FT. SPACE LOCATED IN A COMMERCIAL ZONING DISTRICT. APPLICANT: Edward Yamaoka ADDRESS: 19665 Stevens Creek Boulevard, Cupertino, California 95014 SUBMITTED: September 7, 1979 LOCATION: Northeast corner of Stevens Creek Boulevard and Portal Avenue FINDINGS AND SUBCONC.LUSIONS Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of October 8, 1979. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions enumerated herein shall apply. 15. The approval is based upon Exhibit A of Application 15-U-79 which describes the general location of the 3,200 sq. ft., 92 seat capacity cocktail lounge. 16. Live music, limited to a single, non -electrically amplified piano is permitted subject to the noise performance standard described in Condition 17. 17. Sound from recorded or live music shall not penetrate beyond the property line separating the commercial center from adjoining residential area. The sound attenuation properties of the building and masonry sound barrier shall be tested in the evening (midnight) prior to occupancy of the cocktail lounge and compared to the live music condition. Appropriate acoustical treatment must be installed if required to maintain the original non music sound level condition. 18. The applicant shall repair any major pavement deficiencies in the Portal Plaza Shopping Center parking lot subject to the review and approval of the Director of Public Works. Said repairs shall be completed to the staff's satisfaction prior to issuance of building permits. 19. The masonry barrier separating the Portal Plaza site from adjoining residences shall be raised in height at a minimum of 8 ft. measured from either side of the wall. 20. The existing vehicular barrier located at the east end of the service alley shall be modified to prohibit the movement of bicycles and motor- cycles. -2- 15-U-79 (Amended) Resolution No. 1991 (continued) PASSED AND ADOPTED this 8th day of October, 1979, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioners Adams, Blaine, Claudy, Koenitzer NAYS: Chairman Gatto ABSTAIN: None ABSENT: None APPROVED: John'M.
