HomeMy WebLinkAboutCC 04-21-2026 Item No. 15 Amend 2025 Building Code Adoption_Staff PresentationCC 4-21-2026 #15 Amend 2025 Building Code Adoption Presentation Building Code Amendment Background •November 18, 2025: The second reading and adoption of the code adoption Ordinance and Resolution. •November 26, 2025: The adopted/approved copies were submitted to the California Building Standards Commission (CBSC) for review and acceptance per Health and Safety Code Sections 17958.7 and 18941.5. •January 16, 2026: The CBSC issued a partial acceptance and requested additional findings for three proposed appendices and two Residential Code amendments proposed by the Santa Clara County Fire Department (SCCFD). Background •February 10, 2026: A preliminary response was submitted to the CBSC after consultation with SCCFD. The response included: 1.The requested findings for the adoption of the three appendix chapters. 2.Code Sections R328.3.1 and R328.4 adopted in the 2022 CRC are substantially equivalent to the amendments being proposed to the 2025 CRC. •February 18, 2026: CBSC only partially accepted the justifications for the Residential Code amendments. The amendment to R330.4 included new language and per AB130 could not be accepted. The proposed amendment has been removed from the ordinance. Options •The adoption of the proposed Appendices and Residential Code amendments is necessary to address the local climatic, geological, and topographical conditions that directly impact the health, welfare, and safety of the Cupertino residents. •Actions promote regional consistency in code application and enforcement, particularly regarding Energy Storage Systems (ESS), which are critical for both fire safety and energy resilience. •If the recommended action is not adopted, the City will continue to have partial acceptance from the California Building Standards Commission (CBSC), leading to regulatory uncertainty and potential conflicts between local enforcement and state requirements. Recommended Actions 1. Adopt Resolution No.26-___Amending Resolution No. 25-092 Making Findings Relating to Local Climatic, Geographical, or Topographical Conditions Supporting Amendments and changes to the 2025 California Building Standards Code, and Amendments/Changes made to adopted Resolution 25-092. 2. Introduce and conduct first reading of Ordinance No. 26-___:“An Ordinance of the City Council of the City of Cupertino amending Chapters 16.02, 16.04, 16.06, 16.10, 16.16, 16.20, 16.24, 16.40,16.42, 16.54, 16.58, 16.62, 16.64, 16.68 and 16.80 of Title 16 of the Cupertino Municipal Code.
