Page 9, second paragraph, first line, delete "realistic" and replace with "idealistic". Page 14, delete third paragraph. Page 4, second paragraph under sub -paragraph A, delete the words "the area adjacent to" in the first line and the word "maintaining" in the fourth line. Moved by Comm. Gatto, seconded by Comm. Woodward to approve the Minutes of April 8, 1974, as amended. Motion carried, 4-0 POSTPONEMENTS The Associate Planner said the staff is suggesting agenda items 1 b and I c be continued in addition to items 2 and 3.. The staff further suggested a study session on these items prior to public hearing. The applications 20 -TM -73 and 21 -TM -73 are also recommended for postponement since the applicant is interested in applying for a variance along with the tentative map. Chairman O'Keefe stated that Mrs. Tenaka has also requested a postponement of her application. Moved by Comm. Gatto, seconded by Chairman O'Keefe to continue agenda items 2 and 3 to May'28, 1974. Motion carried, 4-0 Mr. F. E. Robles, an applicant, stated he wished to withdraw application 21 -TM -73 and have 20 -TM -73 continued, his reason being that they do not wish at this time to combine both properties. He would like to make sure that 20 -TM -73 is a buildable lot. He will be asking for a variance. The building pad is very small. The Associate Planner stated that normally, the Planning Commission ' asks that an item be taken off calendar. When they are ready to proceed, the City advertises it at no further charge to the applicant. e MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING Comm. Gatto stated that Mr. Marquese, owner of adjacent property, was at the last meeting and stated he would be unable to attend a Planning Commission meeting for the next 6-8 weeks. Moved by Comm. Gatto, seconded by Comm. Cooper to take application 20 -TM -73 off calendar. Motion carried, 4-0 Moved by Comm. Gatto, seconded by Chairman O'Keefe to take appli- cation 21 -TM -73 off the agenda. Motion carried, 4-0 WRITTEN COMMUNICATIONS 1. Letter to Mayor Sparks from Mayor of City of Santa Clara, regarding the Westfield application (agenda item 7) and suggesting the Planning Commission review some suggestions listed in the appendix of his letter. 2. Letter from St. Joseph's Church representative regarding a portion of their property being considered for review in connection with core area.land use designations. ORAL COMMUNICATIONS Dorothy Gray, 762 Edgewood Lane, Los Altos, Vice -Chairman of Santa Clara County Historical Association, stated that some property has come to their attention, along Henny Creek, west of Foothill Blvd., and near Mary Knoll, on which there is a one -room school house that was built in 1870. There are 50-60 acres of rolling terrain here, with a year -around creek. Since this area lies along borders of Cupertino and Los Altos, they would like to have this considered in the General Plan hearings for open space and perhaps there can be some joint effort for retaining this as open space. The Associate Planner stated that the property is within the City of Los Altos. It is next to•the 20 -acre property zoned for apartments. The present open space plan does s'hhow the area along the creek as open space. In conversations with Mrs. Lucien Hertert, the Associate Planner has learned that interest has been shown in the preservation of the school house. PC -147 Page 4 MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING Mr. Max Maas, 10585 Merriman Road, Monta Vista, stated that the only way he got notification of public hearings in his area was in mail addressed to "Resident", with his address on it. The Associate Planner explained that the staff uses the County Assessor's records, and notifications are normally addressed by name. Attorney James W. McKeohen, 39239 Liberty Street, Fremont, Ca., said he was present at this meeting in regard to Area 21A. Although it has already been designated, they were not aware of the public hearing. His half -acre is contiguous to the ARCO station on Foothill Blvd, and the half acre across the street, zoned CG: Under the proposed changes, it would drop from 10 units to 4.4 units, and from general commercial to 4.4 units per acre, respectively. They have developed Westridge and the proposed rezonings would constitute a severe financial loss. Developer Donald J. Bahl, P.O. Box 911, Campbell, Ca., said he has been talking with the staff for several months on the development of this property. He understood that all that was needed was a building permit and he was unaware of the rezoning hearings. The Associate Planner stated that this property is not in the interim zone, and the office has been processing plans. Mr. Jim Gillmann, of Chappel Industries, said they were notified last summer that there would