(a) Hillsides Public Hearing to consider 1973 Comprehensive The Planning Director announced that anyone interested in the field trip on October 5, 1974, beginning at 9 A.M., should notify him within the next couple of days so he can arrange transportation.. Juanita McLaren, 22101 Lindy Lane, Cupertino, urged that the field trip include the two outstanding homes presently being constructed on Candy Rock Mountain by Stuart Kadas. Associate Planner Laurin stated that the Planning Department has recently received their copy of the final study of the Santa Cruz Mountains. Copies have been r.'.ade of those portions affecting Cupertino. The Associate Planner next reviewed the color -coded General Plan study Map, showing the Mc to Bello Ridge Study Area and Conservation Development Plan. Until this date, we have not permitted septic tanks. However, under certain conditions, this policy may change. The iAssociate Planner also felt it was important to include in the computations those properties in the Williamson Act since development of those properties could make a significant difference in population. MINUTES OF THE SEPTEMBER 21 , 1974 PLANNING COMMISSION MEETING Associate Planner Laurin said three different studies yit:l.d a population density range between 3800 and 5600. This figure could be raised to the projected 10,000 by means of either a blanket increase or increases given certain areas. Counc. Adams asked about impacts resulting from the different density levels. The Associate Planner said that in regard to traffic impacts, we don't get a single answer. It depends on the kinds of traffic as well as the numbers, or traffic distributions. The general conclusion here is that the existing roads would be adequate. Improvement of Monte Bello Road would be very expen- sive and would upset the ecological balance up there. As to the schools, the Associate Planner said that if it is assumed that the neighborhood school concept is dead, then the children from this area could be bussed to existing schools. However, if we pursue the neighborhood school concept, a few schools would be needed: one in the Seven Springs Ranch area and one in the Catholic Church area. Chairman.O'Keefe answered Comm. Adams that the neighborhood school concept is very important in the Cupertino School District. Alternate uses of schools are being studied. Abandonment of schools in order to build new schools would be very difficult to accept. As to the matter of water and sewers, septic tanks will be per- mitted under certain circumstances. The Associate Planner answered Comm. Gatto that the boundaries werE taken directly from the PPC map. There was some discussion about whether or not residential units should be allowed in the fault zone. Comm. Gatto requested a graphic presentation of traffic impacts as related to the different population levels. Comm. Cooper asked for charts of the alternate formulae and smaller copies of the maps, etc. She would also like a check list for the Commissioners to use, to better keep track of progress made and items yet to be covered. Comm. Adams would like to see economic alternates, also. Moved by Comm. Gatto, seconded by Comm. Adams to continue this public hearing to Saturday, October 5, 1974, at 9:00 A.M. CITY i't:RTINO: Amendment to Ordinance 220(e), Cluster Ordinance, establishing new regulations affecting residential cluster develop- ments. First Hearing continued. Associate Planner Cowan went through the Ordinance, page by page, pointing out the recommended changes. There was some discussion. about the difficulty of computing the acreage credits. It was decided that if land occurs within a site that is not developable because there is something else on it, it should not be given credit. There was the consensus of opinion that in Section 9, there should be another clause that speaks to undevelopable or unusable land. Comm. Gatto pointed out that Section 11 C and E would be very difficult to apply to air rights condominiums. This will be studied further. Section 13 should indicate that space will be needed for storage of recreation vehicles. ction 13.5 C needs some rewording as t6_-.z�evelzs et t=avrved open- space, There should be a section stating when the Architectural and Site Approval Committee shall review the development plan. The definitive plan will be reviewed by the PlanningCommission and the precise plan goes to the Architectural and Site Approval Committee for. review. Section 17 is going to be reworked. HON & ETELVINA A. HOMEM: REZONING single lot from R3-2.2 (Residential, multiple, 2,200 sq. ft. per dwelling unit) to R2-4.25 (Residential, duplex, 4,250 sq. ft. per dwelling unit) or whatever zone may be deemec appropriate by the Planning Commission. Said property is located at the southeast corner of the intersection of Alpine Drive and Foothill Blvd. First Hearing. ' A transparency of the area was displayed on the screen. The Associate Planner Cowan explained the applicant's request to rezone from R3 to R2. This is in an