Page 3, paragraph 5, first sentence should be deleted and replaced with: "Comm. Gatto said a Town Center achieved is better than one partially achieved." Moved by Comm. Gatto" and replace with "Director of Public Works". Page 12, last paragraph should be deleted and replaced with: "The Planning Director indicated the recently adopted guideline is 30 days for the review period for an EIR. Our present guidelines allow a period of ten days for the draft of an EIR before hearings can be held." Moved by Comm. Gatto, seconded by Comm. Said property consists of .694 acre and is located within a Rl•-lO (Residential, single-family, 10,000 sq. ft. per dwelling unit) -zone located northwest of Mount Crest Drive and south of Linda Vista Drive. First Hearing. CONTINUED TO FEBRUARY 25, 197-+. 7. Application 2 -TM ---74 of VINCENT & DOMENICA MAGGIO: TENTATIVE MAP to adjust property line between two single-family residential lots containing approximately .433 acre. Said property is located at the southwest corner of Maggio Circle and Blaney Avenue and is within a R1-7.5 (Residential, single-family, 7,500 sq. ft. per dwelling unit) zone. First Hearing. The Planning Director explained the purpose of the lot line adjustment is to move the common lot line between Lots D and E 12+ feet to the west in order to reflect an existing fence line dividing the two properties, both of which are owned by the same persons. No utility service easement problems will result from the requested adjustment. Since there were no comments from the audience, it was moved by Comm. Nellis, seconded by Comm. Gatto to close the public hearings. Motion carried, 4-0 2 -TM -74 approved Moved by Comm. Nellis, seconded by Comm. Gatto to approve application. 2 -TM --74, subject to the 14 standard conditions. Application 1 -TM -74 of CITY OF CUPERTINO: TENTATIVE MAP to divide 4.15 acres into four parcels. Said property is located at the northeast corner of the intersection of Torre Avenue and Pacifica Drive and. is within a P (Planned Development zone with professional office and related commercial and quasi -public use intended) zone. First Hearing. The Planning Director referred to the excerpt from the November 16, 1973 City Manager's report which was attached to the Associate Planner's staff report of. February 8, 1974, which explains the purchase agreement. MINUTES OF THE FEBRUARY 11, 1974 PLANNING COMMISSION MEETING PC -14O Page 5 The Assistant City Attorney stated that the City Attorney has. indicated that we cannot obligate the City in the future by making a down payment of a certain amount of money for the entire propert and then make payments. This is a 4 —year purchase agreement. The property will.be•purchased in 4 segments. Mr. Anthony Musolino, 12985 Tenoak Way, Saratoga, confirmed that he has been negotiating with the City Attorney on this matter. Comm. Nellis questioned whether it was really necessary to divide this property into four segments at this time. She would prefer to divide only that portion currently being purchased by the City. Then one year from now, the City could divide again that portion it was prepared to purchase. Discussion followed. Since there were no comments from the audience, it was moved by Comm. Discussion of high density -zoned properties in the lower foothills that are inconsistent rith the General Plan. The Associate Planner stated that on January 8, 1974 the Interim Zoning Ordinance on the Montebello Ridge expired. He indicated on a map on the bulletin board those undeveloped properties in the foothills that have zoning that is completely inconsistent with th 1964 General Plan. C--140 age 6 ontebello Ridge ublic hearings nitiated MINUTES OF THE FEBRUARY 11, 1974 PLANNING COMMISSION MEETING The staff recommended that the City of Cupertino Planning Commission initiate a public hearing to change the zoning classifications on those properties as follows: 1. The 20+ acre property west of Foothill Blvd., across from the intersection of Alpine Drive, to be rezoned to A1-43. 2. The property located at the western terminus of Voss Avenue to be redesignated from R3-2.2 to Al --43. If the Planning Commission proceeds alongthese lines, an environmental assessment would be required. After discussion, it was moved by Comm. Nellis, seconded by Comm. Gatto to direct the Planning Director to initiate a public hearing to consider rezoning of specific properties formerly designated Montebello Ridge Interim Zone to a zoning classification which is consistent with the 1964 Cupertino General Plan.. Discussion of City Council referral of Planned Development Ordinance. The Associate Planner recapped the discussion of the Planned Development Ordinance at the last City Council meeting. Comm. Nellis said she would hope the City Council would define the responsibilities of the. Planning Commission and of the Architectural and Site Approval Committee. The Planning Director stated that his department is researching how other cities are accomplishing this. The City Council has continued the matter to their next meeting.