be hearings on this property but never knew just when they would take place. It was suggested the above persons speak with the Planning Director during the week and come back to the Planning Commission to talk about a specific development. Setsuko Tanaka, 1334 Brookdale, Mountain View, said that only six weeks ago she learned her property is being considered for rezoning. They are living in Mountain View and learned through their realtor that their property is being considered for R1 instead of R3. The property is located in Area 23. She was instructed to get in touch with the staff. PUBLIC HEARINGS: 1. City of Cupertino: Public Hearing to consider ].973 Comprehensive General Plan. A. Discussion of Infilling of Valley Floor The Associate Planner said Area 21A, northwest corner of Stevens Creek Blvd. and Foothill Blvd., was the last area discussed at the previous meeting. MINUTES OF THE, APRIL 22,. 1974 PLANNING COMMISSION. MEETING The. Associate Planner stated that Area C has been mixed County and City of Cupertino. There are duplex developments clustered along Alcalde and Santa Lucia, but the area is predominently Rl -10. The Planning Commission has determined the vacant land should remain single family. Mr. Max Maas, 10585 Merriman Road, Monta Vista, presented pictures of the "junk yard" in the area. It was his contention that the only hope of getting this blight cleaned up is to allow duplexes here. He spoke of the fire hazard in the older, existing building; Horses are out, and the yard is not properly cleaned up. He says that he has to live with the flies and the stench. Mr. Robert Seffelite, 22562 Alcalde Road, Cupertino, stated that his property is in the City of Cupertino but is surrounded by County property. He has three duplexes now and plans'to build three more. Two years ago they planned to build a convalescent home, but those plans were abandoned. Comm. Cooper asked if there is an access problem with these vacant lots. The Planning Director said that generally speaking, they do have access to public right-of-way. He added that a majority of the lots are in excess of the required square footage for duplexes Comm. Cooper did not see any reason for not allowing duplexes in this area. Mrs. Nancy Hertert, San Juan Road, said she hopes as much as possible of the land up there can be in single family dwellings. There has been talk about mixed zoning. There are many small homes on large lots in the area. There is a school and a park. There are many people who are asking for single family homes. Jackie Hall, 10629 Baxter, Los Altos, reinforced Mrs. Hertert's statements in regard to the feeling of many people in the area who prefer single family homes to duplexes. Comm. Gatto said that something to take into consideration is the fact that about 80% of the area is developed. The nature of that area is most important. There is justifiable evidence that Foothill Blvd.. could have duplexes, Merriman could go single- family, and Santa Lucia could go single-family. Moved by Comm. Gatto, seconded by Comm. Woodward that the area fronting on Alcalde, between Merriman and Foothill, and Foothill between existing commercial and Alcalde be designated duplex zoning. AYES: Comm. Area 22, northeast and southeast corners of McClellan and Stevens Canyon Road had been given duplex zoning. Chairman O'Keefe asked for comments from the audience. There were none. Moved by Comm. Gatto, seconded by Chairman O'Keefe that the consensus for Area 22 was 4 to 7.6 units per acre. AYES: Comm. Cooper, Gatto, Woodward, Chairman O'Keefe NOES: None ABSENT: Comm. Adams Motion carried, 4-0 Areas D and E, along Linda Vista and Rae Lane area, have a 0 to 4 residential pattern in the area. The Chairman asked for comments from the audience. There were none. Adams Motion carried, 4-0 MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING Northerly of Lindy Lane (Candy Rock Mountain) Juanita McLaren, 22101 Lindy Lane, Cupertino, presented slides and a map of the area. She has lived there for 18 years. In January of 1966 they were an island of homes sitting there and asking for annexation. At that time, 6,70 acres were annexed. In 1967, after a great deal of study and many hearings, they were rezoned. Their families have grown and now they are left with very large proper- ties. In order to keep the weeds down, they have allowed horses to graze there. There are six existing homes there now. She does not believe they should be considered along with Mt. Crest Drive, which is developed. They have asked for half -acre lots. She asked that the present zoning be retained because of the view lots locations of the existing homes, fire hazards, and because they would like to retain their privacy. Mr. John Stetzmiller, 21950 Lindy Lane, said his property is