Associate Planner Cowan summarized the past history of the property,
as noted in the December 6, 1974 memo from the Planning Director.
The staff feels the present zoning is inconsistent with the General
Plan and the general topography and character of the area and, therefore,
recommended approval of the application for rezoning.

hearing since there were no comments from the audience.

3. Application 13—Z-74 of SAN CARLOS HOMES & DEVELOPMENT CO.:
REZONING 20.7 acres from A (Agricultural/Residential - 10,00(
sq. ft. minimum lot) to P (Planned Development with resident-
cluster use intent with approximately 3.6 dwelling units per
acre) or whatever zone may be deemed appropriate by the
Planning Commission. Said property is located southerly of
and adjacent to Voss Avenue at its westerly terminus.
First Hearing continued.

4. CITY OF CUPERTINO: Public Hearing for annual review of
five-year capital improvement program.
The Director of Public Works submitted copies of the new five-
year capital improvements program.
Comm. Woodward asked about the Community Development Act, as it
relates to this five-year capital improvements program. The
Director of Public Works said this relates chiefly to capital
improvements and the Community Development Act lends itself to
the social aspects. The two can very well go hand in hand.
The Planning Director stated that after the citizen input has been
analized it may be found that some items in the five-year capital
improvements program can be lifted out of this program and placed
into the Housing and Community Development Act expenditure. I
Comm. Gatto was assured by the Director of Public Works that
something that has not even been thought of as yet could be in-
serted into the Program at any time. If it is something"is needed
immediately the City Council can insert it immediately.
Mr. Nick Szabo, 10235 Creston Drive, President of the Creston
Homeowners Association, said they are experiencing a traffic
problem and asked the Planning Commission to add to the Program a
traffic light at the intersection of Starling Drive and Foothill
Blvd. It is their only exit from that subdivision for some 250
homes to Foothill Blvd. It is extremely difficult to make left
turns at peak hours. They have a couple of thousand trips of
Kaiser-Permanente cement trucks (that just don't stop very quickly
to contend with. Even though this does not have the proper number
of warrants, he contends the hazard justifies it.
Comm. Cooper was answered that this would have to be a cooperative
effort on the part of Cupertino, Los Altos and the County. The
Director of Public Works said that until this meets warrant, we
would never get the cooperation from the other jurisdictions.

The Director of Public Works said another study will be made and a
subsequent recommendation will follow.
Mr. Szabo said the school bus turns left at this intersection.
There followed a discussion of the submitted report. The Director of
Public Works said the east side is pretty well served by parks. Linda
Vista Park serves the southwest portion, and Monta Vista and Varian
Parks will serve the western portion of the City.
Comm. Cooper said she would like to see a higher amount of money put
into park land acquisition. She would like to see something in the
Program to speak to the purchase of land in the section behind Gemco.
She would like to pass on to the City Council the need for a park in
this general area, to serve the many children in that area. She would
like to see this as a priority item; perhaps it could be considered in
the Housing. and Community Development Act deliberations.
Chairman O'Keefe asked for comments from the audience.

Moved by Comm. Cooper, seconded by Comm. Gatto to recommend to the City
Council that a higher amount of money be designated, or set aside, in
land banking each year to permit the City to be in a better position
to purchase it as land becomes available.
Comm. Gatto said -he seconded the motion for discussion. Last year,
when the parks were reviewed by the Planning Commission, there appeared
to be a need for additional parks in only two small areas: Garden Gate
area and a small piece near Wolfe Road. Comm. Cooper said one of the
concerns of the people is the need for some open area in the core area.
Comm. Woodward agreed that it is nice to put money aside for land.
We have to identify our needs, however. He would be mQre.in favor of using,
say, $100,000 to develop Linda Vista Park and then the following year to
start setting aside money for future park land acquisition.

