HomeMy WebLinkAboutPC Reso 195311 -TM -79 RESOLUTION NO. 1953 OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING APPROVAL OF A TENTATIVE MAP TO SUBDIVIDE APPROXIMATELY 1.3 ACRES INTO EIGHT RESIDENTIAL CLUSTER PARCELS AND ONE LOT TO BE HELD IN COMMON OWNERSHIP. APPLICANT: J. Guy Farthing ADDRESS: 1348 Montclaire Way, Los Altos, California 94022 SUBMITTED: May 4, 1979 LOCATION: Southeast corner of Homestead Road and Lucky Oak Court adjacent to and westerly of the Stevens Creek Watercourse ------------------------------------------------------ FINDINGS AND SUBCONCLUSIONS: Approval is recommended subject to the findings as set forth on Page 1 and subconclusions as set forth in the minutes of the Planning Commission meeting of July 9, 1979. CONDITIONS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated herein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. The approval is based upon Exhibits A and A-1 of Application 11 -TM -79 as may be amended by additional conditions contained herein. 16. The developer shall initiate a homeowners association for the purpose of maintaining a common area referred to as Lot 9 on Exhibit A. The applicant shall comply with Section 13.6 of Ordinance 664 regarding the establishment of the association and requirements of improvements and maintenance. 17. The applicant shall dedicate an access easement to the Santa Clara Valley Water District encompassing the 100 -year flood plain area and the 15 ft. setback area adjacent to the flood plain. 18. The applicant/owners shall agree to expand the access easement to cover all of the paved surface area of Lucky Oak Court and shall agree to sign joint maintenance agreements for said drive with the adjoining homeowners association.
