Subject: Director's Minor Modification, DIR-2009-34, to allow revisions to a previously-
approved landscape plan to enhance on-site permeability, including the
removal of 12 trees and the installation of a vegetated bio-swale on an existing
light industrial/ office property.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports her decision
to the City Council and Planning Commission in time to allow an appeal
of the decision within fourteen calendar days.
BACKGROUND:
On September 10, 2009, Apple received approval of a Director's Minor Modification
(DIR-2009-16) for exterior site improvements that consisted of reconfiguration of the
rear parking lot, minor site enhancements, tree removals and landscaping replanting on
the subject property.
The original approved plans anticipated installation of a mechanical storm water
treatment unit to handle storm water. However, in the interest of maximizing the onsite
storm water retention and minimizing run-off into the bay (as required by the C3 storm
drain regulations), Apple was directed by Public Works Department to install a new
vegetated bio-swale in lieu of the mechanical unit. This change will allow for "greener"
site improvements since landscape storm water treatment measures tend to naturally
filter smaller particle matters than mechanical units. Additionally, the bio-swale will
comply with Regional Water Quality Board measures.
In addition to the bio-swale, Apple is intending to replace existing storm drain pipes
along the rear of the site and along the east side of the site near Calabazas Creek due to
pipe damage caused by roots of surrounding trees. Consequently, Apple is in need of
removing a total of 12 additional trees to accommodate the storm drain pipe restoration
work.

DISCUSSION:
The proposed plans indicate that this will be the fourth bio-swale to be incorporated
onto the site. Three bio-swales to be located in the rear parking lot were approved with
the previously-approved plans.
The new bio-swale will be constructed in the landscape planter immediately west of the
eastern driveway along Vallco Parkway, and will require the removal of six existing
trees in the planter area. These trees include four Monterey Pine trees, a Colorado Blue
Spruce tree and a Crepe Myrtle tree. The applicant will provide the required
replacement trees in accordance with the City's Protected Trees ordinance. All of the
existing Ash trees along the Vallco Parkway frontage are being preserved.
The bio-swale will have an overall width of seven feet, including a five foot bottom
width, and layers of soil and crushed drain rock at the bottom of the swale. A clean out
will be provided at the upper end of the swale.
Additionally, storm drain pipes to discharge the on-site swales will be replaced on the
southeast corner of the site adjacent to Calabazas Creek, and along the rear perimeter of
the site. These pipe replacements are necessary because the roots of the surrounding
trees have damaged existing pipes and have also grown into the pipes, preventing
proper flows. Due to the pipe replacements work, six additional trees will require
removal, including four Redwood trees in poor condition, and two Evergreen Ash trees
near Calabazas Creek. All of these trees are not currently visible currently from public
views. These trees will also be replaced in accordance with the City's Protected Trees
Ordinance.
ACTION:
The Director of Community Development deems the modifications minor and
approved the minor modification and tree removals with the following conditions:
1. APPROVED PROTECT
The approval is based upon Exhibits submitted by Kier & Wright, titled "Apple,
Inc., VP2-Director's Minor Modification Permit #2, 19333 Vallco Parkway,
Cupertino, California" consisting of C0.0 through C3.0 and L-03.03 through L-
03.03, except as may be amended by the conditions in this approval.
All prior approvals per DIR-2009-16 shall remain in effect, except as may be
amended by the conditions in this approval.
2. TREE REPLACEMENTS
In addition to the 190 trees the applicant is required to plant as replacement trees
for DIR-2006-16, the applicant shall also be required to plant the following
additional trees based upon the proposed tree removals in accordance with the
City's Protected Trees Ordinance:

3. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS
The Conditions of Project Approval set forth herein may include certain fees,
dedication requirements, reservation requirements, and other exactions.
Pursuant to Government Code Section 66020(d) (1), these Conditions constitute
written notice of a statement of the amount of such fees, and a description of the
dedications, reservations, and other exactions. You are hereby further notified
that the 90-day approval period in which you may protest these fees,
dedications, reservations, and other exactions, pursuant to Government Code
Section 66020(a), has begun. If you fail to file a protest within this 90-day period
complying with all of the requirements of Section 66020, you will be legally
barred from later challenging such exactions.
The approval is granted on November 10, 2009. Please note that an appeal of this
decision can be made within 14 calendar days from the approval date. The fourteen
calendar day appeal period expires on November 24, 2009. If an appeal if filed, a public
hearing will be scheduled before the Planning Commission. If no appeal is filed, the
director's minor modification becomes effective after November 24, 2009.
