The subject property is located at the northern terminus of Amelia Court, and is surrounded by Varian Park to the east across Amelia Court, single-family homes and Ainsworth Drive to the west, single-family homes and Varian Way to the north, and single-family homes and Crescent Road to the south. The subject property is developed with one single-family home that is vacant, a detached garage and two sheds located at the western edge of the property near Ainsworth Drive. The home is currently accessed by a driveway from Amelia Court along the southern perimeter of the property that slopes upward toward the home. There is currently no access from Ainsworth Drive. All of the existing structures are proposed to be demolished prior to the recordation of the final map. The subject property varies in topography with an average slope of 15.7%. Overall, the site terraces down from west to east (Ainsworth Drive to Amelia Court). All of the proposed building pads are located on flat portions of the site. A geological report was not required because the site is not located in a geological hazardous area. Detailed site and architectural designs for the future homes are not being proposed at this time; however, the buildable footprint for the tv~o new lots along Amelia Court have been delineated to demonstrate proper building and garage interface. 3-2 Brian Kelly TM-2009-03 October 27, 2009 Page 3 DISCUSSION: Subdivision Design The proposed project (see Tentative Parcel Map, Attachment 1) involves the creation of three new single-family lots configured in a manner to allow two of the lots (Lots 1 and 2) to face and access from Amelia Court. Additionally, the existing driveway along the southern perimeter of the project site will be removed. This driveway will no longer be needed since Lot 3 will take access from Ainsworth Drive. Frontage improvements will involve the construction of street frontage for Lots 1 and 2 along Amelia Court consisting of curb, gutter, sidewalk and a cul-de-sac that will terminate Amelia Court at Lot 2. The project will also continue the matching frontage improvements (curb, gutter and sidewalk) along the west side of Varian Park (east side of Amelia Court) for approximately SO linear feet. As a condition of approval, the shared private drive ingress/egress and roadway rights for Amelia Court will be granted from the existing property to Lots 1 and 2 of the newly subdivided property. On Lot 3, the street frontage will also be improved consisting of curb, gutter, sidewalk and completion of the partially completed cul-de-sac at the termination of Ainsworth Drive. Y' ~ ~' ~ .. . ~ n An arborist report (see Attachment 2} was prepared for this site by the City Arborist, David Babby, and is dated October 2, 2009. The arborist's report inventoried trees both on site and those overhanging the site from neighboring properties. In total, 42 trees of 19 different species were inventoried. The remaining ten trees are situated on neighboring properties with canopies overhanging the project site. Based on the report, three (3) trees are considered "protected trees" based upon the specimen size (single trunk 10" diameter or greater; multiple trunk 20" diameter or greater) and species of trees per the City's Protected Trees Ordinance. These three protected trees are all located on the project site and are Coast Live Oak trees identified as trees 1, 2 and 24. The applicant is proposing to retain these three protected trees on site; however, according to the City Arborist report, retaining these trees will require relocation due to their locations in or near future construction areas for the future homes and curb, gutter and sidewalk improvements. A condition of approval has been added to require a tree removal permit for the relocation and transplanting of these trees. Although no protected trees are proposed to be removed, the following is a list of the trees on the project site proposed to be removed by the applicant: 1. Tree No. 7, a severely pruned apple tree with amulti-trunk diameter of 11 ", that the City Arborist also recommends removing. 2. Tree No. 41, a 25-inch diameter (specimen size) California Black Walnut tree that is in poor condition. 3. Tree No. 42, a 19-inch diameter (specimen size) avocado tree that is in fair condition. 4. Tree No.17, a multi-trunk 43" diameter (specimen size) California Black Walnut tree that the City Arborist recommends removing because it is dying. 5. Tree No. 23, a multi-trunk 10" diameter Coast Live Oak tree that is in fair condition. 