essentially R3 area, with a few R2 lots in the area. Mr. Homem offered to answer any questions. He said he is anxious to get his building permit and start construction. There were no comments from the audience. Moved by Comm. Gatto, seconded by Comm. Adams to close the public hearing. UNFINISHED BUSINESS: 5. Consideration of proposed amendment to the 1964 General Plan concerning the land use element for. the Valley Floor Infilling. (Returned to Planning Commission for report, except for the Flood Plain) The Planning Director said [he Council chose to delete the flood plain from discussions on the :infilling of the valley floor at this time. He suggested the discussions at this meeting center around Area 21A, the northwest corner of Stevens Creek Blvd. at Foothill Blvd., and the commercially oriented use on Stevens Creek Blvd. at Peninsula Avenue. Mr. Harry Cappel, 7603 Kirwin Lane, San Jose, asked that he be allowed to develop a low intensity professional office complex on the 2.8 net acres at Foothill and Stevens Creek Blvd. He said there was no opposition to his proposal at the City Council meeting. Ms. Ann Anger, 10185 Empire Avenue, Monta Vista, said she would like to see a mini -town and country center on this site. She added that she hopes that this will be developed as a planned development and to make sure no 7-11 type operation gets in there. Comm. Woodward asked if it was within the purview of the Planning Commission to restrict operating hours of a development. The Assistant City Attorney said that in order to regulate operating hours it would have to relate to the land use rather than the type of operation. emm :Woodward a ked the staff—zi Si.lver Oak ary The Planning Director went over the alternate configurations for Silver Oak Way. Comm. Woodward said we must be careful about commercial development backing up against residential property. If the development here faced out, the rear of the property could be made into a green area, possib._y a mini -park. Comm. Cooper said this property is unique in one respect -- the large Permanente trucks going around this corner. This is an undesirable area for residential. Commercial use would not be good because it would bring in additional traffic. She would be in favor of considering a cluster development here. She noted that the noise level at that corner is incredible. Comm. Woodward was in favor of facing the commercial out, toward Foothill Blvd. Comm. Cooper said she would be in favor of allowing strictly professional buildings here. Mrs. Lucien H_ertert, San Juan Road, suggested that if it were zoned residential there could be a wide strip of landscaping between the residential and Foothill Blvd. Chairman OtKeefe felt that incentives should be provided for the development of this very important corner. MINUTES OF THE SEPTEMBER 23, 1974 PLANNING COMMISSION MEETING Mr. Cappel said the City Council was in favor of his developmett proposal for commercial/professional use. The Planning Commission decided the report back to the City Council would state that the area southerly of the northwest corner of Foothill and Stevens Creek Blvd. should be placed in a professional office/commercial planned development category with an underlying zone of residential, 4 — 7.6 dwelling units per acre. There shall be no access to the commercial development from Silver Oak Way. The discussion then turned to the "Old Monta Vista" area along Stevens Creek Blvd., bounded by Peninsula Avenue, University Way, and freeway. Mr. John Mangano, 10204 Portal Avenue, Cupertino, stated that he is interested in Areas 9, 17 and 18 as indicated on the map. He said he was asking that these properties remain commercially zoned so he won't suffer grave economical loss which he will seek to recover through the courts. The Planning Director answered Comm. Cooper that this property was designated for duplexes. There is an existing d?•felling unit on the property. Ms. Ann Anger said she was very disappointed that the State did not take that property along Alhambra all the way down to Stevens Creek blvd. She pointed out the current land uses of the lots along Peninsula Avenue. She suggested the Mangano properties and those to the south be commercial and those properties to the north should be residential. Comm. Adams was hesitant about changing any land use determinati at this point, after spending so much time on them previously. Comm. Cooper said commercial zoning would be appropriate on that corner where there exists commercial development. She thinks it would be best to encourage residential to be back up Santa Clara Avenue and to encourage upgrading of the existing commercial. Mr. Mangano said if his property is downgraded he will have to seek restitution through the courts. Comm. Woodward said he :would like to keep commercial out of Santa Clara Avenue. Comm. Gatto said the most realistic approach would be to define the zoning pattern of the most desirable uses in that area. This would tend to minimize the commercial traffic.