adjacent to the McLaren property. He moved there six years ago on the basis of the rural atmosphere and so they could have a horse for the children to ride all over the area. He asked for continuance of the half -acre zoning. Mr. Dennis Palsooger, 10328 Cold Harbor, said he is currently in _ the process of purchasing the Cassisi property. The entire area is surrounded by dwelling units on 1 to 4 acres. There are at least eight nicely landscaped homes along Lindy Lane, facing the Cassisi property. There is lots of poison. oak. The property was originally 2.1 acres but is now 1.823 acres. If this is desig- nated one acre lots minimum it would no longer he dividable. Mr. George Langstaff, 21925 Lindy Lane, said he is adjacent to property being developed on half an acre, with another in the offing. There are some 10,000 sq. ft. homes along Lindy Lane. He said we should save the flat lands for farms and orchards and put the homes in the foothills. Comm. Gatto said. Candy Rock is a living example of what happens with a cut -and -fill situation. Taking advantage of the terrain and then applying half -acre lots throughout the area is the plan with the most merit. The entire question hinges on the Hillside Study, even though this property is below the 600 foot level. He believes that half -acre zoning overall is too dense. He is inclined to go with the one —acre zoning. The Planning Director answered Comm. Cooper that the Planned Development Ordinance would most likely be the vehicle to use to develop the flat portion of this property. Although .it is below the 600 foot line, we should try to maintain the character of the area. He did recognize the hardship in keeping the brush down, etc., in the area. Moved by Comm. Gatto, seconded by Comm. Cooper, that the consensus for Area F was 0 to 2 density PD designation. AYES: Comm. Cooper, Gatto, Woodward, Chairman O'Keefe NOES: None ABSENT: Comm. Adams Motion carried, 4-0 It was decided there would be a study session on agenda items 1 a, 1 b and 1 c on May 1, 1974, at 7:30 P.M. Chairman O'Keefe asked. the status of the Saich property at Stelli.ng.and Stevens Creek Blvd. The Planning Director said the open space primary designation has been taken off the Core Area General Plan Map since the City Council did not feel it could be purchased within the foreseeable future. Now the property has a 12 to 16 units per acre designation, which was. the underlying designation. Moved by Comm. Gatto, seconded by Comm. Cooper that items 1 a, 1 b and 1 c be continued to the adjourned meeting on Wednesday, May 1, at 7:30 P.M. in the Council Chamber. Motion carried, 4-0 Recess was called at 10:22 P.M. by Chairman O'Keefe. The meeting reconvened at 10:42 P.M. 4. Application 15-Z-73 and 18 -TM -73 of DAVID & THELMA B. CAMPBELL: PREZONING 0.66 acre from Santa Clara County Rl--10 (Residential, single-family, 10,000 sq. ft. per dwelling unit) to City of Cupertino Rl-10 (Residential, single-family, 10,000 sq. ft. per dwelling unit) zone or whatever zone may be deemed appropriate by the Planning Commission; TENTATIVE MAP to divide 0.66 acres into two parcels. Said property is located at 22701 San Juan Road. First Hearing continued. The Associate Planner stated this application was continued from the meeting of February 25th to allow the staff and applicant to consider the availability of sewers to this area and to study hillside development in general. MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING It was the staff's judgment that this proposal can be evaluated independently of the General Plan study because of its location and the nature of the surrounding development. The Associate Planner answered Comm. Gatto that the staff still recommends denial of this application; however, if approved, the staff has recommended some conditions which are listed on pages 4 •and 5 of the February 22, 1974 staff report. The south side of San Juan Road has recently been rezoned by the County Board of Supervisors to a slope density formula. The Associate Planner said the issues here are the rezoning from County R1-10,000 to City of Cupertino R1-10,000, and the tentative map. A map showing contours was displayed. This proposal will require a 21% driveway. The fire department is hesitant to service more than a 20% gradient; however, they have indicated they could probably go along with this as long as they have adequate turn -around space. The staff feels that if this driveway is allowed it will be against present policy. This is the center lot of three undeveloped lots. Chairman O'Keefe asked for comments from the applicant and/or audience. Mr. Bill Sampson, 101 Glen Eyrie Avenue, San Jose, said he was representing the owners of the property and the developer. He showed a series of slides of the property