6. Tree No. 21, a multi-trunk 16" diameter olive tree that is in f air condition. The City Arborist also identified and inventoried 12 additional trees on the project site that were not shown on the proposed tentative parcel map including Tree Nos. 8,13-16, 20, 29, 32-35, and 39. Of these trees, the City Arborist indicated that Tree Nos. 20, 29, and 39 might require removal based upon the proposed location of the construction of the new homes. Further, the City Arborist notes that Tree Nos. 3,12, 21-23, 40-42 may also require removal based upon the proposed location of the future construction. 3-5 Brian Kelly T'M-2009-03 October 27, 2009 Page 6 Additionally, the City Arborist recommends that Tree Nos. 18 (a multi-trunk 27" English Walnut tree) and 30 (a 9" Modesto Ash tree) be removed because they are dead /dying. Staff recommends that only the existing dead/dying trees be allowed to be removed at this time, which includes Tree Nos. 17, 18 and 30. Staff recommends that all other trees on site remain until the applicant obtains approval of the site and architectural review permits for the future single-family homes at which time staff can determine if any of the existing trees can be retained on site. Cupertino Sanitary District The Cupertino Sanitary District has reviewed the project and states that sanitary sewer service can be provided to the proposed parcels via Amelia Court. There is also an existing 20-foot sanitary sewer easement on the property that Cupertino Sanitary District is considering to Quit Claim (see Attachment 3). Categorical Exemption The proposed project is deemed categorically exempt per Section 15315, Class 15 (Minor Land Divisions) of the California Environmental Quality Act (CEQA) since it consists of a subdivision less than four parcels, is in conformance with the General Plan and zoning, requires no variances or exceptions, has access and all services to local standards, and the parcel does not have an average slope greater than 20%. OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO APPROVING A TENTATIVE PARCEL MAP TO SUBDIVIDE ONE PARCEL INTO THREE LOTS RANGING IN SIZE FROM 12,049 SQUARE FEET TO 14,470 SQUARE FEET ON PROPERTY LOCATED AT 10231 AMELIA COURT SECTION I: FINDINGS WHEREAS, the Planning Commission of the City of Cupertino received an application for a Tentative Parcel Map, as described in Section II of this Resolution; and WHEREAS, the necessary public notices have been given in accordance with the Procedural Ordinance of the City of Cupertino, and the Planning Commission has Held one or more public hearings on this matter; and WHEREAS, the applicant has met the burden of proof required to support said application; and has satisfied the following requirements: 1) That the proposed subdivision map is consistent with the City of Cupertino General Plan. 2) That the design and improvements of the proposed subdivision are consistent with the General Plan. 3) That the site is physically suitable for the type and intensity of development contemplated under the approved subdivision. 4) That the design of the subdivision or the proposed improvements are not likely to cause substantial environmental damage and/ or substantial and unavoidable injury to fish and wildlife or their habitat. 5) That the design of the subdivision or the type of improvements associated there with is not likely to cause serious public health problems. 6) That the design of the subdivision and its associated improvements will not conflict with easements acquired by the public at large for access through or use of property within the proposed subdivision. NOW, THEREFORE, BE IT RESOLVED: That after careful consideration of maps, facts, exhibits, testimony and other evidence submitted in this matter, the application for Tentative Parcel Map, file no. APPROVED EXHIBITS Approval is based on plan sets titled "Tentative Parcel Map, 10231 Amelia Court, Cupertino, CA, APN: 326-17-017", dated July 2009 on Pages 1 and 3, and dated August 25, 2009 on Page 2, consisting of three sheets labeled 1 through 3, except as amended by the Conditions contained in this Resolution. 2. NOTICE OF FEES, DEDICATIONS, RESERVATIONS OR OTHER EXACTIONS The Conditions of Project Approval set forth herein may include certain fees, dedication requirements, reservation requirements, and other exactions. Pursuant to Government Code Section 66020(d) (1), these Conditions constitute written notice of a statement of the amount of such fees, and a description of the dedications, reservations, and other exactions. You are hereby further notified that the 90-day approval period in which you may protest these fees, dedications, reservations, and other exactions, pursuant to Government Code Section 66020(a), has begun. If you fail to file a protest within this 90-day period complying with all of the requirements of Section 66020, you will be legally barred from later challenging such exactions. 