1. Applications 9-Z-78, 12 -TM -78 and 6-U-78 of B.A.S. HOMES, INC.: PREZONING
approximately 15.4± acres from Santa Clara County R1-10 (single-family
residential 10,000 sq. ft. minimum lot size) zoning district to City of
Cupertino P (Planned Development with single-family residential and quasi -
public use intent) zone or whatever zone may be deemed appropriate by the
Planning Commission; TENTATIVE MAP to subdivide said property into 31 single-
family lots ranging in size from 6,000 to 26,000 sq. ft. and two lots
consisting of a total of approximately 6.4 net acres; USE PERMIT to construct
31 single-family homes and conceptual approval for future location of
religious facilities on the easterly portion of the site containing approxi-
mately 6.4 net acres; and ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration. Said property
is located on the westerly side of Foothill Boulevard approximately 150 ft.
southerly of Poppy Drive immediately opposite of the intersection of Salem

2. Application 10-Z-78 of DANIEL J. DUARTE: PREZONING a parcel of approximately
.43 acres from Santa Clara County R2-8LH two family residence) to the City
of Cupertino R1-7.5 (single-family residential, 7,500 sq. ft. minimum lot
size) zone or whatever zone may be deemed appropriate by the Planning
Commission; and ENVIRONMENTAL REVIEW: The Environmental Review Committee
recommends the granting of a Negative Declaration. Said property is located
on the east side of Merriman Road approximately 300 ft. northerly of Santa
Lucia Road. First Hearing.

3. Applications ll-Z-78 and 14 -TM -78 of JAS J. GARBER: REZONING approximately
.32 acres from R3 (Multiple family residential) to R1C (Residential, single-
family cluster) zone or whatever zone may be deemed appropriate by the
Planning Commission; TENTATIVE MAP to subdivide said property into three
air -space condominium lots with rights of exclusive occupancy; and ENVIRONMENTAL
REVIEW: The Environmental Review Committee recommends the granting of a
Negative Declaration. Said property is located on the northeast corner of
Foothill Boulevard and Alpine Drive. First Hearing.
4. Applications 13-Z-78 and 20 -TM -78 of HOWARD RUTH, JR. & ALAN SIMPKINS: REZONING
approximately 2.3 acres from P (Planned Development) to R1C (Residential,
single-family cluster) zone or whatever zone may be deemed appropriate by the
Planning Commission; TENTATIVE MAP to subdivide said property into 20 single-
family cluster lots and one lot to be held in common ownership; and ENVIRONMENTAL
REVIEW: The Environmental Review Committee recommends the granting of a
Negative Declaration. Said property is located on the southwest corner of
Pacifica Drive and Whitney Way. First Hearing.
5. Application 14-Z-78 of GEORGE CODY (BYRNE AVENUE ASSOCIATES): PREZONING
approximately 1.56 acres from Santa Clara County R -3h (Residential, single-
family, 8,000 sq. ft. minimum lot size) zone and City of Cupertino pre Rl-7.5
(Residential, single-family, 7,500 sq. ft. minimum lot size) zone to City of
Cupertino pre-R1C (Residential, single-family cluster) zone or whatever zone
may be deemed appropriate by the Planning Commission to permit the construction
of eight (8) single-family cluster homes; and ENVIRONMENTAL REVIEW: The
Environmental Review Committee recommends the granting of a Negative Declaration.
Said property is located on the southeast and southwest corners of Byrne Avenue
and Stevens Creek Boulevard. First Hearing.
6. Application 30-U-74 of DONALD WIENER AND PAUL CASTANEDA: Determination of
extension of Use Permit allowing temporary use of service station for a
retail tire business; and ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration. Said property
is located on the southwest corner of the intersection of Stevens Creek Boulevar
and Pasadena Avenue. First Hearing.
7. Application 7-U-78 of SHELL OIL COMPANY: USE PERMIT to remove an existing
service station and replace same with a gasoline dispensing station; and
ENVIRONMENTAL REVIEW: The Environmental Review Committee recommends the
granting of a Negative Declaration. The subject property consists of
approximately .50 acres located at the northeast corner of Stevens Creek
Boulevard and Stalling Road. First Hearing.
8. Applications 9-U-75 (Revised) and 16 -TM -78 of THE O.K. EARL CORPORATION/JOHN
GRAY (HOME FEDERAL SAVINGS & LOAN ASSOCIATION): USE PERMIT to construct two
office buildings equaling a total of approximately 33,000 sq. ft.; TENTATIVE
MAP to subdivide approximately 3.57 acres into three parcels consisting of
1.22, 1.07, and 1.25 acres; and ENVIRONMENTAL REVIEW: The Environmental
Review Committee recommends the granting of a Negative Declaration. Said
property is located on the southeast corner of Stevens Creek Boulevard and
Miller Avenue in a P (Planned Development with commercial and professional
office intent) zone. First Hearing.

