A letter from Valley Church on Stelling Road regarding the application for a bowling alley on Stelling Road. B. A letter from developer Richard Kehrig regarding the applica— tion for a bowling alley at the southwest corner of Homestead and Stelling. C. A memo from Councilman Jackson regarding EIR. D. A letter from the owners of Villa Serra registering opposition to the proposed bowling alley at the southwest corner of Homestead and Stelling Roads. ORAL COMMUNICATIONS -- None NOTE: In order to decrease the length of the meeting, no item will be initiated after midnight. PUBLIC HEARINGS 1. Application 20-U-73 of the WESTFIELD COMPANY: USE PERMIT to allow construction of two 32,340 sq. ft. light industrial buildings, a total of 64,680 sq. ft. Said property is within a P (Planned Development with light industrial intent) zone and is located at the southeast corner of the intersection of Pruneridge and Tantau Avenues. First Hearing continued. The Associate Planner stated this application was previously continued to allow the staff time to sit down once again with the principals to try to resolve the traffic situation. Two major owners have agreed to allow Westfield to develop without the penalty of uncommitted properties. The Director of Public Works reviewed the meeting with Hewlett Packard and Watkins Johnson. Mr. Lester was not present at this meeting so he did. not respond to this proposal. The Director said they have decided to establish the sq. footage per employee and subtract the mechanical area. There was a discussion about how this would be monitored. There will be a review of the Use Permit when an applicant wishes to remove mechanical equipment from his building and replace that area with employees. He noted that 50% of the employees will be leaving work before the peak hour. PC -155 Page 3 PC -155 I MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING COMMISSION Page 4 { Architect Jack Rominger, representing Watkins Johnson, was prepared to answer any questions, Mr. Walter Ward, General Manager of Vallco Park, said he had not attended this meeting because he was not in town at the time. He said this does not establish a precedent in Vallco Park. He further suggested a condition wherein the applicant shall contribute to a local transit system. He suggested another condition wherein the applicant shall agree to participate in the Tantau overcrossing. Condition 16 requires a 10 ft. landscaped area; but a 20 ft. landscaped area is in the agreement on the property adjacent to Santa Clara. The rest of Vallco Park has conformed to this and Mr. Ward does not see why this should be waived for Westfield. Mr. Terry Rose, representing the Westfield Company,, stated that 25 ft. of landscaping would foul-up his parking layout. It is his contention the ordinance calls for either a 25 ft. landscaped buffer or a 6 ft. masonry wall. The staff is requesting the masonry wall be 8 ft. high. He does not believe the homeowners want a 8 ft. wall between them and the Park and they would like the opportunity to discuss this with the neighbors. As to Condition 19, Mr. Rose said he understood the Tantau overcrossing will be included in the LID. In the shopping center discussions, Vallco Park has agreed to pay for the overcrossing. Mr. Rose wanted to address Condition 20 - Off -Street Parking. He feels the Planning Commission would require as much parking over the minimum that the property allows. To allow for shift overlapping and to prevent possible off -site parking. Residents in this area do not want employees of the industrial park to leave their cars in front of their homes. He has reduced his parking from 275 to 263 to allow for trash areas. He stated that adequate parking is a definite problem in leasing these buildings. In regard to Condition 21 - Outside Chemical Storage Tanks, Mr. Rose stated that AMI, Intersil, and Vallco Park Building No. 1 all have outside storage tanks and it seems to him that a precedent has been set. He does not know at this time whether this will be a problem. As to participating in a local transit system, Mr. Rose requested a definition of this before agreeing to it. Mr. Ward stated that on a first come first served basis without an agreement, the last property to be developed would be responsible for transit. He said he can not at this time define the transit systems or the costs involved. He would like to avoid in the future someone ending up with land that they can not develop. MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING COMMISSION Mr. S.mith, Director of Planning and Inspection for the City of Santa Clara, stated their areas of concern: 1. The Tantau overcrossing. 2. The 25 ft. of landscaping adjacent to residential. 