TM-2015-01, TR-2016-28 (EA-2015-04) Petition for Reconsideration
Kirsten Squarcia, Deputy City Clerk, declares as follows:
• That she is a citizen of the United States, over the age of 18 years, and that at all
times herein mentioned was an employee / agent of the City of Cupertino.
• That on August 6, 2018, she deposited in the United States Post Office, California,
a Notice of Public Hearing, a copy of which is attached hereto.
• That said mailing list has been provided by the Planning Department and lists the
owners of property who are entitled to Notice of Hearing.
• That on said day, there was a regular communication by Unites States mail
between Cupertino, California and the addresses shown on the attached mailing
list.

PETITION FOR RECONSIDERATION
TM-2015-01, TR-2016-28 (EA-2015-04)
NOTICE IS HEREBY GIVEN that at its meeting of Tuesday, August 21, 2018 the City Council
of the City of Cupertino will conduct a public hearing to 1) consider a Petition for Reconsideration
of its decision of May 15, 2018 to detennine if it meets the requirements of Cupertino Municipal
Code (CMC) Section 2.08.096, and if reconsideration is granted, 2) conduct a hearing to reconsider
Council's decision of May 15, 2018 to deny a Tentative Map application to allow the subdivision
of 3 parcels (approximately 1.06 acres) into 5 parcels - 4 residential and 1 common (private street),
Tree Removal Pen -nit to allow the removal and replacement of seven (7) protected trees and
associated environmental review; based upon the new evidence and grounds proffered by
Petitioner, if Council detennines that the Petition meets the requirements of Cupertino Municipal
Code section 2.08.096, and approving or denying the Petioner's appeal; Application No(s).: TM-
2015-01, TR-2016-28 (EA-2015-04) Applicant(s)/Appellant(s): Welkin International (Cai Xing
Xie); Location: 10234 Scenic Blvd., APN No.(s) 357-08-014, -047. At its regular meeting of the
Cupertino Planning Commission on April 10, 2018, the Planning Commission voted (3-0-2) (Sun
and Fung voting no) to deny the applications per Resolution Nos. 6856, 6857 and 6859. Council
meets at 6:45 p.m., Council Chamber, Community Hall, 10350 Torre Avenue, Cupertino,
California. Interested parties are invited to attend and be heard. If you wish to challenge the City
Council's action in court, you may be limited to raising only those issues you or someone else
raised at the public hearing described in this notice, or in written correspondence delivered to the
City of Cupertino City Hall at, or prior to, the public hearing. IMPORTANT NOTICE: Please be
advised that pursuant to Cupertino Municipal Code 2.08.100 written communications sent to the
Cupertino City Council, Commissioners or City staff concerning a matter on the agenda are
included as supplemental material to the agendized item. These written communications are
accessible to the public through the City's website and kept in packet archives. You are hereby
admonished not to include any personal or private infonmation in written communications to the
City that you do not wish to snake public; doing so shall constitute a waiver of any privacy rights
