APPROVED PROTECT The approval is based on the tree removal justification letters dated July 13, 2009 and December 7, 2009, and associated plans and photographs submitted by Paul West, certified arborist ISA# WC3760, except as may be amended by the conditions of approval contained in this letter. The trees to be removed are identified as trees 1-6 in the justification letters. 2. REMOVAL OF DEAD TREES In addition to the trees approved to be removed in conjunction with this application, the applicant has recently removed three (3) dead Alder trees within the complex consisting of trunk diameters between 23 inches and 28 inches. The applicant shall be required to replace the removed dead alder trees in accordance with the tree replacement requirements of the City's Protected Trees Ordinance. 3. TREE REPLACEMENTS The applicant shall be required to plant replacement trees on the property in accordance with the tree replacement requirements of the City's Protected Trees ordinance as stated in the table below and in accordance with the tree replacement plan provided by the applicant. The replacement trees shall be required to be planted within 60 days of the effective approval of this application. IN-LIEU TREE REPLACEMENT FEE In the event a replacement tree cannot be planted on the property as determined by the Director of Community Development, the applicant will be required to pay an in-lieu tree replacement fee based upon the purchase and installation cost of the replacement tree(s) in compliance with the City's Protected Trees ordinance. 5. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. Staff has made the findings necessary to grant the tree removal permit in accordance with Section 14.18.180 of the Protected Trees Ordinance. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission and the trees cannot be removed until a final decision on the appeal has been made. The trees listed are in danger of falling due to their growth pattern and health. The growth pattern identified is a heavy list to one side. Corrective pruning is not an option due to poor growth form and poor pruning in the past. The six Aleppo pine trees are also beginning to slowly decline in health and vigor due to their susceptibility to pests. Therefore I am recommending the removal of all six trees. The six trees identified are a liability to the Stonebridge HOA and are likely to cause physical damage to person or property if they are not removed. The removal and replacement of all six trees would greatly enhance the urban forest of Stonebridge HOA. This tree project has been under consideration by the Board almost a year. The project was discussed at the Board Meeting prior to our Annual Meeting (March 2009), at the An~~ual Meeting, and every Board Meeting since the Annual Meeting. The Board has identified such discussions in the Meeting Minutes that have been sent and made available to the homeowners. The project was also discussed with members of the Homeowners Association, including the homeowners who have contacted your office, and their concerns would duly considered by the Board. After carefully considering these concerns, the recommendations made by arborists engaged for the Board, and the Board's observations, the Board concluded that removal of the trees in question in accordance with such recommendations was in the best interest of the community. We look forward to your office issuing approval of our permit request. I am an owner at #22910. During the June Board Meeting I reported an old pine tree just outside the stone perimeter of the neighborhood had developed a crack in one of its main trunks. It was inspected by the Board and I was assured that this tree would take precedence before other delapidated trees are removed, This limb hangs over my house, threatening my safety and imperiling the roof and my dining room. Please weigh the danger and authorize the removal of this menacing tree before the winter storms set in. I will be much obliged with a favorable decision. Sincerely yours, v „