3. Location of loading docks. He then quoted portions -of the Intercity Agreement. Mr. Rose said the distance from the residential property line to his proposed building is 150 feet. He knows of Vallco Park building constructed in this 150 feet. He also knows of Vallco Park buildings that violate the line -of -sight provision. Mr. Richard Love, representing Hewlett Packard Data Systems, ex- pressed the Hewlett Packard concern. He said they do not wish to hold up the Westfield Company, however, they have made a sub- stantial investment in Cupertino. One of the main concerns is -the planned development. They see the danger of their property being whittled away as the ground rules change. Those companies that do not develop right away will be the ones who will be penalized the most. They requested guidelines so they may plan for the future. Comm. Gatto said the trips per acre have not changed but the uncommitted properties have been reassigned. They are concerned that perhaps once the regional shopping center is built the traffic will be -such that the City may say the 17 uncommitted acres is not enough. Mr. Ward said that Mr. Rose is correct in that Vallco Park has variances to the setback which have been approved by the cities of Santa Clara and Cupertino. Mr. Rose said it is impractical to put the loading docks on the ends of the buildings. In regard to the 25 ft. buffer, during the layout they were lead to believe that they had the option of a masonry wall, which they preferred. Mr. Will Lester said he was unable to attend the last meeting and Mr. Ward has been carrying the ball for Vallco Park. He considers his property as a part of Vallco Park. He and Mr. Ward met with the staff the afternoon of this meeting. He considers his property a part of Vallco Park and they do not wish to hold up the Westfield project. However, he believes it would be to the advantage of the City and the entire Park if the conditions suggested are incorporated into the approval. PC -155 Page 5 PC -155 Page 6 MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING COMMISSION Mr. Jim Blair stated he represented the contractor for this proposal. 4. They have kept the buildings as far from the residential as possible. They feel the combination of landscaping and a 6 ft. wall is better than 25 ft. of landscaping. The layout dictates the location of the doors. This building will probably be occupied by an R&D electronic facility rather than a trucking or loading firm and these 'will probably be closed most of the time. The Associate Planner reviewed the entire proposal at this time per the request of Comm. Cooper. It was noted the applicant plans very intensive planting along the property line. He would like two driveways onto Pruneridge. There is a 30 ft. setback on Tantau. The Director of Public Works said as of today, parking is not allowed along Tantau. Bike lanes will probably be installed. Comm. Woodward was answered, by Mr. Smith, that if the landscaping were sufficiently dense the 6 or 8 ft. wall would not be an issue. Mr. Rose answered Comm. Cooper that they have had 8 or 9 different:. layouts for this site, all within the Code as they understand it. They have positioned the building as far away from the residences as possible and still give the setback on Tantau. Some 60 parking spaces would be lost with the additional 15 ft. of landscaping. Considerable study has gone into the planning for this proposal. The Director of Public Works answered Comm. Cooper that provision in the parking lot for compact cars would give more parking spaces.' Mr. Blair said they have looked at several designs with underground parking. It would be completely impractical unless it represented additional sq. footage to the building. This could mean multi -story. One of the things the residents like about this proposal was the low profile. Mr. Lester said he lives on the site. He gets the most calls from irate neighbors. They have problems with hot rods, motorcycles, kids, etc., who don't seem to consider their neighbors. There is already a 6 ft fence behind these residences and the masonry wall would act as• a substitute for them. He would like the 25 ft. peripheral landscaping buffer continued. MINUTES OF JUNE 10, 1974 P.EGULAR MEETING OF PLANNING COMMISSION Patty.Brisco, Monta Vista, recommended a model of the proposal be presented. She noted that the new Ralph's Supermarket on Highway 9 is a very large building, very close to residential. The more open space between the commercial or industrial and the residential areas the better. Moved by Comm. Adams, seconded by Comm. Gatto to close the public hearing. Motion carried, 5-0 Condition 16 was thoroughly discussed and it was the concensus that the.25 ft. buffer would be better than Mr. Rose's proposal for the wall and the lesser amount of landscaping. Moved by Comm. Adams, seconded by Chairman O'Keefe to deny application 20-U-73 after it was determined that Mr. Rose wanted a decision at this meeting. AYES: Comm. Adams, Cooper, Chairman O'Keefe NOES: Comm. Gatto, Woodward Motion carried, 3-2 The Assistant City Attorney recommended findings be made on this decision. Comm. Adams said the reason for denial is that the 25 ft. buffer planting tone, around the entire Industrial Park, would be broken if this 4.5 acre parcel were allowed the solid wall and 10 ft. of landscaping. This is not in keeping with the General Plan of development of this Park. The Assistant City Attorney advised the applicant may appeal in writing within 5 days to the City Council. If the City Council decides not to uphold the Planning Commission's decision, the matter can be sent back to the Planning Commission without public hearing for a review and a report. 