Stelling Road (Abundant Life Church), with the following conditions: 1. APPROVED PROTECT This approval is based upon a retroactive tree removal plan and tree replanting plan submitted with the application on August 25, 2009 by HPC Architecture, Inc., the applicant's tree justification statement, and visual inspection by staff, except as may be amended by conditions in this resolution. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. The approval of the retroactive tree removal permit has been granted in accordance with Section 14.18.188 (Retroactive Tree Removal Permit) of the Protected Trees Ordinance of the Cupertino Municipal Code. Please note, however, that an appeal of this decision can be made within 14 calendar days from the date of this letter. If this happens, you will be notified of a public hearing, which will be scheduled before the Planning Commission, and the replacement TR-2009-13 Page 3 trees cannot be planted until a final decision on the appeal has been made. If no appeal is made within the appeal period, the replacement trees may be planted in accordance with this approval after Friday, November 6, 2009. Below you will find the Justification Statement for the trees that were removed. Let me know if you have further questions. Steve Tree Removal Justification Statement for 10100 Stellin~ Road. See Tree Removal Plan, AT.O1, dated 6/18/09. These trees were removed prior to filling a Tree Removal Application. Trees A through I were removed for these reasons: A new underground fire protection water line was installed on the southern edge of the property. The trench for this new water line ended up running through the parking stalls immediately adjacent to these nine trees. The roots were undermined in this process of digging the trench. Over the years these trees have undermined the asphalt paving in the adjacent parking area causing damage and a tripping hazard. See submitted photos. The adjacent property owner to the South had pruned back about 40-50% of the tops of these trees beyond the property line without permission from the church. See submitted photos. Trees J through P were removed for these reasons: The main sewer line for the church was replaced due to flow problems. These trees were located directly over this line and contributed to the ongoing sewer problems. The replacement trees will be located further to the south at the edge of the new patio.
