HomeMy WebLinkAboutPC Reso 202218 -TM -79 RESOLUTION NO. 2022 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO RECONFIGURE FOUR LOTS OF RECORD. APPLICANT: Michael G. Pisano ADDRESS: 10201 Hillcrest Road, Cupertino, CA 95014 SUBMITTED: July 31, 1979 LOCATION: West side of San Felipe Road at the westerly terminus of Alcalde Road FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of December 10, 1979. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is granted based upon Exhibit A 4th Revision of Application 18 -TM -79 as may be modified by additional conditions contained herein. 16. The grading concept and building location for each lot shall substantially reflect Exhibit A 4th Revision of Application 18 -TM -79. The Director of Planning and Development or designee, shall review and approve subsequent building permit applications based upon Exhibit A 4th Revision and the policies established below. a. Pad elevations. The finish vertical elevation of the vehicular turn- around pads for each building site shall be within 10 ft. of the finish elevation designated on Exhibit A 4th Revision. Mass grading of building sites is not permitted. Permits to grade building sites may be issued only in conjunction with building permit for residential structures. Private roads and individual driveway approaches for each site may be graded concurrently with the main public road. b. Retaining walls may be employed to resolve ground stability problems or minimizing grading. c. The project engineer shall submit a plan to prevent soil erosion. The applicant or a subsequent lot owner may appeal to the Director of Planning's decision regarding the above design standards 16(a -c) to the Planning Commission. The Planning Commission may review the appeal as an unfinished business agenda item. -2- 18 -TM -79 Resolution No. 2022 (continued) 17. No grading shall be initiated during the period between November 1st through March 31st. If a developer chooses to grade during these months, he or she must present a certificate of insurance naming the City as co -ensured or may in lieu of insurance, must post a bond or letter of credit with the City in a sum sufficient to repair possible damage to public or private property resulting from ground failure or extensive sedimentation. 18. Prior to recordation of the final map, all owners of property which is contiguous to the proposed road right-of-way for San Felipe Road, as described on Exhibit A 4th Revision, shall sign an offer of dedication for said road right-of-way.
