Subject: Director's Minor Modification (DIR-2009-17) to allow an approximate 2,000
square foot single story expansion to an existing two story home.
Chapter 19.132 of the Cupertino Municipal Code allows for administrative
approval of minor changes in a project. The Director reports his decision to the
City Council and Planning Commission in time to allow any Council member or
Planning Commissioner to appeal the decision within fourteen calendar days.
DISCUSSION:
The project property is located in a R1-7.5 zoning district located at 10650 Santa Lucia
Road. Typically, increasing the size of a second story would require Two Story Permit.
However, because the only part of the second story that is being modified is the roof, a
Director's Minor Modification is required.
Although the plate height is increasing by 18-inches, the roof is being reconfigured from
a gable roof to a hip roof. The highest point of the ridge would be setback, thereby
minimizing the visual mass of the roof. The project meets all R1 development
regulations, including second story setbacks and height requirements.
The second-story windows will also be reoriented and enlarged along the rear and the
right side, and will be required to provide privacy protection consistent with the R1
Ordinance.
ACTION:
The Community Development Director deems the project minor and hereby approves
the modification with the following conditions:
1. PRIVACY PLANTING
The final privacy-planting plan shall be reviewed and approved by the Planning
Department prior to issuance of building permits. If existing tree(s) is used for privacy
screening, a letter from a certified arborist shall be submitted confirming that the tree(s)
is in good condition and is appropriate privacy protection in any season.

2. PRIVACY PROTECTION COVENANT
The property owner shall record a covenant on this property to inform future property
owners of the privacy protection measures and tree protection requirements; consistent
with the R-1 Ordinance, for all windows with views into neighboring yards and a sill
height that is 5 feet or less from the second story finished floor. The precise language
will be subject to approval by the Director of Community Development. Proof of
recordation must be submitted to the Community Development Department prior to
final occupancy of the residence.
The approval is effective August 13, 2009. The fourteen-calendar day appeal period will
expire on August 27, 2009.
