The undersigned, being first duly sworn, deposes and says: That at
all times hereinafter mentioned affiant was and still is a citizen of
the United States, over the age of eighteen years, and not a party
to or interested in the above entitled proceedings; and was at and
during all said times and still is the principal clerk of the printer and
publisher of the San Jose Mercury News, a newspaper of general
circulation printed and published daily in the City of San Jose,
County of Santa Clara, State of California as determined by the
court's decree dated June 27, 1952, Case Numbers 84096 and
84097, and that said San Jose Mercury News is and was at all
times herein mentioned a newspaper of general circulation as that
term is defined by Sections 6000; that at all times said newspaper
has been established, printed and published in the said County and
State at regular intervals for more than one year preceding the first
publication of the notice herein mentioned. Said decree has not
been revoked, vacated or set aside.

NOTICE OF PUBLIC HEARING
HOUSING ELEMENT AND GENERAL PLAN UPDATE
NOTICE IS HEREBY GIVEN that at its special meeting of Tuesday, May
14, 2024, at 6:45 p.m., the City of Cupertino City Council will conduct a
hybrid public hearing - in person at the Community Hall, City of
Cupertino, 10350 Torre Ave, Cupertino, CA 95014 and via teleconference
- to consider the 2023 - 2031 Housing Element, a part of the General
Plan, and other associated changes to the General Plan to address a
Housing Element Update required by State Law; and amendments to
the land use map. (File No. GPA-2022-001). Any interested person may
attend the meeting and provide comments. The Planning Commission
conducted a public hearing at a special meeting on Monday, April 29,
2024, and adopted Resolution No. 2024-05 recommending on a 3-2 vote
(No: Madhdhipatla and Scharf) that the City Council adopt the draft
resolution presented to the Planning Commission in substantially simi-
lar form with a modification to remove the parcel (APN: 359 08 029) not
allowed to be counted toward RHNA by HCD from the list of Housing
Priority Sites. The CA Department of Housing and Community Develop-
ment (HCD) has determined that the proposed Housing Element will
comply with State housing element law when adopted and properties
identified as Priority Housing Sites are rezoned, subject to final review
by HCD. The project is exempt from the California Environmental Quali-
ty Act (CEQA) pursuant to Govt. Code Section 65759(a).

City Council's action in court, you may be limited to raising only those
issues you or someone else raised at the public hearing described in
this notice, or in written or electronic correspondence delivered to the
City of Cupertino City Hall 10300 Torre Avenue, Cupertino, CA 95014 at.
the meeting under the Americans with Disabilities Act should email
citycierk@cupertino.gov or call 408-777-3200 at least 48 hours prior to
the public meetings to ensure their needs can be appropriately accom-
modated. IMPORTANT NOTICE: Please be advised that pursuant to
Cupertino Municipal Code section 2.08.100 written communications
sent to the Cupertino City Council, Commissioners or City staff con-
cerning a matter on the agenda are included as supplemental material
to the agendized item. These written communications are accessible to
the public through the City's website and kept in packet archives. Do
not include any personal or private information in written communica-
tions to the City that you do not wish to make public, as written com-
munications are considered public records and will be made publicly