Moved by Comm. Woodward, seconded by Chairman O'Keefe, to take the
position in favor of development of parks and deferment of saving
for additional land inasmuch as no specific need is identified.
Comm. Gatto felt there was the need for a happy balance somewhere
between park development and park land acquisition.
Comm. Cooper suggested that perhaps funds from some other catego
could be shifted to park and open space acquisition.
Comm. Gatto would: like to see land acquisition separate from the
parks category.
Chairman O'Keefe withdrew his second and Comm. Woodward withdrew
his motion.
Comm. Gatto said there should be a study of historical buildings
and/or grounds made very soon. If we wait too long they will no
longer be available.
Moved by Comm. Gatto, seconded by Chairman O'Keefe that there
should be a separate category for structures or sites that evolve
from the historical preservation evaluation.

As to street improvements, Comm, Woodward was in favor of adding
Stevens Creek Blvd., between Bubb Road and Byrne Avenue. The
Director of Public Works said that once the new plan line is
established (hopefully before the end of the fiscal year) the
property owner can petition the City to purchase the land necessa
for these improvements.
Bicycle lanes were discussed next. The Director of Public Works
said it runs $1000 per mile for development of bicycle lanes.
There will be arterial bicycle lanes throughout the County, and
Cupertino will augment them.
After further discussion, it was moved by Comm. Gatto, seconded
by Chairman O'Keefe to take this matter off calendar for the
present time and to readvertise it when appropriate.

5. Application 34-Z-74 of RODERIC E. & GLORIA G. CASTOR: PREZONING
0.30 acres from Santa Clara County R-1 (Residential, single-
family, 10,000 sq. ft. per dwelling unit) to City of Cupertino
P1--10 (Residential, single-family, 10,000 sq. ft. per dwelling unit)
or whatever zone may be deemed appropriate by the Planning
Commission. Said property is located at 22433 Santa Paula Avenue.
First Hearing.
Associate Planner Cowan said this property is in a semi -developed
area in Monta Vista. Application was filed in response to our annexation
policy in regard to water service. This proposal is consistent with
Cupertino's infilling plan.
Chairman O'Keefe asked for comments from the audience. There were none.

6. CITY OF CUPERTINO: Public Hearing to consider vacation of a
roadway approximately 0.998 acres, more or less, located along
the easterly side of Blaney Avenue between Interstate Freeway 280
and Homestead Road, as provided in Section 8320 et seq. of the
Streets and Highways Code of the State of California, fixing time
and place for public hearing, and providing for notice thereof.
The Director of Public Works explained this involves the property swap
with P.G. & E, details of which can be found in his staff report of
December 6, 1974.
,Since there were no comments from the audience, it was moved by
Comm. Gatto, seconded by Comm. Woodward to close the public hearing.

Road in accordance with the staff's recommendation.

resolution, subject to City Council approval, to improve above -

The Assistant City Attorney advised that the agreement has already
been signed with no statements in regard to improvement of this
land; however, the Planning Commission can suggest it.

7. CITY OF CUPERTINO: Public Hearing to consider abandonment
of a portion of roadway, Torre Avenue, south of Homestead
Road to Interstate Freeway 280.
The Director of Public Works explained that the City has adopted a
new plan line. The original plan line required Torre Avenue, the
present one does not.
Since there were no comments from the audience, it was moved by
Comm. Gatto, seconded by Chairman O'Keefe to close the public
hearing;

owners shall incorporate said portion of Torre Avenue into their

8. CITY OF CUPERTINO: Public Hearing to consider an amendment to
City Ordinance No. 220 regulating residential single-family (R-1) zones.
Associate Planner Cowan explained the staff's recommended change of
wording for clarity.
Since there were no comments from the audience, it was moved by
Comm. Gatto, seconded by Comm. Cooper to close the public hearing.

9. CITY OF CUPERTINO: Public Hearing to consider an amendment to
City Ordinance No. 002(v) regulating activities in the Park and
Recreation Zone.
The Planning Director said this revision was prepared to redefine
permitted land uses in public parks and to provide the Planning
Commission with the opportunity to review park site plans prior to
adoption.
[he Assistant City Attorney recommended new wording for. Section 6.2,
Drior to final recommendation to the City Council. lie further answered
2omm. Woodward that Section 6.3 should so state that there Shall be
xiblic hearing on this, as required under State Law.