from various angles and directions. The lower portion of the property is densely covered with shrubs, one oak tree, and poison oak. He pointed out that there would be a minimum of fill. He said there is a very good possibility of running the sewer line between the two properties, down to the existing line on Santa Lucia. Mr. Sampson demonstrated on a map that he had prepared how it was feasible to construct a home down the hill from the Campbell home, but not on the other two adjoining lots, due in large to the problem of access. There is the possibility, with a little more fill, that the driveway could be 20% rather than 21%. There is a 30% slope on the property; however, with a minimum amount of grading and disturbance of shrubs and trees, a home could be con- structed here. Comm. Gatto asked about the history of this subdivision. The Planning Director said that in 1917 Inspiration Heights was created. Mr. Sampson said the Campbell property consists of five of the original lots on the District map. PC -147 Page 9 pC-147 MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING Page 10 Comm. Cooper asked where the San Andreas Fault runs in relation to this property. The Planning Director said it is up on the other side of Stevens Creek, at least 2-1/2 miles from this property. The Associate Planner answered Comm. Gatto that the Associate Engineer's major concern with this proposal was the service vehicles' access to the property. It is marginal, but Engineering feels it is workable. Mr. Sampson added that portions of San Juan Road are 20% gradient right now. Moved by Comm, Gatto, seconded by Chairman O'Keefe to close the Public Hearing. Motion carried, 4-0 Comm. Gatto commented that he has less reservation about the zoning application than with the tentative map. This is very steep, but Engineering feels that it is workable. 15-Z-73 Moved by Comm. Gatto said he would like to condition the approval of the tentative map that all of these areas with cut and fill must be planted with erosion retardant type planting to insure stabilization of the graded area. Condition 20 Comm. Cooper would like to add the condition that the trees and shrubs shown in the slides shall remain so as to shield the home from Santa Lucia. 18 -TM -73 Moved by Comm. ROBLES (Juanita Williams). TAKEN OFF CALENDAR. 6. Application 21 -TM -73 of F. E. ROBLES (Juanita Williams). APPLICATION WITHDRAWN BY APPLICANT. At this point the Planning Director stated that after conferring with the Assistant City Attorney, it appears that Agenda Item 9 (3141-71 - De Anza Oaks) could not be discussed until duly advertised, since this is an application to modify a use permit that has been previously approved. The Assistant City Attorney said the Planning Director can make minor changes, but major changes must come before the Planning Commission with public hearing. Mr. Bob Hardesty, with Deane and Company, developers of De Anza Oaks, said he believes the modifications are minor. The owner of Lot 35, De Anza Oaks, felt that the homeowners should be represented at a meeting between the Planning Director and the developer regarding modification of the use permit when it is to be decided whether the change is minor or major. The Planning Director was not opposed to this. 7. Application 20-U-73 of THE WESTFIELD COMPANY: USE PERMIT to allow construction of two 32,340 sq. ft. light industrial buildings, a total of 64,680 sq. ft. Said property is within a P (Planned Development with light industrial intent) zone and is located at the southeast corner of the intersection of Pruneridge and Tantau Avenues. First Hearing. The Planning Director referred to details in the April 9th memo and attachments and to correspondence from neighboring property owners and the City of Santa Clara. Exhibit A was reviewed. The Director stated that the Environmental Impact Report has been prepared and is scheduled for Council review on May 20th. It was brought out that one major issue that would prohibit final determination by the Planning Commission at this meeting was the question of the status of the'69 uncommitted acres in Vallco Park. The Inter —City Agreement states that 150 feet from the property line, the building height shall be no greater than 16 feet. In addition, there is the request for a 25 -foot landscaped buffer. PC -147 Page 11 20 -TM -73 Taken off calendar 21 -TM -73 withdrawn PC -147 Page 12 MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING The staff stated there is some concern about service doors opening in the direction of the adjacent residential. The Director of Public Works summarized the stage -phasing, based on traffic. Comm. Gatto suggested computing this on the basis of parking stalls rather than size of buildings. The Director of Public Works said it