RESOLUTION NO. 2004
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF A USE PERMIT TO CONSTRUCT
A 7,500± SQ. FT. COMMERCIAL OFFICE STRUCTURE IN A
P (PLANNED DEVELOPMENT) ZONING DISTRICT.

FINDINGS AND SUBCONCLUSIONS:
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of October 22, 1979.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The approval is based upon Exhibit A 1st Revision (Configuration C) and
B of Application 27-U-79 as may be modified by additional conditions
contained herein.
16. The approval is contingent upon the abandonment of Mann Drive as defined
on the official recorded Plan Line for Stevens Creek Boulevard.
17. In order to ensure that the off-street parking supply is consistent with
expected demand, commercial retailing activities shall be limited to
approximately 2,500 sq. ft. of gross floor area.
18. The applicant shall record a covenant obligating existing and future property
owners to provide reciprocal ingress/egress easements with the adjoining
property owners to the west at such time in the future as the City or
County can require the same of the adjoining property owner. Said covenant
shall be approved by the City Attorney and recorded prior to the issuance of
building permits.
19. The applicant shall cause an acoustical report to be prepared for the purpose
of designing a suitable noise attenuation barrier between the peripheral
parking lot and adjoining single-family residence. The design and location
shall be reviewed by the Architectural and Site Approval Committee.