10. CITY OF CUPERTINO: Public Hearing to consider 1973
Comprehensive General Plan.
a. Hillsides
The Planning Director noted that Exhibit C-1 includes a statement
of policies for the hillsides. There has also been some additiona
work on the slope/density formula.
Exhibit C-1 as discussed first. Comm. Cooper would like a list
of definitions included. Comm. Gatto suggested rather than a
description of the actual curve, that instead the paragraph
reference the graph showing the curve. Then the graph can be
modified without disturbing the policy statements.
It was decided the second paragraph on page 4 would be reworded.
Comm. Cooper would like to cite some examples for Policy Statement
#1 in order to clarify it.
Chairman O'Keefe asked for comments from the audience.
Mr. Lawrence Hill, Saratoga, asked about Policy Statement 3. In
the case of the Catholic Church property, a good portion of that
is an existing cemetery. The portion close to the core area could
be sold to another party. If the north side is going to be develol
now and he wanted to know if an overall plan for that property
that may be sold must be included. The Planning Director said
this was the basic intent on these larger properties Chairman
O'Keefe said that although the parcel is not directly related,
nevertheless, it should be included in the overall plan.
Comm. Cooper wanted to include the character of the area that the
City is striving for.

Comm. Woodward wanted Section 5 updated. He said the expansion and
contraction of the Urban Service Area should be based on the General
Plan.
Ms. Ann Anger, Monta Vista, said she is concerned about large acreages
clustering the dwelling units intc a small area and being given credit
for much unbuildable land. She cited De Anza Oaks as a prime example.
Mr. Sam Bradlyn, Cupertino, said that in the lower foothills we should
not use cluster housing to increase density. Only the actual, usable
acreage should be used to compute density.
Mr. John Finnemore, Cupertino, said that item 6 seems to be in conflict
with item 2. The Planning Director explaind the difference between them.
Comm. Gatto said additional credit may be given if any property develop-
ment meets a social need. The character of the neighborhood should be
of prime concern. Comm. Gatto felt it would be a grave mistake to
close doors to the developers to design around the amenities. He felt
that each application should be evaluated on its own merits. There
are too many unknowns..

Chairman O'Keefe would like to leave the door open for the developers
to come in with something imaginative. He would prefer to b._. more
general in the policy statements.
Comm. Woodward said we are talking about planned communities here, which
are Lsr;e. He could see nothing wrong with two large developments that
were entirely different, as long as they were attractive within their
environment.
Comm. Cooper would like to be able to give the developer some direction
so he won't have to keep coming back in with proposals.
Comm. Gatto wanted to add the statement to the effect that the hills aie
to act as a backdrop to the valley floor and the developers should
recognize this.
Associate Planner Laurin said the conclusions in the December 6, 1.974 memo
;could be essentially the same, although the Planning Commission has decided
to put a curve (or knee) in the upper end of the curve rather than cut it
off sharply. The number of d•.-elling units will change very .lighciy with
this chanr;c. lie went on to explain his memo of December 6th and its
accompanying attachments.

Mr. Finnemore brought to the attention of the Planning Commission
some implications of this document. Associate 1" :ner Laurin
explained the curve is generally the same as th• .untv's. The
lower land density should coincide with CupertL. in the flat
land.
Mr. Finnemore feels we are not providing for a nsit::icn. Ile
contends we are not treating the upper foothills the same as the
lower foothills. As a iesult, we will have many requests to have
upper foothill property treated as lower foothills.
Comm. Woodward submitted the thought that the hills themselves
constitute the transition.
Ms. Ann Anger said she was hoping for lower density than she has
seen here. She is afraid we will end up with too much density in
our hills.
Moved by Comm. Gatto, seconded by Chairman O'Keefe to continue
this discussion to December 18, 1974.
