HomeMy WebLinkAboutPC Reso 199422 -TM -79 RESOLUTION NO. 1994 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY 3.75 GROSS ACRES INTO 41 TOWNHOUSE PARCELS AND ONE PARCEL TO BE HELD IN COMMON OWNERSHIP. APPLICANT: Gardenview Terrace (John Rintala) ADDRESS: 10350 South De Anza Boulevard, Suite 2A, Cupertino, CA 95014 SUBMITTED: September 7, 1979 LOCATION: West side of Gardenside Lane and Poppy Way approximately 100 ft. northerly of Rainbow Drive. FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and sub.conclusions as set forth in the minutes of the Planning Commission meeting of October 8, 1979. CONDITIONS: 1-14. Standard conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumberated herein shall apply. 15. The approval is based upon Exhibit A 1st Revision of Application 22 -TM -79 as may be amended by additional conditions contained herein. 16. The applicant shall record a covenant restricting sales price, resale, procedures, etc. per the requirements of the City's Below Market Rate housing program on four units within the subdivision. Said covenant shall be recorded simultaneously with the filing of the final subdivision map and shall be subject to review and approval of the City attorney. 17. All applicable subsections of Section 13.5 and 13.6 of the RlC Ordinance (Ordinance Number 664) regarding street improvement requirements and covenants shall apply to the subject development. The applicant shall be required to install half -street improvements plus an additional 10 ft. along the entire frontage along the planned extension of Gardenside Lane subject to the review and approval of the Director of Public Works. PASSED AND ADOPTED this 8th day of October, 1979, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote.
