Any changes to the drawings or calculations require a delta-revision cloud bubble around the changes and a date stamp indicating when the changes were made. Please provide a written response clearly addressing each item and indicate where items are located on the plan set. Re-submittal without a response letter will be considered incomplete 1. Revise Sheet 35 of the Plan Set-Amplified Sound Hours: Please revise sheet 35 of the plan set to provide further details regarding how noise from the event/performer will be limited to comply with the City’s nighttime noise limit of 60 decibels at any residential property line. The nearest residences are The Hamptons Apartment Homes at 19500 Pruneridge Avenue, which appear to be roughly 910 feet from the event stage. Please provide additional information on sheet 35 of your plan set describing how the noise level will be checked along property lines bordering residential uses, particularly at the property line nearest to the Hamptons Apartment Homes, to ensure that noise levels at full volume do not exceed 60 decibels at the property line, since this will be a nighttime event. Will a decibel reader be used, and if not, how will noise be checked? Please also provide when the noise level will be checked and at which locations along the property line the noise checks will occur. These requirements are per the following Cupertino Municipal Code section: “10.48.052 Outdoor Public Events. A. Outdoor events open to the general public on nonresidential property, such as parades, rallies, fairs, concerts and special sales and promotional events, involving generation of noise levels higher than would normally occur, by use of the human voice, public address systems, musical instruments, electronic amplification systems, and similar soundproducing activities, are allowed upon obtaining an appropriate permit from the city, and subject to the following general limitations: OFFICE OF COMMUNITY DEVELOPMENT PLANNING DIVISION CITY HALL 10300 TORRE AVENUE • CUPERTINO, CA 95014-3255 (408) 777-3308 • FAX (408) 777-3333 • planning@cupertino.org Page 2 1. The event shall not produce noise levels above seventy dBA on any residential property for a period longer than three hours during daytime. 2. The event shall not produce noise levels above sixty dBA on any residential property during the period from eight p.m. to eleven p.m., and above fifty-five dBA for any other nighttime period. 3. Continuous or repeated peak noise levels above ninety-five dBA shall not be produced at any location where persons may be continuously exposed. B. The conditions imposed upon the event or activity in the permit issued by the City, regarding maximum noise level, location of noise sources, or duration of activity, for example, may be more limiting than this section, to protect certain individuals, areas or nearby activities which would otherwise be disturbed, and these permit conditions, when in conflict with this section, are overriding.” RESPONSE______________________________________________________________________ Sincerely, Catherine Tarone Planning Permit Technician (408) 777-3297 catherinet@cupertino.gov