3. FUTURE SINGLE-FAMILY RESIDENTIAL DESIGN REVIEW The architectural design of the future single-family residences on Lots 1, 2 and 3 shall demonstrate that the garages will be set back to promote visibility of the living areas of the homes along the street frontages from Amelia Court and Ainsworth Drive to the satisfaction and approval of the Director of Community Development. Any proposed two-story residence shall require site and architectural approval of a two-story residential permit per Section 19.28 of the Single-Family Residential (R1) Zoning Ordinance. 4. DEMOLITION OF STRUCTURES Prior to recordation of the final map, the applicant shall demolish and remove all structures on the property. 5. EASEMENTS Prior to recordation of the final map, the applicant shall record appropriate deed restrictions and covenants running with the land, subject to approval of the City Attorney, for reciprocal ingress/ egress easements and private roadway access. The deed restriction shall provide for necessary reciprocal ingress and egress pedestrian and vehicular easements to and from the affected parcels. 3-8 Model Resolution No. TM-2009-03 October 27, 2009 Page 3 6. PUBLIC ACCESS EASEMENT Prior to final map, the applicant shall record a public access easement over the sidewalks along Lots 1, 2 and the frontage along Varian Park on Amelia Court. The agreement shall be subject to review and approval as to form and content by the City Attorney. 7. MAINTENANCE AGREEMENT Prior to final map, the applicant shall record a covenant and deed restriction running with the land obligating the existing and future property owners of Lots 1 and 2 to maintain the improvements (curb, gutter, sidewalk, private street) on Amelia Court, and leaving Amelia Court free of debris, weeds and other obstructions. 8. TREE PROTECTION No trees shall be removed and/ or relocated from the subject property until a tree removal permit is obtained in conjunction with the site and architectural review and approval of the future single-family residences for the relocation and transplanting of any protected bees on site. The tree removal permit application shall not be filed prior to filing of applications for the site and architectural review for the future single-family residences. SECTION IV: CONDITIONS ADMINISTERED BY THE PUBLIC WORKS DEPARTMENT 9. STREET WIDENING Street widening and dedications shall be provided in accordance with City Standards and specifications and as required by the City Engineer. 10. CURB AND GUTTER IMPROVEMENTS Curbs and gutters, sidewalks and related structures shall be installed in accordance with grades and standards as specified by the City Engineer. 11. STREET LIGHTING INSTALLATION Street lighting shall be installed and shall be as approved by the City Engineer. Lighting fixtures shall be positioned so as to preclude glare and other forms of visual interference to adjoining properties, and shall be no higher than the maximum height permitted by the zone in which the site is located. 12. FIRE HYDRANT Fire hydrants shall be located as required by the City and Santa Clara County Fire Department as needed. 13. GRADING 3-9 Model Resolution No. TM-2009-03 October 27, 2009 Page 4 Grading shall be as approved and required by the City Engineer in accordance with Chapter 16.08 of the Cupertino Municipal Code. 401 Certifications and 404 permits maybe required. Please contact Army Corp of Engineers and/ or Regional Water Quality Control Board as appropriate. 14. DRAINAGE' Drainage shall be provided to the satisfaction of the City Engineer. Pre- and post- development calculations must be provided to indicate whether additional storm water control measures are to be installed. 15. UNDERGROUND UTILITIES The developer shall comply with the requirements of the Underground Utilities Ordinance No. 331 and other related Ordinances and regulations of the City of Cupertino, and shall coordinate with affected utility providers for installation of underground utility devices. The developer shall submit detailed plans showing utility underground provisions. Said plans shall be subject to prior approval of the affected Utility provider and the City Engineer. 16. IMPROVEMENT AGREEMENT The project developer shall enter into a development agreement with the City of Cupertino providing for payment of fees, including but not limited to checking and inspection fees, storm drain fees, park dedication fees and fees for under grounding of utilities. Said agreement shall be executed prior to issuance of construction permits. Fees: a. Checking & Inspection Fees: $ 6% of Off-Site Improvement Cost or $3,9820.00 minimum b. However, the fees imposed herein may be modified at the time of recordation of a final map or issuance of a building permit in the event of said change or changes, the fees changed at that time will reflect the then current fee schedule. 