A RESOLUTION OF THE CUPERTINO CITY COUNCIL AUTHORIZING
TELECONFERENCING FOR LISTED SUBSIDIARY BODIES PURSUANT TO
GOVERNMENT CODE SECTION 54953.8.6
WHEREAS, Government Code section 54953.8.6 permits a legislative body, such
as a City Council that established a subsidiary body meeting the definition contained in
Government Code sections 54952(b) and 54953.8.6(b)(1) (“eligible subsidiary body”), to
authorize eligible subsidiary bodies to use teleconferencing; and
WHEREAS, the City Council of the City of Cupertino has established the following
eligible subsidiary bodies: Arts and Culture Commission, Audit Committee, Bicycle
Pedestrian Commission, Economic Development Committee, Housing Commission,
Parks & Recreation Commission, Planning Commission, Public Safety Commission,
Sustainability Commission, Technology, Information and Communications Commission,
and Teen Commission; and
WHEREAS, the City Council has considered the circumstances and needs of the
listed eligible subsidiary bodies, including public access, member participation, and the
efficient conduct of public business; and
WHEREAS, the public has been made aware of the audio-visual remote
participation that is available for use by the City’s eligible subsidiary bodies in connection
with their regularly scheduled meetings and has been provided the opportunity to
comment in-person at the physical location of meetings held by the eligible subsidiary
bodies; and
WHEREAS, the City Council finds that allowing eligible subsidiary bodies to use
teleconferencing enhances public access and participation, and promotes the attraction,
retention, and diversity of such eligible subsidiary body members.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
Cupertino does hereby resolve as follows:
1. The foregoing recitals are true and correct and are incorporated herein by
reference.
2. The City hereby authorizes the following eligible subsidiary bodies to conduct
teleconference meetings pursuant to Government Code section 54953.8.6, subject
to compliance with all applicable provisions of the Ralph M. Brown Act and any
implementing policies adopted by the City Council.

c. Bicycle Pedestrian Commission
d. Economic Development Committee
e. Housing Commission
f. Parks & Recreation Commission
g. Planning Commission
h. Public Safety Commission
i. Sustainability Commission
j. Technology, Information, and Communications Commission
k. Teen Commission
3. A quorum of members of an eligible subsidiary body must still participate in
person at the physical location of a meeting before business may be conducted.
4. Any eligible subsidiary body authorized under this resolution shall comply with
all requirements applicable to teleconference meetings, including any
requirements regarding public access, member participation, and notice as
provided by law.
5. This authorization shall remain in effect for six (6) months from the date of
adoption and may be renewed by subsequent council action consistent with
Government Code section 54953.8.6, and in all events is subject to the statutory
sunset date of January 1, 2030.
6. No other subsidiary body, including the Library Commission, is authorized by
this resolution unless and until separately approved by the City Council.
7. This resolution may be reviewed, modified, or revoked by subsequent action of
the City Council at any time, consistent with applicable law.
8. This resolution shall become effective immediately upon adoption.
