Subject: Director's Minor Modification, DIR-2009-27, to allow a 276 square foot sunroom to be
added onto the rear of an existing 2,606 square f oot single family residence located at
10251 Partlett Place in a Planned Development Single Family Residential P(R1-7.5)
Zone.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
BACKGROUND:
The subject property is located east of North De Anza Boulevard, at the northwest corner of
Lazaneo Drive and Partlett Place. The residence is part of a 54-unit detached single family
planned development originally constructed in 1977. The development was rezoned to Planned
Development with Single Family Residential Use, with the intent that the residences in the
development would comply with the Sin le-Farru~Residential (R1) Ordinance.
DISCUSSION The property
owners are requesting to add 276
square foot sunroom to an
existing single family residence.
The addition will be located along
the rear side of the residence,l5'-
10" from the rear property line.
The R1 Ordinance allows a
reduction of the rear yard setback
to 10-feet if, after the reduction,
the usable rear yard is not less
than twenty times the lot width as
measured from the front setback
line. The proposed project
satisfies this rule. The project
would decrease the existing
usable rear yard from 1,525

square feet to 1,435 square feet, which is above the minimum required usable rear yard space of
1,420 square feet.
The project complies with all other requirements of the Use Permit (14-U-76) and the R1
Ordinance, including but not limited to floor area ratio, setback and height. No trees are
proposed for removal.
ACTION:
The Director of Community Development deems the modification minor and approves the
addition to the residence.
This approval of the modification is effective October 13, 2009. The fourteen calendar day
appeal period will expire on October 28, 2009.