17. TRANSFORMERS Electrical transformers, telephone vaults and similar above ground equipment enclosures shall be screened with fencing and landscaping or located underground such that said equipment is not visible from public street areas. The transformer shall not be located in the front or side building setback area. 18. BEST MANAGEMENT PRACTICES Utilize Best Management Practices (BMPs), as required by the State Water Resources Control Board, for construction activity, which disturbs soil. BMP plans shall be included in grading and street improvement plans. 19. DEDICATION OF WATERLINES The applicant shall dedicate to the City all waterlines and appurtances installed to City Standards and shall reach an agreement with San Jose Water for water service to the subject development. 20. NPDES CONSTRUCTION GENERAL PERMIT The applicant must obtain a Notice of Intent (NOI) from the State Water Resources Control Board, which encompasses preparation- of a Storm Water Pollution Prevention Plan (SWPPP), use of construction Best Management Practices (BMPs) to control storm water runoff quality, and BMP inspection and maintenance. 21. AMENDED DEVELOPMENT BEST MANAGEMENT PRACTICES (BMP REQUIREMENTS The applicant must include the use and maintenance of site design, source control and storm water treatment BMP's, which must be designed per approved numeric sizing criteria. A Storm Water Management Plan, Storm Water Facilities Easement Agreement, Storm Water Facilities Operation and Maintenance Agreement, and certification of ongoing operation and maintenance of treatment BMP's are required. 22. EROSION CONTROL PLAN The developer must provide an approved erosion control plan by a Registered Civil Engineer. This plan should include all erosion control measures used to retain materials on site. Erosion control notes shall be stated on the plans. 23. TRAFFIC CONTROL PLAN 3-11 Model Resolution No. TM-2009-03 ~ October 27, 2009 Page 6 The developer must submit a traffic control plan by a Registered Traffic Engineer to be approved by the City. The plan shall include a temporary traffic control plan for work in the right of way as well as a routing plan for all vehicles used during construction. All traffic control signs must be reviewed and approved by the City prior to commencement of work. The City has adopted Manual on Uniform Traffic Control Devices (MUTCD) standards for all signage and striping work throughout the City: 24. TRASH ENCLOSURES The trash enclosure plan must be designed to the satisfaction of the Environmental Programs Manager. 25. REFUSE TRUCK ACCESS The developer must obtain clearance from the Environmental Programs Manager in regards to refuse truck access for the proposed development. 26. C.3 REQUIREMENTS C.3 is required for project creating or replacing 10,000 square foot or more impervious surface. Project is required to fill out C.3 Impervious Surface Form. Provide Low Impact Development measures. Babby, Registered Consulting Arborist October Z, 2009 1.0 INTRODUCTION I have been retained by the City of Cupertino Community Development Department to review the tree-related impacts associated with a proposed subdivision of 10231 Amelia Court, Cupertino, into three single-family residential lots. Specific tasks performed for my review are as follows: ^ Identify all trees situated in close proximity to the proposed development, including those located on the subject site and those overhanging the site from neighboring properties. ^ Measure or estimate the trees' trunk diameters where appropriate to obtain the most representative sample of trunk size; diameters are rounded to the nearest inch. Trees with more than one trunk diameter listed have multiple trunks. ^ Estimate each tree's height and canopy spread. ^ Ascertain each tree's health and structural integrity, and assign an overall condition rating (e.g. good, fair, poor or dead). ^ Determine each tree's suitability for preservation (e.g. high, moderate, or low). ^ Specify which trees are regarded as "protected trees" pursuant to Section 14.18.035 of the Cupertino Municipal Code. ^ Review Sheets 1 thru 3 (dated 8/25/09) prepared by Nelsen Engineering, and assess the potential tree-related impacts. ^ Obtain photographs of each tree; these can be viewed in Exhibit C. ^ Assign numbers to each inventoried tree, and show these numbers on the map presented in Exhibit B, which is a copy of the Tentative Parcel Map (Sheet 2). ^ Affix metal tags with corresponding numbers to accessible tree trunks situated on the subject site (the tags are round aluminum with engraved numbers). ^ Prepare a written report containing the aforementioned information, and provide recommendations to help mitigate or avoid anticipated impacts to trees that will be retained, relocated or removed. 