• That on June 24, 2019, she deposited in the United States Post Office, California, a
Notice of Public Hearing, a copy of which is attached hereto.
• That said mailing list has been provided by the Planning Department and lists the
owners of property who are entitled to Notice of Hearing.
• That on said day, there was a regular communication by Unites States mail between
Cupertino, California and the addresses shown on the attached mailing list.

NOTICE IS HEREBY GIVEN that the City Council of the City of Cupertino will hold a
hearing on the matter described below. The public is encouraged to attend and speak.

DESCRIPTION: Consideration of a hotel on a 1.72-acre site in the Cupertino Village
Shopping Center. The project would also involve demolition of two existing commercial
buildings on the sites. The development would be a new 5-story,185-room hotel including
event meeting rooms, a restaurant, and rooftop lounge and bar. A Mitigated Negative
Declaration is proposed.
At a regular meeting of the Planning Commission held on June 11, 2019, the Planning
Commission recommended to the City Council the approval of a Mitigated Negative
Declaration and applications for a proposed hotel development per resolution numbers
6876 through 6882, 4-0-1 (Takahashi absent).

Cupertino City Council will conduct a public hearing to consider a hotel on a 1.72-acre site in the

Dear Mr. Friedman,
Action Item No. 3 has been amended as underlined below. At its June 18, 2019 regular
meeting, the Cupertino City Council took the following action:
1. Conducted the public hearing; and
2. Found the project exempt from CEQA; and
3. Adopted Resolution No. 19-071 approving the Development Permit (DP-2018-03) with
an amendment to add a condition of approval to ensure that the Manager's Unit meets
the specified noise and air filtration standards; and
4. Adopted Resolution No. 19-072 approving the Architectural and Site Approval (ASA-
2018-04) with an amendment to add a condition of approval regarding modification to the
east elevation building fagade and vegetation to improve the aesthetics of the project, to
be approved by Staff; and
5. Adopted Resolution No. 19-073 approving the Fence Exception (EXC-2018-01); and
6. Adopted Resolution No. 19-074 approving the Tree removal Permit (TR-2019-11).
The resolutions that Council adopted at the meeting and were enclosed in the initial
mailing remain unchanged.

Any interested person, including the applicant, prior to seeking judicial review of any
adjudicatory decision of the City Council, must first file a petition for reconsideration with
the city clerk within ten days after the date of mailing of this notice. Any petition filed
must comply with Municipal Code §2.08.096. Due to the deadline falling on a holiday, the
last day to file a petition for reconsideration is Friday, July 5, 2019.