2. Application 1.0-U-74 of THE WESTFIELD COMPANY: USE PERMIT to allow construction of one one—story building containing 19,400 square feet. Said property is within a P (Planned Development with light industrial intent) zone and is located at the northwest corner of the intersection of Pruneridge and Tantau Avenues. First Hearing. PC --155 Page 7 Application 20-U-73 denied PC -155 MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING COMMISSION Page 8 The Associate Planner reviewed the June 5th staff report on this matter. The ground rule for trip and intensity were revised. This property represents the niche in the property dominated by Hewlett Packard. The approved Hewlett Packard plan called for an access to the street and the staff recommends a joint driveway which will require some kind of agreement. Comm. Adams wanted to consider some type of commitment with regard to participation in future transit. Condition 18 in the June 5th staff report for 10-U-74 was modified to include the following phrase at the end of Condition 18: "The degree of participation to be determined at a later date." Chairman O'Keefe asked for comments from the audience. Mr. Terry Rose, stated that in regard to Condition 16, they addressed this problem of joining driveways in the past on their second project. At that time, it was suggested they discuss the matter with Watkins Johnson. Watkins Johnson was very much against this because it could be'a security problem. It is his impression that Hewlett Packard would feel the same. Therefore, he would like the driveway as proposed. On Condition 17, he would like to resist the elimination of the driveway. They will go along with right turns only. He went along with the other conditions as stated in the staff report. Mr. Gordon, of Hewlett Packard Company, said they have no intention of using that exit. They would be opposed to a common driveway because of the perimeter berming. Comm. Gatto said that if the curb cut is allowed no amount of signing will effectively prevent left turns. Comm. Woodward suggested an exit so close to the intersection, with a 3 1/2 ft. high berm, could be a hazard. Comm. Adams said he would be in favor of closing that curb cut. Moved by Comm. Gatto, seconded by Comm. Adams to close the public hearing. Motion carried, 5-0 Moved by Comm. Adams, seconded by Comm. Gatto to approve application 10-U-74 subject to the conditions as noted in the staff report with the following exceptions: Delete Condition 16, at the end of Condition 18 add "The degree of participation shall be determined at a later date." Condition 19: no outside chemical or gas storage tanks or other outside storage MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING CONNISSION facilities are to be constructed without the review and approval of the Planning Commission. The purpose of said review shall be to ascertain the visibility, atmosphere and safety impacts on the adjacent area and the reduction of parking spaces within the site. AYES: Comm. Adams to recommend to the City Council that the construction phasing of Valico Park be amended to reflect the following: The 17 acres of the 69 acres within the uncommitted property to be released for development but that it be recovered by including undeveloped landE of Hewlett Packard and Watkins Johnson, to share in the recovery of the 17 acres by a method to be determined at a later date. It is further agreed that by the release for Westfield Company that the Hewlett Packard, Watkins Johnson and Will Lester properties shall absorb the Westfield share toward the recovery of the 17 acres. Chairman O'Keefe announced that the balance of the Agenda not covered at this meeting will be continued to June 20, 1974. On June 12th there will be a study session on the Hillsides Develop- ment, June 19th the Regional Center will be covered and on June 20 will be the remainder of this Agenda. Comm. Cooper announced she will be out of town on June 20 to 27th. 3. Application 5-V-74 of VALLCO PARK, LTD.: VARIANCE to con- struct 9 -foot high modular precast security wall, on northerly terminus of Meadow Ave. on Vailco Park property. Said propert: is in a P (Planned Development with light industrial intent) zone and is located at the southerly property line of Intersil Inc., 10900 North Tantau Avenue. First Hearing. PC -155 Page 9 PC --155 Page 10 MINUTES OF JUNK 10, 1974 REGULAR MEETING OF PLANNING COMMISSION The Associate Planner located the proposed wall on the map. The main purpose of the wall is to prohibit people from trespassing on the Intersil property, it will not be seen from Tantau. Mr. Will Lester said the reason for this 9 ft. high wall is that there is a 3 ft. barricade at the end of Meadow Avenue and children can climb onto this barricade and get up over a 6 ft. wall. This wall is 218 ft. long and hasthe approval of the adjacent residents. This is at the top of the berm. He said they did not want to destroy the existing residential landscaping. Comm. Gatto was concerned about the visual effect of a 9 ft. high solid wall at the end of Meadow Avenue, even though the applicant has said that it will have a texture. Mr. Walter Ward said they