10231 Amelia Court, Cupertino City of Cupertino Coni»zu~~ity Development Deparhnent Page 1 of 10 3-20 David L. The trees' locations are presented on the map in Exhibit B, and photographs are provided in Exhibit C. Three trees are considered a "protected trees" pursuant to Section 14.18.035 of the Cupertino Municipal Code; they include #1, 2 and 24. Each is a coast live oak with multiple trunks. Ten trees have trunks situated on neighboring properties and canopies overhanging the site; they include #4, 5, 9-11, 25-28 and 37. The following 18 trees are not shown on the Tentative Parcel Map reviewed: #4, 5, 8-11, 13-16, 20, 29, 32-35, 37 and 39. Note that their trunk locations, as shown on the map in Exhibit B, are only roughly approximate and should not be construed as being surveyed or necessarily accurate. 3.0 SUITABILITY FOR TREE PRESERVATION Each tree has been assigned either a "high," "moderate" or "low" suitability for preservation rating as a means to cumulatively measure their physiological health, structural integrity, anticipated life span, location, size and specie type. A description of these ratings are presented below; note that the "high" category comprises 4 trees (or 10%), the "moderate" category 27 trees (or 64%), and the "low" category 11 trees (or 26%). High: Applies to trees #4, 5, 36 and 38. These trees have a high potential of providing long-term contribution to the site, appear in good health, and contain seemingly stable structures. 10231 Amelia Court, Cupertino Page 3 of 10 City of Cupertino Community Development Deparbnent 3-22 Dm~id L. Babby, Registered Consulting Arborist October 2, 2009 Moderate: Applies to trees #1-3, 6, 8-16, 20, 21, 23-25, 28, 31-35, 37, 39 and 40. These trees contribute to the site but not at seemingly significant levels. Their longevity and contribution is less than those of high suitability, and more frequent care is needed during their remaining life span. Low: Applies to trees #7, 17-19, 22, 26, 27, 29, 30, 41 and 42. These trees are predisposed to irreparable health and structural problems that are expected to worsen regardless of measures employed. 4.0 REVIEW OF POTENTIAL IMPACTS Thirteen trees would require removal to accommodate the proposed design; they include #1-3, 12, 20-23, 29 and 39-42. Of these, #1-3 and 23 are coast live oaks, and their relocation is suggested as an alternative to their removal (note that #1 and 2 are regarded as "protected trees"). The loss of the other nine trees seemingly confornis to City Code. The removal of trees #7 and 17 are also proposed. Tree #7 is a severely pruned apple tree and its loss would seemingly conform to City code; however, it does serve as an effective screening element between the subject and northern neighboring property, and as such, I suggest its retention is considered. Tree #17 is a dying California black walnut and should be removed. I also recommend the removal of trees #18 (a dead English walnut) and 30 (a dying Modesto ash). Tree #24 is another coast live oak of "protected tree" status. By implementing the proposed design, it would sustain significant root loss (and possibly canopy loss) during grading, construction of the proposed home, and installation of the proposed turf block. 10231 Amelia Court, Cupertino Page 4 of IO City of Cupertino Conzanunity Development Depart»zent 3-23 Da>>zd L. Babby, Registered Consulting Arborist October 2, 2009 For all practical purposes, this tree may also be in direct conflict, and protection in its current location may not be feasible. If this is the case, its relocation is recommended. If retained, I recommend the turf block is established at least 12 feet from its trunk, and the home and grading design is adjusted to consider a minimum setback of eight feet in all other directions for any soil cuts, grading, compaction and trenching. The proposed grading design will expose trees #4 thru 11 to potentially significant and irreversible impacts. To avoid this from occurring, I recommend grading, soil compaction and trenching does not exceed five feet beyond the northern perimeter of the proposed driveway, garage and northern building footprint for lot 2. 