has been determined that this type industrial use will generate 25 trips per peak hour. . Comm. Woodward agreed that limiting the parking would be effective. The City of Santa Clara could put up "No Parking" signs along certain streets to prevent overflow parking from the parking lot onto the streets. Mr. Michael W. Stout, 520 Meadow Avenue, Santa Clara said the volume of traffic as well as the curb parking should be considered here. If the traffic can't be decreased, then he would like them to look at ways of re -directing it. The Director of Public Works stated that the Tantau overcrossing will relieve the east -west traffic but will have very little effect on north -south traffic. It will have a great effect on the students walking to school. Comm. Woodward said he would like to attempt to resolve the problem confronting the neighbors to this property who came to this meeting. The Director of Public Works answered Comm. Gatto that the City has the money for the traffic signal at Tantau and Pruneridge for whenever we are ready to put it in. Comm. Cooper asked if bike lanes are being considered. The Director of Public Works said the City is planning bike lanes throughout Vallco Park. Comm. Cooper was answered by the Planning Director that it would be very difficult to enforce the staggering of work hours. (Comm. Cooper said she believes that schools located near light industrial is good planning as long as the schools and the companies don't have the same hours. Mr. Terry Rose, 21311 Milford Drive, Cupertino, said he returned from his vacation early to find that his application was on the agenda. lie said he wants to work with the neighborhood. Cupertino allows 40% building coverage; they are at 33%_ Tenants are not going to stay in a building that has inadequate parking. Ile feels the City's parking ratio for light industrial is adequate. He thinks the planned 6' masonry wall will inhibit noise. He would not like to position the buildings so the doors face the freeway overcrossing. 0 i MINUTES OF THE APRIL 22, 1974 PLANNING COMMISSION MEETING Comm. Cooper asked if the applicant was aware of the PD Zone and whether he understands the trips per acre formula. Mr. Rose said he had just read it the day of this meeting. Mr. Russ Ciota, 3054 Sullivan, Santa Clara, said there are 550 homes in Westwood Oaks area. He recommended some kind of shield to deflect the noise from the trucks. Katie Colety, 634 Hudson, Santa Clara, commented on traffic conditions. She is concerned because her children must cross the heavily traveled ways to go to and from school and to see their friends. The crossing guard told her this is the worst school crossing in Santa Clara. Mrs. Pat Monahan, 3876 Pruneridge, Santa Clara, has lived there some ten years. She heard promises of greenbelt, limits of height! of buildings, etc. She said there is a row of buildings along both sides of. Tantau that are generating a great deal of traffic. Mr. Rose said there will be a signal at Tantau and Pruneridge. Further, he will approach the City of Santa Clara about having the speed limit enforced and possibly reduced. Mr. Bob Welch, Meadow Avenue, Santa Clara said his property is adjacent to the property under discussion. He would like the Planning Commission to try to resolve the noise problem. Mary Stout, 520 Meadow Avenue, Santa Clara, feels the masonry wall will retain the heat. She would like alternative ways of reducing the noise to be considered. Comm. Gatto asked the Director of Public Works how many cars will be allowed on this site. The Director said they are planning 43 spaces per acre instead of the 50 spaces per acre allowed by Ordinance. Mr. Rose said he would get together with the staff to work on these numbers. Comm. Gatto would like to see one curb cut eliminated. He said the masonry wall is much better for noise abatement than landscaping. He would like to see some trees added. This would be much better than 25' of landscaping. Comm. Cooper would like to see a wider setback from the resident if the parking lot is. going to be reduced. Moved by Comm. Gatto, seconded by Comm. NORMAN AND LEO NORMAN: PREZONING .85 acres from Santa Clara County P.1-10 (Residential, single-family, 10,000 sq. ft. per dwelling unit) zone to City of Cupertino R1-10 (Residential, single-family, 10,000 sq. ft. per dwelling unit) zone or whatever zone may be deemed appropriate by the Planning Commission. Said property is located adjacent to and easterly of Crescent Drive approximately 320 feet northerly of the intersection of Cupertino Road and Crescent Drive. First Hearing. The Associate Planner said the reason for this application is the (City's water service policy. The staff recommended approval. He referred to the April 17th staff memo on this proposal. Mr. W. C.