9. Application 11-U-78 of MICHAEL DEL MONACO (ANTHONY'S PIER): USE PERMIT to
construct a sit-down restaurant consisting of approximately 7,500 sq. ft.
on a 1.38 acre parcel and ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration. Said property
is located on the southwest corner of the intersection of North De Anza
Boulevard and Highway 280 in a P (Planned Development with commercial,
industrial, residential use intent) zone. First Hearing.
10. Application 12-U-78 of THORNWOOD ASSOCIATES: USE PERMIT to allow a sit-down
restaurant (Pizza Parlour) to occupy approximately 3,000 sq. ft. in the
existing Brunswick Shopping Center and ENVIRONMENTAL REVIEW: The project
was previously assessed and no action required. Said property is located
at the southeast corner of Stelling Road and Homestead Road in a P (Planned
Development with recreational/entertainment and incidental commercial intent)
zone. First Hearing.
11. Application 13-U-78 of THORNWOOD ASSOCIATES: USE PERMIT to allow a health spa
to occupy approximately 4,800 sq. ft. in the existing Brunswick Shopping Center
and ENVIRONMENTAL REVIEW: The project was previously assessed and no action
required. Said property is located at the southeast corner of Stelling Road
and Homestead Road in a P (Planned Development with recreational/entertainment

12. Application 14-U-78 of THORNWOOD ASSOCIATES: USE PERMIT to allow a coin-
-operated amusement electronic game center to occupy approximately 1,600 sq. ft.

was previously assessed and no action required. Said property is located at the

consisting of approximately 158,000 sq. ft. on a 17 acre parcel; TENTATIVE MAP
to divide approximately 28.5 acres into four parcels and ENVIRONMENTAL REVIEW:
The Environmental Review Committee recommends the granting of a Negative
Declaration. Said property is located on the north side of Vallco Parkway
approximately 1,500 ft. easterly of Wolfe Road in an MP (Planned Manufacturing)
zone. First Hearing..
14. Application 15 -TM -78 of NORTHERN CALIFORNIA SAVINGS & LOAN ASSOCIATION:
TENTATIVE MAP to subdivide approximately 5.4 acres into two parcels consisting
of 1.2 acres and 4.2 acres and ENVIRONMENTAL REVIEW: The Environmental Review
Committee recommends the granting of a Negative Declaration. Said property is
located on the northeast corner of Rodrigues Avenue and South De Anza Boulevard
in a P (Planned Development) zone. First Hearing.

UNFINISHED BUSINESS:
15. REFERRED BY CITY COUNCIL - Application 9-U-78 of DR. JOSEPH F. BROWN: USE
PERMIT to allow construction of an industrial building containing approximately
36,500 sq. ft. and ENVIRONMENTAL REVIEW: No action required. The project
was assessed previously in conjunction with an earlier application submittal.
Said property is located at the northerly terminus of Bandley Drive.
