Chapter 19.132 of the Cupertino Municipal Code allows for administrative approval of minor changes in a project. The Director reports her decision to the City Council and Planning Commission in time to allow an appeal of the decision within fourteen calendar days. BACKGROUND: Since 2006, Apple, Inc. has occupied the project site consisting of a one-story industrial office building at 20400 Mariam Avenue. The applicant, Tom Hernandez of Apple, Inc., is requesting approval of a Director's Minor Modification to construct a 14 ft. by 55 ft. accessory building (See Attachment A) at the rear of the industrial office building. DISCUSSION: The accessory building will primarily accommodate storage of IT (information technology) equipment in atemperature-controlled environment, and general office materials for a small portion of the building. The proposed accessory structure is a modular building that will have an exterior stucco-like finish and a tan color to match the existing office building. Since the new accessory building will replace an existing storage trailer, existing parking spaces will not be displaced. ACTION: The Director of Community Development deems the modification minor and hereby approves the modification application on October 1, 2009. Please note that approval of the modification application is not effective until the appeal period has passed and no appeals have been filed within the appeal period. The fourteen calendar day appeal period expires on October 15, 2009. If an appeal is filed, a public hearing will be scheduled before the Planning Commission.
