RESOLUTION NO. 1918
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A TENTATIVE MAP TO RESUBDIVIDE
FOUR PARCELS CONSISTING OF APPROXIMATELY 25 ACRES INTO
SIX PARCELS EQUALING APPROXIMATELY FOUR ACRES EACH.

LOCATION: Westerly ridge in Regnart Canyon approximately 800 ft. northwesterly
of Regnart Road approximately 1,000 ft. southwesterly of the terminus
of Lindy Lane
FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of March 12, 1979.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. That the approval is based upon Exhibits A and A-1 of Application 1 -TM -79
as may be modified by additional conditions contained herein.
16. The grading concept for Lots 4, 5, and 6 shall be reviewed and approved by
the Director of Planning and Development and Director of Public Works. Said
Directors shall compare the grading concept proposed by Exhibit A-1 of
Application 1 -TM -79 with the grading concept approved for said lots in
conjunction with the Nellis subdivision application (10 -TM -77). The
primary objective of the review is to select the grading plan which strikes
the best balance between minimum disruption of the natural terrain and
maximum degree of ground stability for subsequent development and reduced
driveway grades for fire protection purposes. In addition to the above
policy, the Directors shall review the subject lots as well as Lots 1, 2,
and 3 based upon the following general policies.
a. Pad elevations. The finish vertical elevation of the vehicular
turn -around pads for each building site shall be within 10 ft. of
the finish elevation designated on Exhibit A. Mass grading of
building sites may be performed only in conjunction with building
permits of residential structures. Private roads and individual
driveway approaches for each site may be graded concurrently with
the main public road.
b. Retaining walls may be employed to resolve ground stability
problems or minimize grading.

c. A registered landscape architect shall review grading plans and,
after consultation with the project and City Engineer, shall submit
a plan to prevent soil erosion and visually screen extensive cut
and fill areas. The intent of the visual screen is to soften
grading scars. A 100% screening effect is not required.
17. That an emergency access driveway shall be constructed connecting driveway
serving Lots 1 and 2 with the driveway serving Parcel 4. The objective
of this condition is to provide an emergency fire linkage between the
proposed public street within the approved Grand View Estates subdivision
and Regnart Road. As provided by the Hillside Subdivision Ordinance,
appropriate deed restriction and covenant running with the land shall be
recorded to provide for a common access and maintenance agreement for
driveways and including the emergency fire access. Each lot holder within
the subdivision shall be responsible for maintenance of the emergency
fire road access including necessary gates and other control devices.
The applicant shall execute an agreement, as approved by the City Attorney
in form, with the owner/developer of Tract No. 6310 (Nellis subdivision)
to jointly maintain the emergency access road connecting Regnart Road
with the future public street system in Lindy Canyon (Tract No. 6401).
18. That the applicant shall record a covenant on each lot to be transferred
informing future lot purchasers of the existence of geologic hazards in
the area, and additionally, that special development regulations apply
to any construction on the lot. Future applicants for building permits
shall comply with the recommendations in the March 8, 1979 memo from
William Cotton entitled "Canyon View Estates".
19. A turn -around space for emergency fire fighting equipment shall be provided
at the terminus of the driveway serving Lot 6.
20. The applicant shall design and install improvements on the public right of
way to provide for the temporary storage of refuse cans for municipal
garbage pick up.
21. Prior to recordation of the final map, provisions shall be made for
water service to the subdivision in a manner as approved by the City
Council.
22. No earth moving or other heavy construction equipment shall be operated
on Saturday, Sunday, or national holidays and on weekdays prior to 7 a.m.
and after 6 p.m. The above requirement is waived if the construction
activity is of a nature that requires continuous operation such as the
connection of utility systems or the placement of concrete into a single
form. The requirement is additionally waived if construction cannot be
stopped without creating either safety problems or hazardous conditions
or construction emergency as determined by the Director of Public Works.
The use of hand tools or hand-held power tools is not regulated by this
condition.

23. No grading shall be done from the month of November to the month of April.
If the developer chooses to grade during these months he must first post a
bond with the City in a sum sufficient to repair any possible damage done.
The sum of the bond to be posted will be determined by staff.
24. The proposed boundary adjustment between Parcel 1 and Lot 18 of Tract No.
6310 described on Exhibit A is not approved in conjunction with Application
1 -TM -79.
25. The subject map will not be recorded until acceptance of street dedication
for the adjoining Grand View Subdivision (Tract No. 6401) has been accepted
by this City. Additionally, building permits for Lots 3, 4, 5, and 6 shall
not be issued until street improvement agreements are accepted and work
has begun on the public road linking Lindy Lane to the driveway system
serving said parcels. Residential plan checking and preliminary site and
driveway grading (contingent upon a building plan) may proceed prior to
completion of the aforementioned public street. No occupancy until road
is completed. Furthermore, subject map shall not be recorded until Nellis'
Tract No 6310 is recorded.
PASSED AND ADOPTED this 12th day of March, 1979, at a regular meeting of the
Planning Commission of the City of Cupertino, State of California, by the
following roll call vote:
