. Staff supports the proposal because the live entertainment is enclosed within the mall, meets the City's Noise Ordinance regulations, and all other requirements of the Master Use Permit. ACTION In accordance with Chapter 19.128 of the Cupertino Municipal Code, the Director of Community Development finds: DIR-2010-07 Tatami Sushi at Vallco Shopping Mall Page 2 1. The granting of the application will not be detrimental or injurious to property or improvements in the vicinity, and will not be detrimental to the public, health, safety, general welfare, or convenience; and 2. The proposed use will be located and conducted in a manner in accord with the Cupertino General Plan and the purposes of this title. The Director of Community Development grants asix-month temporary use permit, effective March 4, 2010, expiring September 4, 2010, to allow live music entertainment in Vallco Shopping Mall at the Tatami Sushi & Seafood Buffet, located at 10123 North Wolfe Road, Suite 2001. A formal use permit will be required if the applicant decides that the live entertainment should become a permanent function of the restaurant. The approval is granted on February 18, 2010. The fourteen calendar day appeal period expires on March 3, 2010. 2