5.0 RECOMMENDATIONS Recommendations presented within this section are based on plans reviewed, and serve as guidelines for avoiding or mitigating tree-related impacts. They should be incorporated into the project plans, and carefully followed throughout the development process. Note that they are subject to revision upon reviewing any additional or revised plans. 5.1 Design Guidelines 1. On Sheet 2, I recommend the following items are added: the trunk locations of each inventoried tree; the canopy dimensions of trees #l, 2 and 24; and each tree's assigned number. 2. Recommendations presented in Section 4.0 of this report shall be followed. 3. All existing, unused lines or pipes beneath the canopies of retained trees shall be abandoned and cut off at existing soil grade (rather than being dug up and causing subsequent root damage). 10231 Amelia Court, Cupertino City of Cupertino Conzmuirity Development Depm~tment Page 5 of 10 3-24 David L. Babby, Registered Consulting Arborist October 2, 2009 4. Any new underground utility, service and irrigation lines shall be established beyond the trees' canopies. 5. The permanent and temporary drainage design, including downspouts, shall not require water being discharged beneath the oak tree canopies. 6. Table A of Section 14.18.185 the City Code should be used as the framework for determining the size and amount of new trees to install. The new trees should be proposed and planted beyond 15 feet from the canopies of existing trees and any areas planned for future grading. The trees shall be planted prior to final inspection, double-staked (no cross-brace) with rubber tree ties (may not be necessary for trees of 48-inch box size and larger), and all forms of irrigation of an automatic drip or soaker hose system placed on the soil surface and not in a sleeve. Additionally, to achieve the greatest assurance of proper installation, all new trees shall be installed, including necessary irrigation, by an experienced state-licensed landscape contractor or a professional tree company, and performed to professional industry standards. 7. The landscape design should incorporate the following guidelines: a. Plant material installed beneath the canopies of oak trees must be drought- tolerant, limited in amount, and planted at least five to ten feet from their trunks. A source for identifying suitable drought-tolerant plant material is as follows: www.californiaoaks.orp/ExtAssets/CompatiblePlantsUnder&AroundOaks.pdf. b. Beneath the canopies, Isuggest afour-inch layer of coarse wood chips or other high-quality mulch is spread (no gorilla hair, bark or rock/stone). Black plastic or other synthetic ground cover should also not be placed beneath the canopies. c. Irrigation can, overtime, adversely impact the oaks and should be avoided. Irrigation for any new plant material beneath their canopies should be a low- volume, drip-type system that does not apply water within a distance of approximately five feet from their trunks, applied irregularly (such as only once or twice per week), and temporary (such as no more than three years). Irrigation should not strike within 12 to 24 inches of the other trees. 10231 Amelia Court, Cupertino Page 6 of 10 City of Cupertino Community Development Deparbnent 3-25 David L. Babby, Registered Consulting Arborist October 2, 2009 d. In the event trenches for irrigation andlor lighting are required beneath a canopy, they shall be installed in a radial direction to the trees' trunks. e. Mulch should be placed no closer than 12 inches from a tree's trunk. f. Tilling beneath canopies should be avoided, including for weed control. g. Bender board or other edging material proposed beneath the canopies should be established on top of existing soil grade (such as by using vertical stakes). 8. The proposed locations. of the relocated oaks should be identified on Sheet 2. 5.2 Protection Measures before and during Construction 9. All recommendations presented in Section 5.1 of this report shall be followed. 10. Tree protective fencing shall be erected to restrict access into unpaved areas beneath the entire tree canopies, and established no farther than five feet from an approved foundation, and 18 inches from an existing driveway or retaining wall. It shall be installed prior to any demolition, grading, trenching, soil scraping, or construction, and comprised of five- to six-foot high chain link mounted on two-inch diameter steel posts that are driven at least two feet into the ground and spaced no more than 10 feet apart. Once established, the fencing shall remain in place and be undisturbed throughout construction until final inspection. Note that I can provide a diagram of the fencing locations once revised and more finalized plans are resubmitted to me for review. 