have replaced a 6 ft. cyclone fence here sometimes as often as every day. It is not possible to keep the cyclone fence. Moved by Comm. Adams, seconded by Comm. Cooper to close the public hearing. Motion carried, 5-0 Moved by Comm. Gatto, seconded by Chairman O'Keefe to approve application 5-V-74 with the stipulation that a setback of 3 ft. for the width of the barricade at the end of Meadow Avenue be incorporated into this solid 9 ft. wall, landscaped as approved by the staff. The justification of this variance is undue hardship through the business because of a trespassing problem. AYES: Comm. Adams, Cooper, Gatto, Woodward, Chairman O'Ke•efe NOES: None Motion carried, 5-0 ENVIRONMENTAL REVIEW COMMITTEE — Recommendation for Negative Declaration The Planning Director said since the adoption of the Environmental Quality Act in 1970, the ERC (Environmental Review Committee) makes a determination whether or not an EIR will be necessary. The ERC is composed of one Planning Commissioner, one Councilman, the City Manager, the Director of Public Works, and the Director of Planning and Development. Application 3-U-74 of VALLCO PARK, LTD. was continued to June 24, 1974. k MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING COMMISSION 13. --Applications 14-Z--74, 11-U--74 & 14 -TM --74 of ADOLPH FIRENZI: REZONING 1.9 acres from R3--2.2 (Residential, multiple, 2,200 sq. ft. per dwelling unit) zone to P (Planned Development with commercial intent) zone or whatever zone may be deemed appropriate by the Planning Commission; USE PERMIT to allow the construction of a furniture store containing approximately .25,275 square feet; TENTATIVE MAP to combine two parcels. Said property is located southerly of and adjacent to Stevens Creek Blvd. and Blaney Avenue. First Hearing. The Associate Planner identified the property on the transparency map. It is adjacent to the Fisherman's Village Restaurant. The proposal is consistant with the trip standard of 16 trips per acre at peak hour. The applicant is talking about a 27 ft. set- back. from Stevens Creek Blvd. and a 25 ft. rear yard setback adjacent to the residential. The landscaped area between the Fisherman's Village parking lot and adjacent residential is 30 ft. Our ordinance requires a 6 ft. masonry wall between commercial and residential zones. Comm. Woodward said that it has been brought up previously that a double fence could create a problem with rodents. The Associate Planner spoke to the interrelationship between this and the adjacent vacant property. A reciprocal driveway is one of the conditions recommended by the staff. Architect Terry L. Lofrano said that basically they agree with the conditions of the application except Condition 17 regarding the driveway and interconnection of properties. The question is the ability of the owner to be subject to a nonexistent neighbor. The possibility of relocating or eliminating a driveway could be a hardship. They are going to great lengths to preserve a very large tree on the property. They have taken all the parking away from the front and put it at the side and the rear and have created an entrance on the side. He only has one form of vehicular exposure to the street.. Comm. Gatto stated the City would have public •hearings on any plan to move the entrance to this property. Mr. Lofrano answered Comm. Gatto that they will be open from 10 A.M. to 5 P.M.. with the personnel leaving at 6 P.M.. They will probably be open on Sunday and two nights a week. They will handle Drexel and Heritage furniture. The majority of it will come in railroad cars and they will probably use commercial warehousing in the railroad yard. Because of the size of the PC -155 Page 13 PC -155 Page 14 MINUTES OF JUNE 10, 1974 REGULAR MEETING OF PLANNING COMMISSION deliveries, they will probably be handled in the mornings. There will be deliveries to the customers during operation hours, but rarely on Saturday or Sunday. At the present time they have only one other store, in Daly City, but they plan to have 200 of these throughout the country. There will be a portico across the front and they will need the architectural requirements of the City. Chairman O`Keefe asked for comments from the audience. There were none. Moved by Comm. Gatto, seconded by Comm. Adams to close the public hearings. Motion carried, 5-0 Comm. Gatto said this application fits the exact mold of our General Plan in that it is a low traffic generator, it has a landscaped front. Comm. Woodward wanted to add "It may be necessary to require the removal of parking spaces in conjunction with the implementation of this condition" to the end of Condition 17. Comm. Cooper asked if there is a reason that the 50 ft. landscape buffer on Stevens Creek Blvd. was unable to be attained here. The Planning Director said there is no documentation of the 50 ft. require- ment at this time. After further discussions it was moved by Comm. Gatto, seconded by Chairman OKeefe to approve application 14-Z-74 subject to the 14 standard conditions. Conditions 15, 16,,and 17 (as amended by Comm. Woodward) and Exhibit A shall be amended to show a 50 ft. front setback and a 22 ft. rear setback. AYES: Comm. There is an intensity transfer. Four