HomeMy WebLinkAboutPC Reso 12532-Z-74 RESOLUTION NO. 1253 OF TilE PLANNING COMMISSION OF THE CITY OF CUPERTINO RECOMMENDING the approval of a change of zone of 14.76 acres from P (Planned Development with commercial intent) zone to P (Planned Development with commercial/ industrial intent) zone. APPLICANT: Keith E. Garner, et al.. ADDRESS: 800 Oak Grove, Menlo Park, California SUBMITTED: February 1, 1974 LOCATION: Southwest quadrant of Saratoga -Sunnyvale Road at Freeway 280. ZONE: P (Planned Development with commercial intent) ACREAGE: 14.76 acres CONDITIONS AND FURTHER FINDINGS: 1-14. Standard Conditions to the extent that they do not conflict with the special conditions enumerated therein. In the event a conflict does exist, the special conditions as enumerated herein shall apply. 15. Approval is based upon Exhibit B, 1st Revision, and Exhibit C of 2-Z-74, as may be modified by additional conditions contained herein. 16. The 3.67 acre commercial portion of the site shall be developed with uses that generate no more than 16 trip ends per acre at the peak hour between 5 and 6 p.m. The 11+ acre industrial portion of the site shall be developed with uses that generate no more than 16 trip ends per acre at the peak hour. In order to comply with this condition, it will be necessary for the developer to either retain a portion of the site in an undeveloped status until traffic conditions improve and/or transit facilities develop or that a mixture of uses be developed that generate no more than 16 trip ends per acre at the peak hour. The specific commercial and industrial uses shall be evaluated at the use permit stage in terms of traffic generation factor. 17. There shall be no direct access from the property to Saratoga - Sunnyvale Road. 18. The minimum of 50 ft. of landscaping shall be maintained from the curb line in order to provide a landscaping buffer to soften the impact of development from Saratoga -Sunnyvale Road. Individual uses within the development shall not be oriented to the landscaping area in terms of front entry walks. Pedestrian access will be allowed from Saratoga -Sunnyvale Road, however, on a very limited basis. 19. The individual division lines between the commercial and industrial land uses and the two portions of the commercial site do not con- stitute approval of a division of the property. A tentative map will be required prior to legalizing the division of property. In the event the property is divided, the division of the property will not allow for separate pole signs on each individual property. 2-Z-74 Planning Comm. Resolution No. 1253 (continued) 20. Upon ninety (90) days written notice given by the City, the developer shall agree to participate in a local improvement district and enter into an agreement with the City to insure participation, provided that such a local improvement district is required. In the event a local improvement district is not formed the developer shall participate in the cost of providing roadway improvements and signalization to the extent that it can be shown that the property benefits from said improvements. The benefit shall be determined in the same manner and assessment formula as would be utilized in a local improvement district. Said improvements shall consist of roadway improvements including signalization in accordance with a traffic circulation element (plan line) approved by the City Council. 21. In the event that a traffic signal becomes warranted at Valley Green Drive and Saratoga -Sunnyvale Road prior to Bandley Drive and Green- leaf Drive being constructed that developer participate in the con- struction of a temporary traffic signal at Valley Green Drive and that said participation be credited towar he participationor the permanent traffic signal at Greenleaf Drive and Saratoga -Sunnyvale Road. ----------------------------------------------------------------------------- PASSED AND ADOPTED this 8th day of April, 1974, at a regular meeting of the Planning Commission of the City of Cupertino, State of California, by the following roll call vote: AYES: Commissioners NAYS: None ABSTAINING: None ABSENT: None ATTEST: James H.
