Subject: Director's Minor Modification to a Use Permit (9-U-66) for the continued
operation of a demonstration building in a parking lot of an existing office
complex for an additional three-year period.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports her decision
to the City Council and Planning Commission in time to allow any
Council member or Planning Commissioner to appeal the decision within
fourteen calendar days.
Application:
The applicant, Sterling Makishima (Hewlett-Packard), proposes to continue the location
of a temporary building on the HP campus used as a demonstration building. The
demonstration building was originally approved in 2006 (DIR-2006-29) and expired
October 6, 2009. Hewlett-Packard is requesting to keep the demonstration building in
the current location for their continued use for another three-year period.
The size of the building is 1,859 square feet. It has minimal visibility from Pruneridge
Avenue. The building is located in a parking lot that is remote from the office
buildings. This area was previously used for a contractor's trailer for several years
prior to 2006, and there are no adverse parking impacts from this use. The building
and landscaping utilizes approximately 20 - 22 parking spaces.
Action:
The Director of Community Development approves the modification with the following
conditions:
1. The modification shall expire on November 18, 2012.
2. The area shall be restored as a parking lot upon expiration of the modification.
This approval of the modification is effective November 4, 2009. The fourteen-day
appeal period will expire on November 18, 2009.

Dear Ciddy:
Last April I came to City Hall to discuss relocation of a modular `home' to Hewlett Packard's
Cupertino Site. This is to be an adjunct to the Site's marketing efforts, providing ahome-like
setting for the demonstration of various high-tech devices.
At that time you reviewed my binder of the site and existing home photos with Steve Piasecki,
from which it was agreed that the project would qualify for a Director's Minor Modification. This
was on the basis of the following:
1. The home appears as shown in the attached photo, taken when it was used as a
display at a trade show. It will be in place temporarily at the HP site, to be removed
after a period of about three years.
2. It will be located in a farmer parking lot about 120 feet from Pruneridge Avenue,
which is substantially screened per the attached site photos. The surface and
grades of the parking lot will be modified to suit the proposed landscape shown. Per
the attached sketches the plantings and hardscape will be residential in scale, in
keeping with the scale and style of the house itself.
3. After removal of the demonstration home, the parking lot will be restored to its former
condition, or (if HP desires) submittal made to the Planning Department for an
alternate treatment.
4. The Home will be accessible per ADA, including a handicap parking stall and
accessible access to the building entries by means of ADA-compliant sidewalks.
5. After granting of the Minor Modification permit, we will submit to the Building
Department for building permit in compliance with applicable codes, prior to
preparation and placement of the Home at this location.
