RESOLUTION NO. 1950
OF THE PLANNING COMMISSION OF THE CITY OF CUPERTINO
RECOMMENDING APPROVAL OF TENTATIVE MAP TO MODIFY
PROPERTY LINES FOR THREE EXISTING PARCELS CONSISTING
OF A TOTAL OF APPROXIMATELY .8 OF AN ACRE.

LOCATION: Southwesterly terminus of Miramonte Road approximately 350 ft.
easterly of Stevens Canyon Road
FINDINGS AND SUBCONCLUSION
Approval is recommended subject to the findings as set forth on Page 1 and
subconclusions as set forth in the minutes of the Planning Commission meeting
of July 9, 1979.
CONDITIONS:
1-14. Standard Conditions to the extent that they do not conflict with the
special conditions enumerated herein. In the event a conflict does
exist, the special conditions as enumerated herein shall apply.
15. The approval is based upon Exhibits A, A-1 1st Revision and B of Application
9 -TM -79 as may be amended, by additional conditions contained herein.
16. Prior to commencement of construction on the road and/or residential
units (including grading), the applicant shall, at his own expense,
furnish a certified report from a registered tree surgeon, landscape
architect, or other similarly qualified person stipulating the measures
to be taken to protect the native trees during the construction period
and providing for their long-term maintenance.
17. In an attempt to minimize lot grading, building pads shall be located
as close to the Miramonte Road frontage as possible. The intent is to
encourage the use of the 20 ft. minimum setback provision and the
ordinance provision which permits a 15 ft. minimum setback if the garage
entrance is perpendicular to the street (garage served by a curved drive-
way).
18. The applicant, at his own expense, shall provide for dedication and
improvement of the 19 ft. right of way and turn -around as shown on the
roadway improvement drawing, labeled Exhibit B. Said dedication and
improvement shall extend the entire length of the roadway from the
turn -around to Stevens Canyon Road. A 5.5 dedication and a 5 ft. wide
public utility easement shall be dedicated along its frontages of parcels
A, B, and C,
Because of the unique character of the immediate neighborhood, full
improvements to the street section shall be deferred until the development
character of the neighborhood can be determined in conjunction with future
development proposals.

19. Prior to preparation and recordation of a final map, the applicant shall
prepare a detailed geotechnical investigation of the subject property.
If the geotechnical evaluation concludes that a seismic or geologic
hazard exists which will subject future residents and future City street
improvements from undue exposure to risk, the application shall be re-
turned to the Planning Commission for further evaluation and recommendations
to the City Council.

Planning Commission of the City of Cupertino, by the following roll call vote:
