SUBJECT: SPECIAL EVENT PERMIT REVISED PLANNING COMMENT LETTER #2 – Application SE-
2026-003 (Tessellations Student Concert)
Thank you for your submittal of a Special Event Permit SE-2026-003 proposing to hold an outdoor
concert for Tessellations school music students and their families on Friday, May 1, 2026. Additional
information/redline changes are required.
Please provide a written response clearly addressing each item and indicate where items are located on
the plan set. Re-submittal without a response letter will be considered incomplete
1. Santa Clara County Health Permit Required for 2nd Food Truck: Provide the name of the 2nd Food
Truck that will be serving food at the event and provide a copy of their Santa Clara County Health
Department Permit, and please send it to me at catherinet@cupertino.gov.

2. Cupertino Business License Required for Both Food Trucks: Both food trucks must call the
Cupertino Business License Division directly at (408) 777-3221 and the Business License Division
can assist in the issuance of the one-day temporary event business license (they don’t need the year-
long business license, just the temporary one-day event business license). The permit fee is
$13.31. There is no application form, the business owners just need to call the Cupertino Business
License Division and request to submit a Temporary One-Day event license. They will send you a
receipt and if you could please email this receipt of payment to me that satisfies the requirement for
a City of Cupertino Business License.

3. Fully Address the Building Official’s Comment Requiring a Ramp to be Installed Providing
Access to the Stage and Submit the Details Depicting the Ramp to the Building Division: Sean
Hatch, the Building Official had corrections for your proposal to use a stage. In order to use a stage,
you will also need to provide a ramp (see the attached letter). If you are not able to provide this,

unfortunately, you won’t be permitted to use the stage for the event. If you have questions, about the
letter please reach out to the Building Official directly at (408) 777-3228 or seanh@cupertino.gov.
You will need to fully address the Building Official’s comment before I can issue this permit.

4. Revise Site Layout Plan to Shift the Proposed Location of the Stage to be to the West of the
Dirt Area of the Baseball Infield: Per the Planning Manager’s direction, please shift the stage so
that it is located approximately as shown below, to the west of the dirt baseball infield. If you want,
you can shift the stage a bit further up (closer to the library) than shown below, but the stage should
be as close to the school as possible to lessen noise impacts from the concert to adjacent residences.
Please revise your Site Layout Plan to show the new revised location of the stage.

5. Provide Sound Check Decibel Level Readings At Each Property Line the Day Before the
Event: Staff is requiring that you conduct sound checks the day before the event using a cell phone
application that measures noise in decibels to choose the volume that the amplifiers are set at.
Please also designate a staff member to take noise readings during the concert to check that the
sound level of the music complies with CMC 10.48.52 Public Events. Because the event is only 2
hours long, it does not need to comply with the 70-decibel limit, but it does need to comply with the
95-decibel limit.

Please send me the noise decibel level reading from your phone application decibel meter, standing
at each of the 3 property lines the day before the event to demonstrate that the decibel level of the
music was checked. The noise readings at each property line should be well below 95 decibels since
live music will be louder than your noise readings for the recorded music and the live orchestra
music is not permitted to be greater than 95 decibels at the property lines.
Please confirm in writing that you have located a phone application with a decibel reader and that
you will use it to conduct sound checks at least the day before the event, preferably earlier, to check
the noise level of recorded music at the three property lines. Please also confirm you will send me
the maximum decibel level reached at each property line during your sound check the day before the
event, if not sooner so that the event planners have time to adjust the amplifier locations and volume
to comply.
