Subject: Director's Minor Modification, DIR-2009-28, to modify a previously approved Use
Permit (2-U-86) to allow Pre-Kindergarten instruction and the renovation of
approximately 2,100~square feet including the enclosure of 894 square feet of covered
outdoor/storage space and other exterior modifications located at 10120 North De Anza
Boulevard in a Mixed-Use Planned Development Zone (P).
Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval
of mynor changes in a project. The Director reports his decision to the City Council
and Planning Commission in time to allow an appeal of the decision within
fourteen calendar days.
BACKGROUND:
The subject property is St. Joseph's of Cupertino Elementary School located along the easterly side
of North De Anza Boulevard approximately 550 feet north of Stevens Creek Boulevard. The school
was constructed in 1956 with f ourteen classrooms (approximately 540 students) -two classes per
grade level for Kindergarten through Eighth Grade.
DISCUSSION:
Proposed Renovation
The school is requesting the addition of
apre-kindergarten program, which
must comply with State licensing
regulations with respect to minimum
indoor/outdoor space and other
safety/facility criteria. The proposed
project consists of the following:
• A 2,100 square foot renovation of an
existing classroom including the
enclosure of a 262 square foot of
covered outdoor space;
• The conversion of an existing 632
square foot storage area into a
permanent structure to be used as a
music and homework room.

The proposal project is within the roofline of the existing building and will not be visible from the
public streets. In addition, the proposed renovation is consistent with the City's development
regulations and is compatible with the existing building u1 terms of visual appearance and scale.
Maximum Number of Students
Some of the classrooms have been converted into multi-purpose rooms such as a computer room
and library. The Pre-Kindergarten program adds 35 students to the existing enrollment. Per the
applicant's request, the proposed project will result in a total of 13 classrooms, 12 of which have a
maximum enrollment of 36 students per classroom and the new Pre-Kindergarten classroom with
an enrollment capacity of 35 students. The new total enrollment is projected to be 467, which will
be within the existing approved maximum capacity of 540 students for the school. There is enough
parking onsite to accommodate the addition of the Pre-Kindergarten program.
ACTION:
The Director of Community Development deems the modification minor and approves the
modifications to St. Joseph's of Cupertino School, with the following conditions:
1. MAXIMUM ENROLLMENT
The maximum enrollment for the school shall not exceed 540 students.
2. EXTERIOR COLOR
The exterior building color and material shall be compatible with the existing building. The
final building color and material shall be reviewed and approved by the Director of
Community Development prior to issuance of building permits.
This approval of the modification is effective October 7, 2009. The fourteen-calendar day appeal
period will expire on October 21, 2009.