lots are to be created with the new tentative map. The proposal is to construct a series of individual bays whichwill be rented to various types of users - such as homeowner's, apartment dwellers, businessmen; etc., who do not have adequate storage space where they live or work. The site has very limited visual impact.. The freeway is depressed in this area about 30 ft.. The Mini --storage buildings are 9 ft. high. The buildings themselves will act as a solid. wall. There has been some discussion as to the ;Sheriff and Fire Departments access to the property. f Architect Charles Rasmussen, 1.150 Chestnut Street, Menlo Park, said the users are the people who wish to store things which they don't have room for otherwise. They will not be storing boats or trailers or that sort of. thing. Re explained how the Fire Department could service the area. He then answered Comm. Cooper that they, would like to coordinate the exterior building materials throughout this area with perhaps something that simulates slumpstone.. He then went over the details of the elevation drawings. There will be a wood fence. Mr. Rasmussen agreed with Comm. Woodward that there is the potential for some tresp*ssing. However, there is 24 hour managerial :surveillance. He answered Comm. Cooper that the sign specifications have been referred to the staff. They have discussed signing along the common driveway. Mr. Rasmussen further stated that the 1.88 trip end factor may be figured high. Chairman O'Keefe asked for comments from the audience. Mrs. Dorothy Zefzutel:, 1.071.0 North Blaney Avenue, Cupertino, said she had a similar proposal for 1.66 acres on Blaney Avenue. She has researched this operation and believes that this is a very good plan. She requested a statement from the Planning Commissioners whether or not this mini --storage would be 'too close- to have same type of operation on her property. The Chairman explained that the Commissioners can not prejudge an application. Moved by Comm. Gatto, seconded by Comm. Woodward to close the public hearing on application 12-U-74. The staff recommends the half -street section be approved with stipulations that a mini cul-de-sac be constructed, the location of which shall be determined by the Director of Public Works. Comm. Gatto stated he would be more in favor of a monument sign. It creates a much better identification than wall signs. The need for a pole sign in an industrial park is probably minor. The division of individual properties does not necessarily mean individual pole signs will be allowed. Mr. Rasmussen said he does not represent the Steak and. Ale Restaurant, He said when youlimit the signing to one monument sign this would be pretty low and may not be seen from the free- way or from Saratoga -Sunnyvale Road. Moved by Comm. He said the applicant is proposing a new parking design labeled "The Drachman System" which is a system that recognizes the trend toward the use of compact cars. It utilizes 90° angle parking spaces for compacts and 60° parking spaces for standard size cars. The applicant is proposing a total of 495 spaces of which 180 will be compact spaces. The total requirement for the industrial complex is 412. Another problem is that the 90° parking dis- courages larger vehicles from using the smaller spaces but there is nothing to discourage the smaller vehicles from taking up the larger spaces. Mr. John Sobrato, 2775 Middlefield Road, Palo Alto, said the building coverage here is 34%, whereas most of their buildings cover 30 % of the laud. He has never tried this Drachman System and is not totally convinced of its merit. There is. a trend toward smaller cars. The parking in the front will be reserved for visitors and employee parking will be in the rear. Comm. Cooper wondered if there could be an exchange of parking between this and the property labelled "Exception". Mr. Sobrato said he would be very happy to sit down and talk with whoever buys this "Exception" property. He answered Comm. Cooper that the "Loading Area" could be used as a tank farm. The tenant always needs an area like th:i_s for something and in case the parking does not work this cou..d be made into additional parking. Cooper noted the access to the rear parking is between the buildings. At night it will be impossible to back out of parking spots along side the buildings because cars will be steadily coming down the aisle. The possibility of putting the two buildings together was explored next. Chairman O'Keefe said the role of the small car must be taken into consideration. However, he would like to do more study on this before making a decision. Mr. Sobrato said he is scheduled for H --Control the following Wednesday. He wondered if the Planning Commission could approve this proposal in concept. Comm. Adams. stated that if the Planning Commission approved this, this would freeze the building layout. Comm. Cooper would prefer combining two of the buildings and allow better access to the rear parking lot. Comm. Woodward would like to see one curb cut deleted if at all possible. It was noted there are three curb cuts on Valley Green Drive. Comm. Mr. Sobrato stated there will be a meandering and undulating walk. Comm.