11. Unless otherwise approved, all development activities must be conducted beyond the fenced-areas and any unpaved areas beneath the trees' canopies. These activities include, but are not limited to, the following: demolition, grading, stripping of topsoil, trenching, equipment cleaning, stockpiling/dumping of materials, and equipment/vehicle operation and parking. Tree trunks must also not be used as winch support for transporting or lifting heavy loads. 10231 Amelia Court, Cupertino City of Cupertino Community Development Deparnnent Page 7 of 10 3-26 David L. Prior to construction, afour- to five-inch layer of coarse wood chips ('/4- to 3/4-inches in size) from a local tree service company should be manually spread on unpaved soil beneath the canopies of retained trees (no need to place chips against the trees' trunks, or within 24 inches from an approved foundation). The wood chips should remain throughout construction and removed only by hand. 13. The removal of existing hardscape beneath a canopy must be carefully performed to avoid excavating soil and damaging roots during the process. This work should not involve the use of heavy equipment or tractors operating or traveling on unpaved soil beneath canopies. Within the same day as hardscape is removed from beneath a canopy, wood chips specified above should be manually spread, and fencing established to restrict access. 14. Any approved activity required on unpaved areas beneath the trees' canopies must be manually performed using hand tools and wheelbarrows; and not require heavy equipment or tractors traveling or operating on unpaved ground. 15. During any approved trenching or excavation, any roots encountered with diameters less than 1.5 inches could be removed, but must be cleanly severed at right angles to the direction of root growth. In doing so, sharp cutting tools (e.g. Toppers or handsaw) should be used, and the cuts must occur against the tree side of the trench. The severed root end should be covered with backfill soil the same day. 16. Any roots encountered with diameters greater than 1.5 inches must be retained, not damaged, and covered with soil or wrapped in moistened burlap within one-hour of being exposed. If burlap is used, it should remain continually moist until the trench is backfilled. 17. Spoils must not be displaced beneath tree canopies or in an area where the material would erode into unpaved areas beneath canopies. If a section of new property fence is to be installed, the posts should be situated at least 24 inches from any trunk, and manually dug with apost-hole digger. In the event a root of 1.5 inches and greater in diameter is encountered during the process, the hole should be shifted over by about 12 inches and the process repeated. 19. Great care should be taken by construction personnel and any heavy equipment operator to avoid damaging tree trunks, limbs and branches. 20. Ivy should be cleared off and two feet from the trees' trunks. This work should be manually performed to avoid compaction caused during the operation of heavy equipment or small tractors. 21. Throughout construction during the months of April thru November, supplemental water should be supplied to retained trees. In doing so, I recommend a rate of approximately five gallons per inch of trunk diameter (for tree with multiple trunks, apply the largest trunk diameter) is applied to the ground beneath the trees' canopies (and not at the trunks) at two-week intervals. 22. All tree pruning shall be performed in accordance with the most recent ANSI standards, and by a California state-licensed tree service company that has an ISA (International Society of Arboriculture) certified arborist in a supervisory role. The company selected should also carry General Liability and Worker's Compensation insurance, and shall abide by ANSI 2133.1-2006 (Safety Operations). All pruning should be limited to the removal of deadwood >_1 in diameter; heavy limb weight reduction; and clearance from the driveways, homes and sidewalks. 23. The relocation of any tree must be performed according to the standards set forth in ANSI A300 (Part 6)-2005 Transplanting, and by a company that has an ISA certified arborist in a supervisory role, holds a current California state-licensed contractor's license, carries General Liability and Worker's Compensation insurance, and abides 10231 Amelia Court, Cupertino City of Cupertino Community Development Department Page 9 of 10 3-28 David L. The disposal of harmful products (such as cement, paint, chemicals, oil and gasoline) is prohibited beneath canopies or anywhere on site that allows drainage beneath canopies.
