Subject: Director's Minor Modification, DIR-2009-25, to allow exterior modifications at an
existing commercial building (former Harvest Restaurant location), located at 10630
South De Anza Boulevard.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow an appeal of the
decision within fourteen calendar days.
DISCUSSION:
The applicant, David O'Mara of O.M. Investments, Inc., representing Byer Properties, is
requesting approval for exterior modifications at an existing commercial restaurant building
located at 10630 South De Anza Boulevard. The restaurant building was originally developed
under HC-51,339, approved by the City Council in 1974. Over the years, the restaurant has been
occupied by Cocos, Carrows, Flames, and Harvest Restaurant. Facade improvements and an
outdoor seating area were approved under M-2003-03 in 2003. A separate Use Permit, U-2009-
04, has been filed to request approval for a separate bar inside the restaurant. The exterior
modifications are intended to accommodate Aqui Cal-Mex Grill. The proposed exterior
modifications are as follows:
• Install new trellis beams in existing patio area along west elevation
• Install new patio door on west elevation
• Install stucco (to match existing) over existing file on the patio interior walls
• Replace patio paving
• Install new exterior windows at Dining Room 3 on the east elevation
• No other building, lighting or color changes are proposed
ACTION:
The Director of Cormunity Development deems the modification minor and approves the
change as described in the plan set exhibit entitled: "Aqui Cupertino, 10630 South De Anza
Blvd Cupertino, CA" dated August 6, 2009.
The approval is effective September 2, 2009. The fourteen calendar day appeal period expires
on September 16, 2009.
